As stated by the Dutch member, the same regulation concerning used goods (Differenzbesteuerung)
applies in Germany. All goods sold by using Differenzbesteuerung are not counting
for the 10000 Euro.

Following the implementation of the new EU VAT e-commerce rules for online marketplaces,
BrickLink is asking each seller who has reached, or expects to reach, the new
EUR 10 000 distance sales of goods threshold for the preceding 12 months to ensure
they are compliant with their EU VAT registration obligations and provide proof
of registration.

Changes at a glance:

• The previous thresholds for distance sales of goods to buyers in other EU Member
States (EUR 35 000 or 100 000, depending on the Member State) has been abolished
and replaced by a new EU-wide threshold of EUR 10 000.

• Below this threshold, you can continue to apply the domestic rules for VAT
on your cross-border sales. If your sales are above this threshold, you are liable
for VAT in the Member State where your buyers are located. Alternatively, you
can register for the One Stop Shop (OSS) – where you can register for VAT in
one Member State and pay the VAT due in other Member States.

What this means for you:

• If your sales in the preceding 12 months are above the new EUR 10 000 distance
sales of goods threshold, you will need to register for the OSS or in each individual
EU Member State where you sell on BrickLink.

• If BrickLink determines or receives notification that you are not meeting your
VAT obligations within 30 days after receiving this notice, this will result
in the suspension of your selling abilities on BrickLink.

• Once registered for VAT, you will need to enter a valid VAT and/or OSS registration
number in your Store Settings page within the Management tab and enable VAT in
your settings.

Although I will not make it to 10k at all, the same thing applies for used goods
in Germany if you use DIFFERENZBESTEUERUNG. Bricklink definitely should do something
on this topic.

Let's unite to educate BrickLink about EU rules in order not to ruin our
businesses.

I know there are a lot of sellers using the 'VAT margin goods regulation'.
(for now I stick to English, other languages of the same term above) As far as
my knowledge goes, VAT margin goods do not count towards the €10.000 threshold.
Therefore, stores operating under the 'VAT margin goods regulation' are
not effected at all by the new rules and BrickLink should act accordingly.

For the Netherlands indisputable proof (*links*), that the VAT margin goods are
exempted, is available. We would like to collect more data about stores potentially
affected in other languages and countries.

Please reply in this topic if you currently use your 'VAT margin goods regulation'
and would like to continue to do so in the future. Please state your shop-name,
country and the official term/phrase applicable in your country.

Hello,

the same problem in Germany: Here it is called "Differenzbesteuerung". And according
to our law firm, the 10000 Euro do NOT apply for used goods at all. So similar
to the Dutch regulations.

It basically means that once I sell over 10.000€ a year to EU countries i need
to pay my VAT in the country i ship to, not in my own country.

The problem is that the bricklink methodes for implementing VAT to your store
are far from perfect (as far as i can find out). In Holland we have a special
VAT rule called the 'Margin scheme' which means you are dealing in EXCLUSIVELY
purchased 2nd hand goods and do not settle any tax on purchases or sales, other
than the tax paid over your profit margin.

So the problem is, if i read this correctly in the bricklink email from the 29th
of june, When I am selling for more than €10.000 a year in europe I need to enable
VAT in my store, which means all my goods will be charged with 21%, the dutch
VAT rate, while all of my goods actually need to be charged with 0%, cause of
this special margin scheme tax regulation.

This is straight from the government tax website:

"If you sell goods that fall under the so-called margin scheme, these deliveries
do not count towards the threshold amount. If you apply the margin scheme, you
will owe Dutch VAT to the tax authorities on the profit margin of the goods.
You do not charge VAT to the customer and do not mention this on the invoice.
The VAT is included in your sales price."

At this moment I can not open my store cause once i hit 10.000€ in sales in europe
my VAT needs to be enabled and i will loose 17% of my income, which has nothing
to do with my business and the VAT regulation I am working in.

Is there anyone that has more information about this or any idea on what my options
are here?

At this moment I closed my shop to shield myself from potential problems, but
this is my full time job so I am without income as long as Bricklink does not
offer an option here.

It is possible that brickling does offer an option that I just don't know
off, this is why I am asking about it!

Thanks again for the help. I know I am not the only one with this issue and a
lot of my friends / colleages from holland would like to know this as well.

Die Lieferschwelle gilt außerdem nicht für Gebrauchtwaren, sofern die Differenzbesteuerung
angewendet wird.

It is a German law, but based on a EU decision from the 1990s.
Every EU country did something different to reduce packaging material - Germany
constructed a bureaucratic monster. This monster is growing even more in the
next years after the actual changes...

Interesting. I have attempted to find something similar in The NL found a site
with regulations but not something like LUCID. Not yet, because if this is an
EU regulation I assume it will be implemented in all EU countries?

Not only plastic. You have to register every kind of packaging material that
you use: Paper, plastic, glass,...

And of course you have to pay fees to recycling companies for that amounts of
packaging material

Is to remove plastic in packaging? Would applaude that. But it would require
to reconsider LEGO packaging big time.
