| Hi I am getting ready to open a store and am based in California. I am doing
this as a side gig but hopefully will turn more then $600. My question is, what
do I need to know about setting this up? From what I have read it looks like
I have to set up a small business and submit profits and loss. Has anyone done
this? I feel like when I look it up online I have to fish though the scams to
find the correct info. I just want to make sure I am not screwed at tax time
if I am able to be successful. Thanks to anyone who helps. I am really excited
about this.

| hallo,

MS, MT, NH, ND, OR. Of these, 5 don't have a state sales tax (AL, DE, MT,

Author: | christor | Posted: | Apr 23, 2023 18:42 | Subject: | Customs Forms etc - UK to EU low volume sales | Viewed: | 93 times | Topic: | Taxes
|
| I am based in the UK and have sold a large used set to Denmark, but it's
the first time I've shipped out of the UK since a good while pre-Brexit,
and probably since BL was bought by TLC. There's a lot that has changed.
I have everything packaged up, invoiced, been paid, have purchased my shipping
online from Parcelforce UK, and then printed out the reams of customs forms that
it had me download. This is all new to me, have never been given this in the
past.
It is really hard to find actual practical advice that doesn't assume you
have lots of prior knowledge or are an export business. Most stuff I find is
really generic advice and either described in pages and pages of legal jargon
or in comments or posts that are brief and focus on one query only, but never
the whole process. Is there no 'shipping guidance and filling out customs
forms for dummies that only buy and sell occasional sets to support their hobby'?
It's really frustrating.
Q1. Since the set is worth over £135 GBP, I gather BL doesn't automatically
add the taxes on during the sale, instead, duties and VAT are charged to the
recipient upon arrival - correct?
Q2. Is the sales tax and duty status all the same, whether the set being sold
is new or used?
So I have figured out through various sources, that you have to include in a
clear plastic envelope stuck to the outside, all of the copies of all of the
forms (1 despatch note, 2 customs declarations, and 4(!) copies of the "commercial
invoice" generated by Parcelforce) - although I gather I should also include
a copy of the invoice from BL too - even though there's no tax or duty already
paid that needs evidencing (assume for a shipment under the £135 threshold that
this is all more relevant?)
Q3. Is the above correct?
One other aspect that seems unclear - as an occasional trader on Bricklink, I
always viewed myself as a private individual buying and selling sets to support
my hobby, and not as a "commercial exporter".
Q4. Is this still correct in a legal sense, or does even the slightest activity
peg me with that label and the obligations that go with it?
Q5. I'm not VAT registered, I fall way below that threshold, but what about
EORI registration? I have never heard of this before but everything I'm reading
suggests it's necessary - but I'm not a commercial export business????
So now I come to filling out those forms. First the customs declarations:
So HS tariff codes are all new to me too, it seems these are a requirement now,
and I have found what seems to be the right code - 9503003500.
Q6. Then it asks for export license number / certificate number which I think
are irrelevant if I'm not a licensed commercial export business, so it's
safe to leave these blank?
Q7. There's a space for Shipping Costs which Parcelforce has left blank,
although it knows full well the amount it charged me, and has entered those figures
on the invoices? Do I need to also fill it in here?
And so, onto the invoices themselves, all 4 copies:
Q8 (see Q5). There's a space for EORI number - but see above ... is this
required?
There is also then a line on the invoice that states "The exporter of the
products covered by this document declares that, except where otherwise and clearly
indicated, these products are of ________________ preferential origin."
Underneath that there is a declaration the goods aren't subject to prohibitions
or restrictions.
And then underneath that, is a space for signing and dating the declarations
"For and on behalf of the above named customer".
Q9. So firstly, can someone please explain if the second hand Lego I am selling
from the UK to Denmark is of preferential origin or not (and why?) and what the
blank space next to that is for? ("non-preferential origin"?). Do I need
to put something in here?
Q10. Secondly, is this invoice declaration intended to be filled out & signed
by me, the vendor, presumably on behalf of the customer (which seems weird?)
- or by the buyer - i.e. customer - upon receipt?
So sorry for the long post, but it is virtually impossible to find a practical
guide and I've searched BL but only get pieces of the picture. Many thanks
in advance for any help and advice anyone can provide.
Chris

