Well, I hope it wasn’t strictly according to ADP purchases: many didn’t participate
in ADP because of import taxes / shipping unknowns.

Take a look at the Kakapo. You'll see there are still sets left to purchase
in North Korea.

I don’t think the gauge was very accurate or timely.  And it may even have reported
3,500 when it already should have reported 7,000 or more (you know, “glitch”).

You need to go back to how the sets were selected:

Who will be invited?
Select designers whose project(s) acquired 10,000 votes on LEGO Ideas, but were

Program, in addition to a few other projects that we know we unfortunately can’t

So, there’s several possible reasons:
1. IP,
2. can’t be realized,
3. the designer didn’t agree,
4. the designer couldn’t agree (as belatedly happened with one designer).

To which we can add:
5. they couldn’t invite 40 or 50 designs,
6. and, obviously, the Anti-pirate Faction OverLords.

That’s a question that could have been asked as soon as the project were revealed
in March.  It might have been too.  But I think the answer was / would be the
same vague answer TLG makes for Ideas.
(They don’t want to give specific reasons when they can because there are times
when they can’t and it would be unfair, and the reasons aren’t always very nice
to the designers.)

For now, BL can only collect taxes with Onsite payment methods (PayPal Onsite
& Stripe).

BL doesn’t propose other payment methods to your buyers if there’s taxes to be
collected.

That means:
— most US buyers: always,
— UK buyers: if the amount is under £135,
— EU buyers: if the amount is under €150 and they are not VAT-registered on BL.

So your buyers shouldn’t be able to choose any other way.

If they still want to pay you, or do pay you, another way, then you should refuse
/ refund and ask them to use the onsite method, or cancel.

Sorry, my tone was harsher than intended.
But the purpose wasn’t for you to actually prove anything but to make you realize
that it’s neither obvious nor their task for a buyer to check whether your shop
is a business that is registered, incorporated, or what not, or an individual
who’s dumping a dozen of sets and will be gone, or anything in between (a side-business
that doesn’t need to be registered but whose profits need to be declared as such,
or a side-business that’s below all registration and declaration thresholds,
etc.).
A lot of small stores hide behind the term “hobby-seller” while clearly being
professionals (e.g. buying with the sole purpose of reselling).
There might also be sellers that are on multiple platforms and sell different
products and LEGO & BL is just a small part of what they do, so they appear small
here but are not.
BL doesn’t make a difference.
A buyer simply can’t know.

No, Denmark is in EU.

So there’s two possibilities for them not having to pay VAT and you not having
an IOSS:

1. The amount is above €150 (ca. $180).  That means the buyer will pay on delivery
(and there will be a fee and duty to pay too).

2. They are a VAT-registered business and BL knows that.

(Well, there’s a third possibility: a glitch in BL… but that never happens, right?)

If it’s one of those, then you don’t need the IOSS, the VAT is the responsibility
of the buyer.

I think they use physical bricks. Stability and function is important and is
best tested using a real build.

According to their own words, it depends on the designers how they do it: some
use only real parts, some start with digital and check with real bricks, or only
use digital/real bricks for this or that….  (But they don’t expend on which software
they use anymore.)

I think their LDD version has more physical tests too, or its models can easily
be used by the “physical test team” (or whatever it’s called) to check for stability
and stress in their software.

Besides, TLG has to use a digital build somewhere during production because of
the instructions.  They are not hand drawn anymore

that TLG produce a handful of other products made from hundreds of different
parts.

AFAIK, they still have a professional/in-house version of LDD.  I don’t watch
every video they make with Designers about their sets but I haven’t seen LDD
in a while either, so it may be outdated info.

I’ve seen shots of Studio from affiliates though (professional designers “vetted”
by LEGO but not “working for” LEGO).

Seems pretty clear that only the additional 5K are shipping in June:

"Since we are doubling the production run, the additional 5,000 sets for Round
1 will be shipped in June 2022, as opposed to January 2022. This will also delay
the release of Rounds 2 & 3. The final plan for this will be communicated at
a later stage."

The wording is clear. The first batch will not be affected. Makes sense considering
storage costs.

So, they are splitting the production run / adding another one for June, and
that moves the other rounds too.
Actually, considering what we know of how it works in LEGO factories (that is,
very not much ), it can make as much sense as moving the whole run.
I wouldn’t want to be the one managing TLG’s production runs (and no one else
would either, so we’re all safe ).

