EU Marketplace FAQ

1. When will BrickLink implement the EU Marketplace tax solution mentioned in the recent email?

This will be launched on July 1st when the new rules go live.

2. Why is BrickLink subject to new marketplace rules if they are not a payment processor?

There are a number of factors that define a “marketplace”, and when considering the entire picture, BrickLink is considered to be a “marketplace” as defined in recent legislation (including the new EU VAT marketplace rules).

3. How do these changes affect BrickLink transactions within the EU?

Transactions within the same EU country will carry on as they did before but BrickLink is now obliged to collect VAT on goods sold to EU private buyers where goods under €150 are shipped from outside the EU or goods of any value are sold by non-EU sellers and shipped from inventory stored in the EU.
BrickLink will not collect VAT if the buyer is VAT registered and provides their valid VAT number (in these cases, the VAT registered buyer will be responsible to account for VAT).

4. Will the EU Marketplace tax solution require all stores to use onsite payment methods?

No. Onsite payment will only be required for transactions where BrickLink must collect VAT under the new rules i.e. where goods under €150 are shipped from outside the EU or goods of any value are sold by non-EU sellers and shipped from inventory stored in the EU.

5. As a seller, I do not use PayPal, and many of my customers do not use credit cards and are therefore unable to use Stripe. Do I have any other options when it comes to onsite payment methods?

We hope to add more payment methods after the initial solution is deployed. We will focus payment methods that would be most useful to our European members.

6. For the last several months, VAT charges have been added to my BrickLink fees. Does the EU tax solution affect this in any way?

No. VAT on seller fees is sometimes confused with VAT on the sale of goods but they are separate transactions.

7. What will a random web browser display when the prospective buyer is not logged into their account?

It will display the country of IP address if the buyer is not logged in. For more information, please see the Help article here

8. At which VAT rate will be buyer be charged?

BrickLink will collect VAT from buyers based on the country of delivery unless the buyer is VAT registered and provides their valid VAT number (in these cases, BrickLink will not collect VAT and instead the VAT registered buyer will be responsible to account for VAT).

9. What price will a buyer in the EU see at a storefont listing?

EU buyers will see VAT inclusive prices.

10. Does BrickLink collect VAT on orders placed from sellers that have not registered their VAT-ID with BrickLink?

BrickLink is obliged to collect VAT on goods sold to EU private buyers where goods under €150 are shipped from outside the EU or goods of any value are sold by non-EU sellers and shipped from inventory stored in the EU.

11. What about non-VAT registered sellers in EU Countries who do not pay or collect VAT on qualifying orders? How will VAT be handled in this case?

For non-VAT registered sellers, where VAT needs to be collected on qualifying orders, BL will collect VAT through onsite payments.