Is IBAN still functional in the EU for onsite payments, either through Stripe

We use something similar in Canada, and I know these kinds of payments are not

| Hi Bricklink
I'm a seller for the past 2.5 years I'm
to charge sales taxes (GST, HST, QST,..) on all Canadian orders since I'm
selling for over the minimum from the Canada Taxes Departement.
I've post another time a year ago asking when did the Canadian Sale taxes
will be charged by Bricklink directly? We have absolutely no news since a Newsletter
in the past fall.
Can someone from the administration can give us a little news, a timeline, a
date of release, the status of the process?
In Canada, it is obligated to charge sale taxes online since the July 1st 2021.
Best regards and hoping to get some feedback or news

I received an order during March but at the order page it's still showing

is shown at the storefront so it seems the seller side has been fixed but the
buyer side hasn't.
Please kindly fix it ASAP. Thank you.

|
| Hallo zusammen,
- Official margin scheme document issued by a legal authority; (Von einer
Justizbehörde ausgestelltes offizielles Margin-Schema-Dokument)
- Quarterly return that shows goods that are qualified as margin scheme goods.(Vierteljährliche

This way we, sellers lose 20% on UK orders which everyone decides to be good

work. I was wondering if I could get some insight on how it works and if it would
be needed to be reported to CRA or whatnot. Does tax need to be collected for
orders and do I need to apply to CRA or something. I was thinking about selling
spare parts I had for mocs and a few minifigures so its not gonna be a permanent
thing but rather a temporary store to sell to Canadian buyers. Or do you guys
think FB marketplace or some other way to just sell it off is better. Also even
though its not related to taxes but how do you guys calculate shipping and where
do you buy stamps for it.
Thanks in advance for any help.

|
| I am finding it very annoying that VAT is being added to Purchases for lego instructions
and manuals. Under UK VAT guide lines VAT Notice 701/10 instructions and manuals
are zero rated:
https://www.gov.uk/guidance/zero-rating-books-and-printed-matter-for-vat-notice-70110#meaning-of-the-group-3-items
Under section 3.1 you will see the following text:
3.1 Books and booklets
These normally consist of text or illustrations, bound in a cover stiffer than
their pages. They may be printed in any language or characters (including Braille
or shorthand), photocopied, typed or hand-written, so long as they are found
in book or booklet form.
Supplies of any of the following are zero-rated:
literary works
reference books
directories and catalogues
antique books
collections of letters or documents permanently bound in covers
loose-leaf books, manuals or instructions, whether complete with their binder
or not
amendments to zero-rated loose-leaf books, even if issued separately
School work books and other educational texts in question and answer format,
are zero-rated because the spaces provided for the insertion of answers are incidental
to the essential character of the book or booklet. The same applies to exam papers
in question and answer format provided they qualify as books, booklets, brochures,
pamphlets or leaflets.
Please also see section 8 Liability of some common items of printed matter.
This gives a full list of all printed items and clearly shows Instructions and
Manuals as zero rated.
I have written an email to Bricklink Help Centre to make changes as I suspect
hundreds of transactions for instructions/ manuals have been charged VAT when
it should be zero rated.
This is not good for UK buyers who are having 20% added to orders and its not
good for any sellers outside of the Uk as they have no control of this being
added.
I do think that the addition of the VAT field for sets, boxes etc are great and
give users peace of mind however it has to be accurate for the type of goods
the Vat is being applied to.
Urge UK members and have ordered Instructions and been charged VAT, either on
a combined order with other items or as instructions only purchases please contact
Bricklink as this is not correct.
I am sure Bricklink will also be concerned about this address this problem.

|
| To whomever it may concern at BrickLink (I'll also send a copy to support)
- Primarily a heads-up as this could have a financial impact for BrickLink if
they are in error of collection from some sellers:
I was checking the receipt for the Nov/Dec because I am registered for GST/HST
and I am refunded as an ITC credit for these amounts paid (whether it be a service,
for goods, etc..). The newsletter made me realize it was already starting to
be collected. I noticed the receipt had no GST # on it, which in Canada is usually
required when you collect GST/HST. I'm not exactly sure how it works for
the cross-border digital tax like this one (and I'm not talking about the
ones you guys will implement in the future - just the one on the seller's
commissions), but when researching, I found this (and BrickLink is most definitely
aware that I'm GST/HST registered as I'm the one who keeps pushing for
tax settings for Canada ):
_____
Determining the status of your customers
Your customer is considered a specified Canadian recipient if:
-the usual place of residence of the customer is situated in Canada, and
-the customer does not provide you with satisfactory evidence that the customer
is registered for the GST/HST under the normal GST/HST regime.
If you obtain the GST/HST registration number of your customer who is registered
for the GST/HST under the normal GST/HST regime, you are not required to charge
and collect the GST/HST on the specified supply that you make to this customer.
If the GST/HST registered customer provides their GST/HST registration number
and the GST/HST is still charged and collected, the customer is able to request
a refund from you. Any GST/HST paid by the registered customer in such cases
is not recoverable by claiming an input tax credit or by filing a rebate application
for an amount paid as tax paid in error.
___
If I'm interpreting this correctly, and I'll verify with CRA today, BrickLink
wasn't supposed to be collecting this tax on sellers who were already registered
for GST/HST and we can request a refund not from the CRA, but from BrickLink
and BrickLink will not be able to reclaim this from the CRA because it was an
error in how they collected.

