| Good evening all, unfortunately, after placing 1200 orders in 425 different stores
in Bricklink, we have run into our worst experience, and to be honest, our first
bad experience.
Placed an order and requested for VAT free invoice. After this invoice was issued,
we placed a second order, three lots, requesting for it to be combined with the
first one. Since, if VAT was removed from one order, Bricklink unfortunately
does not combine orders, a new order was created. We requested for it to be combined
shipping with the first one.
The seller has since refused to combine the two orders, since 'we did not
choose the option for orders to be combined', and requests that we pay another
shipping fee for the second order. Keep in mind that both orders were not paid/picked/shipped.
We then requested for the second order to be cancelled. It is our understanding
that under EU law, we are able to cancel this orders (apart from our personal
thought that unless it was already shipped/picked, you should be able to cancel
an order anytime - it is just good practice). The seller is of course also refusing
to cancel the order, and started the NPB process.
Should we be able to cancel this order, am I right in thinking that we can do
so under EU law? We are both located in the EU and seller is a registered business.
It is a shame that someone can take something that would have been simple, and
a great business transaction (also being our third order in the store), and make
it this hard. It just makes no sense.
What are your opinions on this matter? Are we allowed to cancel the order?

with a good reason you are always aloud to cancel the order.
best thing is to send an email and try to convince the seller.

Is it right that orders cannot be combined once VAT is taken off, or is it that
the seller has processed the first order and so moved it to a status where new
batches are not combined with an existing order? I can understand them not wanting
to do have to do the paperwork for VAT exemptions again for just a small addition
to an order that they have just processed.
But yes, you can request that an order is cancelled under EU law. However, there
is no EU law about bricklink processes. The seller is entitled to cancel it through
the NPB process if they wish. That is still a cancellation. It is also keeping
a record that you place orders and cancel them, and other companies do this.
Amazon and LEGO can cancel your account if you repeatedly place orders and cancel
or return them, even through you have the right to cancel and return them.
Of course, it is much better practice to work with a buyer (especially a previous
customer that has placed multiple orders) and to cancel it so they keep coming
back in future.

Before it was possible, but since the change in VAT rates months ago it is broken
and you can only add batches if the VAT checkbox is enabled on the pending order.

I am still carrying an NPB completed against me by a seller who flat-out refused
to issue a zero-VAT invoice for me. It was a sizeable order.
Response from BL: "We are sorry the communication with the seller was not better".

Yes/No?
Yes, of course, any decent shop would allow to cancel at least an unpaid/not
shipped order for any reason.
No as AFAIK (but I'm not sure) the EU laws apply to private consumers only.
You're a company with a VAT-ID, then, at least in France, I'm not sure
you have the consumers rights.
But again, this is a bad seller behaviour, he should have gladly allowed the
cancellation - especially knowing you've already paid for another order;
this is plain stupid.