Do you know that for sure? I just assumed they'd use the existing Lego production
infrastructure to produce these this time around. It's all part of TLG. It

It’s LEGO that will produce & pack the sets this time, not BrickLink in its warehouse
like the very first ADP.

That’s why they need to fit the production runs between their other sets, including
the production of the needed elements.
That’s why I understand there’s only one delivery in June, not 5,000 in January
and then 5,000 in June as some others (mis)understood.

reception to return “with no questions asked.”

If the seller hasn’t said anything in their terms _prior to the sale_ about returns,
they have to pay both return shippings and refund the entire order.

What the seller can write is that the buyer has to pay return shipping, or even
that the refund won’t be complete depending on the state of the returned items.
The only orders that are not refundable at all are “bespoke orders” (I don’t
know whether parts order on BL are bespoke orders or not).

But again, that has to be in the terms _before_ the sale.  Not an afterthought.

You can look at LEGO’s own terms for Bricks & Pieces in your country for an example.

You may “upgrade” to a seller account but leave your store closed and not submit
to the New Seller process.

But BL’s inventory tools are not really aimed at buyers / collectors.

Well, I guess it was supposed to be the same but Brexit came in just before the
first vote (2017 for EU), so it ended a bit different.
Norway’s requirements should be similar (voted earlier, and implemented in April
2020 I think) but BL hasn’t done anything yet, maybe not enough sales there or
deemed less risky to take their time?

"Known Colors" isn't actually a list of all the colors that are "known" to
exist, but only those "known" to have appeared in a set.

To be precise: “known” = is in an inventory (set, gear…), and it’s automatically
populated from inventories.


   And there are many parts
in colors that have never appeared in any set, and stores on BrickLink that specialize
in them.

Yep, and when wanting to know if a part exists, you best check that:
1. there’s a picture, preferably a photo, of the part,
2. the stores that have some are experienced and that it’s not a listing error.

You need to join the receipt to the CN22/23.
You need BL’s IOSS-VAT-ID, and you need to give it electronically to your shipping
carrier.

Thou Shall Not write the IOSS on the package… but you can write it on the CN22
that you’ll stick to the package….


   And it specifically says that
"This is NOT an invoice for VAT purposes" So what is the point of that document?

This part means you can’t use it to reclaim VAT.  It’s a receipt, not an invoice.

and buyer that the payemnt is “in kind” but there needs to be a (valued) sale
on BL so that BL take its fees and the Price Guide be updated.

That’s also more and more difficult to do with taxes obligations as payment methods
can only be with money and onsite, so you can’t arrange the actual payment to
be in kind without also paying (and be refunded the item share when the seller
receives the trade).

IOW, with a taxable buyer, it would go like this:
— seller and buyer agree,
— buyer pays with PayPal, so BL can collect taxes from the buyer,
— seller sends items,
— buyer sends items,
— seller receive items and refund, out of BL, the price of the items (but not
the tax).

Well, you can set the Max price field to the Price Guide (for sale or 6 months
average)… but there’s not function to add all the Max price fields (and multiply
by wanted quantity).

I think there was a suggestion about that….

Because the look and feel that you call 'outdated' actually is much more
informative, useful and compact than the newer interfaces.

Yep, think of it as a mailing list or a newsgroup and you’ll undestand how it
works.


  Also, Bricklink is
slowly migrating from the classic look to a newer, but change is slow.
When you compare the Studio forum and this one, it is actually the Studio forum
that is rubbish, with broken search and contact functions and a near total lack
of tools for the administrators to work with. It is a 'temporary' add
on for a separate team.

The development teams of Bricklink and Studio are separate (different technology,
different goals), but this has nothing to do with anything like legal entities.

As for the Bricklink forum: you can tweak a lot. It has some nice, well appreciated
features, lie the tree view and the macro tags.

And the integration with catalogue tools (change requests…).

You are quite correct. Thankyou. Looking at my Paypal account I received the
VAT amount as well. The buyer said the BrickLink payment link did not work and
paid directly through Paypal. I am not sure what is best to do in this situation.