I'm shipping from the US to Israel, a country that has a Value Added Tax
system. Does anyone know if I need to put anything in an "Exporter International
Tax ID" field when creating the international shipping label on Pirate Ship?
I think answer is No, but I wonder if anyone else can confirm.
Here's Pirate Ship's explanation in the Exporter International Tax ID"
field: "Exporter International Tax ID Optional: Used for prepaid VAT taxes (IOSS
/ HMRC / VOEC)".
Imports of goods to Israel are subject to VAT at a standard rate of 17%. The
US, on the other hand, doesn't utilize a VAT system.
From what I've gathered, it appears that the VAT stuff is only something
the importer needs to worry about in this case. Would the same apply to shipments
I send to EU countries?
Thanks for helping out! It's my first shipment to a VAT country so I appreciate

| I'm sure some of you Canadian sellers have noticed that BL has started to
add GST/HST or QST/PST/RST to our BL fees.
In an email from BL on 3 October 2022 they stated:
"Canadian tax will be applied to commission fees starting from October 2022,
which will be reflected in your bill on November 5. The tax amount will be displayed
as a separate line."
I'm okay with that as that was announced.
What I'm not okay with is that GST was applied to all accrued fees from billing
cycles before October. (I hadn't reached the $10 USD threshold to pay fees
for a few months.)
It's not a lot of money, and definitely won't break the bank, but it's
the principle of it.

the CRA that you are authorized to collect taxes in lieu of us doing it directly.
eBay did not have us file it directly with CRA; I believe they submit this and/or
keep it on hand that they received the authorization to be handling taxes on
behalf of the seller who is registered to do so.
Any info about this? Thanks!

| Is it possible to add a link to on-site payment in an invoice.
I had a scenario where a buyer wanted to add to his original order after payment.
Normally not a big deal, they make the order with a bypass code, I send an invoice
with the cost without shipping they send payment via PayPal and I mark the order
as paid on BL.
With the upcoming change to the tax collection in Canada this no longer works
as it has to be on-site payment for BL to collect taxes.
So now when I send an invoice I would like it to include a link to the on-site
payment option, is this possible?
If not is the only option to direct the buyer back to their order page for payment?
Thanks for any/all help.

It's been 2 and a half month since the 1st July (1st date where all online

Did we have more info? or a date when Bricklink will charge the taxes automatically?
I didn't see updates in more than a month about this topic.

|
| Hello fellow bricklink members!
I am in the process of opening a bricklink store and the tax perspective is giving
me a major headache.
Here are some specifics about my upcoming store:
-I would consider myself a private individual selling his personal collection
and not a reseller, since I would be selling what I already have and not buying
and selling.
-I would be selling sets, minifigures and parts, as well as some custom builds
-Everything will be in USED condition, the majority of sets and parts are from
the 90s.
-Since it is a huge collection the inventory would be quite big with many rare
and expensive items
-Therefore I am almost certain I will pass the yearly 10k EU threshold since
most of my buyers will be from EU and I am from a small country (Slovenia).
According to my country's laws, which are similar to many other EU country's
laws, if you sell used items then you have to pay tax on the difference in the
purchase price and the selling price. What are you supposed to do if it is impossible
to determine a purchase price, let alone have any proof of it? Most of my lego
is a combination of my childhood collection, lego from friends and family, bulk
lots on ebay and missing parts from briclink. Do you than have to pay VAT on
the ENTIRE amount?
If I got a tax exemption (still looking into this) how would Bricklink handle
this if I reached the 10k threshold?
I am wondering about selling my entire collection to one buyer as that would
be much simpler, but would minimize profit, not to mention it would be hard to
find someone with that kind of available funds. On the other hand I would kind
of like the challenge of running my own store as a side hustle, but if I lose
20-25% of the value on taxes than its not even remotely worth the effort IMO.
Any advice would be much appreciated and if we ever meet I'll owe you a drink!

| I am running a store in Luxembourg to sell the bulk of my collection and it’s
taking time because I have 3000plus sets.
My understanding from the tax office and from an accountant is that I do not
have to register because even tho my sales are over 10k I am selling private
lego and I am not a trader. I have never bought to sell or claimed any of my
sets in my store against tax. It’s the same as if I was selling a painting privately.
I have had repeated emails with bricklink but they have limited me to selling
within Luxembourg. What can I do?
I am downsizing so this could become a nightmare for me!any advice appreciated!

Author: | Krekeltje62 | Posted: | Jul 15, 2022 09:27 | Subject: | Distance selling < EUR 10K | Viewed: | 112 times | Topic: | Taxes
|
| Hi
Please advise, I have 3 questions regarding distance selling.
Since July 1, 2021, the threshold for distance selling in Europe is EUR 10000
in annual revenue.
This revenue includes sales that:
• Cross borders to buyers in other EU countries
• Are made to private citizens, i.e. only B2C and not B2B.
If the relevant sales in the current year or previous year have passed
this number, then you must start charging destination-based tax rates.
Question 1 , is this a “previous rolling 12 months” system or a “calendar
year” system (always starting at the 1st of January) ?
The EUR 10000 threshold is based on the item base price that is sold only.
Shipping, VAT and other additional charges are not considered part of the threshold
calculations.
Question 2 , is the above correct? Revenue = revenue and that includes
everything. Not ?
My professional accounting answers me
Question 1 : It’s a “calendar year” system (always starting at the 1st of January)
Question 2 : it’s the total revenue , everything is included to calculate the
threshold.
What does Bricklink tell me ? (reading the forum and listening to the
online session regarding this subject)
Question 1 : “previous rolling 12 months”
Question 2 : Only the ordertotal (Shipping, VAT and other additional charges
are not considered part of the threshold calculations)
So to be honest , I’m confused. Who is telling the truth !
Question 3 : When will sellers have the required tools to monitor their sales
in the way that bricklink calculates it (give that that is the correct manner).
Using the EXCEL download method is time consuming (although I’ve automated that).
Thank you for clarifying
Take care

| Today i've got an email from brick that inform me my 2021 distance selling
sales exceeds 10k.
I.ve made an export of this period (01.07.2021 -01.07.2022) and i've noticed
that they took into total shipping cost, fees, taxes, local shippings, non Eu
shippings. and all canceled orders, they are all summed and for this cause i've
exceed the 10k.
For ex, the real selling to Eu customers is ~ 2000+ euro.
I've opened a support ticket but this is strange, they have 1 year to implement
it correctly.

|
| Hi
I just got a mail from Bricklink about having passed the 10.000 treshold for
export to european countries and it does not take away some worries.
My worries concern the registration of the so-called margin sales, that are excluded
from the new system, (OSS or registration by country)
It will be a problem for any dealer selling partly in the margin system, because
the amount we put in the OSS system will not correspondent with the amount Bricklink
reports to the tax authorities. This will mean that dealers doing so can get
questions from all of these countries. ("BL tells us you sold 12.000 Euro, you
have put 7.000 Euro in the OOS system- explain!)
In general: The new system is a real nightmare and will give a lot of discussion
about interpretation. I already got reports from a stampdealer selling 200 Euro
stamps (pure margin) and one tweezer of 7 euro to france, because he did not
put this sale in the OSS system. The French Taxes got the info from e-bay.
There is no word about the margin sales in the BL communication and it looks
they are not aware of this problem.
I have send the following e-mail to BL admin:
Hi
I just got an email about European VAT rules and I have two questions:
1. We sell both new and used LEGO (second hand goods). Lego is sold under the
margin system that we do not have to pay in all the different countries. It
is excluded from this new regulations. We pay Dutch VAT for the difference between
margin goods bought and sold.
2. According to Dutch fiscal law all transport costs are charged with 21% VAT,
so have to be added to the amount sold, also when the shipment is VAT-free charged
by the postal administration. To my surprise it is not included in the threshold
you mention. But how to handle this? Do we have to reportv this part in the Netherlands?
Are there different rules in the countries for taxing the transport costs?
A lot of problems will arise when we sell 20.000 on Bricklink, 10.000 new and
10.000 used, because we will not count the 10.000 used in the OSS system and
this might create a difference between the figures you submit to the local tax
authorities and the amounts we put in the OSS.
I am not the only dealer with this problem, there are even dealers selling 100%
used that do not havev to use the OSS system at all.
So I am very curious how you will tackle this problem otherwise I forsee a lot
of problems for many sellers.
Regards
Erik