Well, the only solution is to refund and ask the buyer to pay again with onsite…
or cancel.
Otherwise, you (both seller and buyer) are stuck with an order that’s overpaid,
without proof that VAT was collected, as it indeed wasn’t (the amount the buyer
overpaid you and that matches the VAT amount they should have paid to BL can’t
be VAT as you’re not allowed to collect EU VAT), and that will incur import VAT
when received.
So if you proceed: the buyer will pay VAT “again”, plus a fee, and you will have
VAT money that you had no right to collect and have no way to remit.

Methinks this will happen more and more and maybe sellers should completely remove
PayPal off-site from their payment methods and maybe change the e-mail address
associated with their PP account to prevent return buyers to use it to pay off-site.

No refund.

If you’re VAT registered:
— you can have the VAT deducted from the VAT you collect, or refunded by your
governement,
— you can enter your VAT number on BL and you won’t pay it.

If you’re not VAT registered:
— you have to pay VAT, as every final buyer.


(Note that BL only collects VAT on your non-EU purchases, below €150.)

pour forcer le vendeur à annuler ?  Surtout quand l’acheteur n’a pas encore payé ?

Et BL s’en moque : le NPB tombera quand même.

La seule façon de faire intervenir quelqu’un qui a du poids, comme PayPal ou
l’organisme de sa carte de crédit ou bancaire, c’est de payer.

Donc, comme je le disais:
— soit on accepte le NPB et c’est fini,
— soit on paye et attaque le vendeur via PayPal ou sa banque / carte de crédit
ou en justice pour se faire rembourser… et on aura quand même un négatif (ou
pire, je ne suis pas sûr que BL ne blâmera pas les acheteurs qui font ça), alors
qu’il suffit de ne pas payer.

pas vraiment et le processus NPB / non-paying buyer (acheteur qui ne paie pas)

Donc, en fin de compte, tu as deux possibilités, toutes les deux mauvaises :

1. Tu ne paies pas. Tu acceptes le NPB (soit directement en y répondant, soit
implicitement en ne faisant rien et en le laissant arriver à son terme). Tu auras
une marque sur ton compte, à la troisième, tu es bannie. Et le vendeur te laissera
sûrement une note (feedback) négative, à laquelle tu ne pourras pas répondre.
Et comme ce sera ta seule note pour le moment, tu seras à -1 et certains vendeurs
ne t’accepteront pas comme cliente mais il y a plein d’autres vendeurs sur BL.

2. Tu paies. Tu reçois la commande. Et tu peux alors donner un feedback négatif
au vendeur, lequel ne pourra pas le faire enlever si tu restes factuelle et courtoise…
mais pourra en laisser un aussi.
Et si tu payes par PayPal ou une carte bancaire, tu peux utiliser leurs services
pour ennuyer le vendeur pour le forcer à accepter un retour / remboursement (selon
la loi, complet et sans frais de port à ta charge si rien n’est stipulé dans
les termes… mais encore une fois théorie contre pratique).

En résumé : le choix est entre un blâme et payer.

Désolé que tu sois tombée sur un mauvais vendeur pour ta première non-commande



(Et si tu veux mon avis, savoir ce que je ferais, honnêtement ça dépendrait de
l’humeur du jour : accepter mon erreur et le NPB ou partir en guerre contre le
malotru.)

The problem with that is that you are not allowed to collect UK VAT (unless you
register for VAT in UK…) and UK VAT collection (and remittance) is the responsibility
of BL now, as a marketplace (because it was the responsibility of the buyers
but they never did).

So BL needs to be able to make the buyer pay (not you) and directly (not through
you) and to link the payment to the order.  And that means PayPal on-site or
Stripe… with their fees.

Bricklink can only collect tax with PayPal Onsite.

Or Stripe.

But it’s not “all” your out-of-EU sales, it’s “only” UK and (most of) USA for
now.

(And if you buy from out of EU yourself, for under €150.)

so hundreds of meta-bottles made of 10,000 bottles made from the raw material.

That being said, 5,000 was too low.

More seriously, I remember reading my firstname in the e-mails, the web page
(that I can’t find anymore…) is clearly a “copy-paste strikes again” error.

The only way I know to avoid copy-paste errors is to do paste-copy instead: you
paste first and copy afterward, this way, what you paste is totally wrong (either
empty or the previous thing you wanted to copy-paste) and you can delete it and
type correctly what needed to be typed.

Le NSS sert à :
— réveiller le vendeur,
— prévenir BL et les autres membres.
Cela peut conduire à un remboursement mais ce n’est pas lié.  BL ne s’occupe
pas de la partie financière.

Si le vendeur te rembourse ou si le paquet arrive, tu peux clore le NSS (mais
pas avant et pas sur une promesse !).
Si le vendeur prouve auprès de BL que le paquet a été envoyé ou que la commande
a été remboursée, BL pourra aussi clore le NSS.

Ça ne veut pas dire que tu ne peux pas aussi demander une annulation… mais le
remboursement ne dépend pas de BL, c’est seulement un arrangement entre toi et
le vendeur, appuyé par la loi si le vendeur est en UE.
En UE, si le vendeur n’a rien prévu dans ses termes, toute la commande doit être
remboursable, port aller et port retour compris. Le vendeur peut prévoir de ne
pas rembourser le port ou de réduire le montant du remboursement pour les commandes
« sur mesure » mais il faut que ce soit dans ses termes.
(À noter que ça, c’est la théorie. En pratique, c’est plus difficile à faire
respecter pour de petits montants chez des petits vendeurs…)

Après, cela dépend aussi de la façon dont tu as payé.  Voir p.ex. les termes
de PayPal (qui veut une preuve de réception et a des termes pour les retours),
ou les assurances associées aux cartes bancaires…

The question is which way.

I was talking about imports in UK: per BL’s help page, the non-UK seller needs
to attach the invoice and that’s all.

For import into EU, per BL’s help page, the non-EU seller “generally” needs to
give BL’s IOSS-VAT-ID electronically (or can put it on the CN-22 but BL also
says not to write anything on the package and the CN-22 is sticked to the package…).

So, as you’re in UK, UK RM reminded you to use ECD for your exportations to EU.

It's not. I think it's a mistake. Why add a paper VAT-invoice ánd include
an IOSS-no.

Hum, I guess BL uses the same boilerplate text (and code?) for both.

There’s another example of using the same text several times: If you look on
top of https://www.bricklink.com/help.asp?helpID=2514 , which is titled “Brexit
Marketplace Changes,” there’s the same text than on https://www.bricklink.com/help.asp?helpID=2517

On the Brexit page, there’s also stuff about VAT registering in your EU country
(so, not UK) which is not exactly the same on the EU VAT page (where the EU thresholds
are mentioned later), but it’s confusing to talk about registration in EU when
you’re talking about UK….

That's correct. But Bricklink thinks we DO need to add their IOSS number,
when shipping from EU to the UK. Next to the 'Download VAT Invoice'
there's a 'IOSS No.' link, which says:


You must share BrickLink’s IOSS number directly with your shipping carrier so
that the shipping carrier can submit this information electronically. This helps
to ensure that the buyer will not be charged VAT twice.

etc.

And AFAICT, UK hasn’t set up their own electronic IOSS-VAT-ID stuff, so it’s

Sorry I don't understand, we use the PostNL online 'business' system
but there is nothing about a IOSS in these formulars.

Some international shipping to EU now needs electronic forms to be filled, and
the IOSS is a field in these forms.  See this thread: https://www.bricklink.com/message.asp?ID=1278588
for an example.

I'm really curious how something like this thread gets brought back to the
forum 10 years later? Did you go through every post ever? Type in "credit card"
and this is what turned up? Really curious.

Maybe there’s an old military depot of chemicals near BL and some leaked to the
servers through the ground and somehow ressurected this thread?

Yes.
But the operative words are “if you’re over the €10.000 threshold” and, as you
quote:

will owe Dutch VAT to the tax authorities on the profit margin of the goods.

So what you sell doesn’t count for the threshold.
So you effectively are at €0 sales to other EU countries.
Therefore you’re way under the threshold.
And then you don’t have to register for VAT on the One Stop Shop or to each of
the EU countries you sell to.
And, more importantly to you, you don’t have to enable VAT on BL.

But, they could also send a new invoice.

Actually, IIRC, the payment can still be pending because the limit is set at
the date the package was sent: if it was sent before July 1st, then it’s okay
if VAT wasn’t collected by the marketplace, otherwise, it should have been collected
and Customs can then be very unhappy… well, okay, they always can and I’m sure
they are more lenient during the transition (i.e. they just charge the VAT, no
added penalty).

But that’s still not the case here, so it’s angels on pinheads