my fault for not reporting, that VAT was charged allready ? I feel like i was
double taxed in this case? I just dont understand this relation beteween European
regulation and internal bricklink rules. The officer at the bourder saw my invoice

| I just got this email today from ebay and I was wondering if Bricklink will be
affected by this also.
"
eBay Canada collecting Canadian Sales Tax as of July 1, 2022
Dear eBay Canada Seller,
Pursuant to the guidelines announced in Canada’s 2021 Federal Budget and recent
provincial sales tax amendments, eBay Canada Limited (“eBay”) will be required
to collect Canadian sales taxes (GST/HST/QST/PST) on applicable sales to Canada-based
buyers.
Effective July 1, 2022, for all sales of tangible goods sold within Canada, eBay
will be collecting the Canadian sales taxes (GST/HST/QST/ PST) from Canada-based
buyers on behalf of Canada-based sellers (irrespective of registration status)
and remitting the tax to the appropriate tax authorities.
For sellers not registered to collect tax with the CRA and provinces, there is
no action necessary. You will begin to see sales taxes charged and collected
by eBay on buyer purchases beginning in July. eBay collected taxes will also
be displayed in your seller reporting as of that date.
For GST/HST and/or QST registered sellers, eBay will be appointed as a billing
agent for collection and remittance of Canadian sales taxes where the sales tax
laws do not automatically require it. As such, eBay will require completion of
billing agent authorization forms. A separate communication for GST/HST and QST-registered
sellers will be forthcoming.
With this change in sales tax collection responsibilities, eBay aims to alleviate
our sellers of the administrative burden to accurately charge and collect sales
taxes on taxable sales made through the platform. eBay is taking over this responsibility
for all sellers – not just those that are not registered – in an effort to simplify
the experience for our community. Any questions or concerns about tax collection
will be handled by eBay Customer Service.
eBay will also be responsible for collection of the Canadian sales taxes on supplies
to Canada-based buyers of digitally downloaded goods, including sales from non-Canadian
sellers.
eBay’s Terms & Conditions and vendor agreements will be updated to implement
these changes and provide for compliance with applicable laws.
Additional information about the federal measures can be found at the CRA site
or by calling their hotline: Notification and information reporting: GST/HST
for digital economy businesses - Canada.ca
Please consult with your tax advisor if you have specific questions or concerns
about these changes.
If you have any questions or comments, please post them on our Community forum
here.
As always, thank you for selling on eBay.

| Hello there, so I've selled some Lego parts and a Lego box to a buyer from
Portugal. I live in Canada and I know that I've taped the VAT receipt from
Bricklink on the box so the post service from Portugal was able to see it. I've
also filled a paper at my Canada Post local office to declare the value of the
items in the box that they sticked on it as well. Now the buyer received it about
a week ago and stated that the Portugal postal service made him pay for the VAT
import duties again even if he paid it on Bricklink. He first told me that I
had the money of the VAT and that I need to pay for the VAT. I told him that
it's not possible and showed him a proof of my Paypal summary of the order
that clearly showed that the VAT was taken from the total amount already. I then
proceed and showed him pictures of the VAT receipt taped in a zip bag on the
package. He came today and said:
The post office in Portugal says that the VAT payment has not been declared and
that the documents can only have been filled in incorrectly.
But at my Canada Post office, I declared the value of the parts in the box and
told them the value as well. The buyer sent me the proof of the VAT payment he
made so I know he did the payment but I told him to go to his post office and
show them the VAT receipt. I've sent him by email the VAT receipt from Bricklink
so he can show them up that he indeed already paid the VAT fees. He said also
this morning:
I've already done proof with the documents you sent me and photos of the
box where you can see the receipt with the taxes charged, but according to the
post office, the DAU for entry of the VAT amount where the activity is registered
is missing.
According to the post office, that VAT amount was not deducted from the invoice,
so they are charging me.
Is it me that have done something wrong or my Canada Post local office or the
Portugal postal office? What should I do? Refund him the VAT fees entirely? Help
me please, I don't know what to do?!

Is Bricklink going to send this information about its sellers this year? If so,
I would think it will be a huge change and will make many small time and casual
sellers like myself rethink if it is even worthwhile to continue selling on BL.
