Does this mean anything for an Australian seller who sells to an Australian buyer?

There's no GST payable on a private sale of used goods but say you bought
someone's used collection and resold it here and made a profit, then if you
were registered for GST, it would be payable on any value you add.

I believe you can claim a GST credit on used goods though, even if you didn't
pay any when you bought them.

For VAT, that’s called the “margin VAT” scheme (you collect VAT only on your
margin, so it’s not that you deduct VAT you didn’t pay, it’s that what you paid
isn’t included in the calculation).  And you can see a lot of threads here about
BL not supporting it….

  Dear BrickLink members,

On June 1, 2023 we plan to implement new marketplace features and settings to
handle Australian Goods and Services Tax (GST). This will mostly affect transactions
where an Australian buyer is purchasing from stores outside of Australia, but
it will also affect all Australian BrickLink members to a degree (both buyers
and sellers).

Here is a summary of what will change:

1. BrickLink will now collect Australian GST for all orders being shipped into
Australia from the outside with a consignment value under $1,000 AUD. As with
other taxes collected on the BrickLink site, this means that all such orders
will require an onsite payment method.

2. When seller invoices go out on June 5th, GST will now be added to the invoice
for Australian sellers.

3. Australian business sellers who are GST registered will now have the option
to upload tax information to their BrickLink seller profile. GST will not be
added to the monthly fee invoice for such sellers.

We plan to send out emails to all affected BrickLink members later this week.
For a deeper explanation of this implementation, please see our new Help Page,
Australian Tax:

https://www.bricklink.com/help.asp?helpID=2597

Thanks for reading, and feel free comment below if you have further questions.

The BrickLink Team

Since when do we pay GST on 2nd hand goods?
New = Yes.... Used = No....
How are you going to seperate this?

GST has always applied to second-hand goods from GST registered suppliers, so
there's no need for them to separate new and used.

For low value imports, the EDP/online marketplace is deemed to be the supplier,
so if the marketplace is GST registered, second-hand goods will attract GST.

https://www.ato.gov.au/Business/International-tax-for-business/GST-on-imported-goods-and-services/Australian-consumers-importing-goods-and-services/

My understanding is that any GST is only collected when the item is first sold
if sold in Asutralia to Australians. And as such, the GST responsibility is
discharged at that time. Hence no additional GST on used items sold within Australia.

There's no GST payable on a private sale of used goods but say you bought
someone's used collection and resold it here and made a profit, then if you
were registered for GST, it would be payable on any value you add.

I believe you can claim a GST credit on used goods though, even if you didn't
pay any when you bought them.

However, GST is payable on items sold to Australia from outside Australia.

What Id like comment on is whether this applies to the product only i.e. lego
bricks or whether it also applies to the shipping and other charges. The BL
help page suggests the whole order cost which I didnt believe was correct.

a service (handling, or even commercial prices), then they don’t act on behalf

We do pay GST on shipping but can claim a credit for that and any other GST we've
paid on purchases & other expenses against the GST that's payable on sales
and any other added services, handling etc.

It's done through a Business Activity Statement that we have to lodge with
the ATO every quarter.

Yeah, that’s the same with VAT.

What I meant is that, but for stringent exceptions, shipping is considered a
product/service you offer and so you have to collect VAT on all of it (even if
you didn’t pay VAT on it / there’s no VAT to deduct).

When people look at the postal services, they see it’s “VAT-free” and they think
all shipping is untaxed.

Isn’t BL just the platform on which we buy from registered stores. I’d love to
see how many stores actually qualify for GST inclusion on here (75000aud).

Probably more than you'd think. It's not just the order value that counts
towards the $75000 threshold, it's the total amount a buyer pays, including
shipping and handling.

Bit of a shame though I don’t reckon as many people will want to drop 10%gst
5%paypal 1%currency plus shipping on items which had their relevant gst paid
when first bought. Feeding too many mouths with each purchase.

If you've bought from some of the larger Australian stores, you'd have
been paying GST, but it would have been included in the listed price, not shown
separately.

The tax on low value imports isn't a new thing, it was introduced in 2018,
it's just new to BrickLink. If you've bought from an overseas business
with a large enough turnover here, or from sellers on larger marketplaces you'd
have been paying it for the last few years.

It’s in the page linked by QBricks :
“When purchasing low value imported goods, shipping and insurance costs are part
of the price of the delivered goods that GST is calculated on.”

I think the rationale is: for importations, the government can’t check what is
what and wants to be sure they get taxes on everything, so everything is taxed.
On domestic sales, that it’s secondhand and shipping and insurance can be checked,
at least when auditing the seller, even if that doesn’t happen often.

Interesting. If I am the buyer and order within the next 24 hours, do I have
to manually pay GST on a parcel from the US?

Don’t you already do that?  Pay GST to the postman / delivery man when you import?

Ive never paid for GST for an overseas item UNLESS it was collected by the selling
platform. This has been overlooked / too hard to implement by the local postal
service.

I'm setting up to place an order and just need to know if I should expect
GST on something around $50-$60 AUD in value, not including GST.

So how does this work if the order gets paid so close to July 1?

When the GST is (will be) collected by BL, there’ll be a receipt that the seller
will join to the package so that AU customs don’t re-collect it.

When the GST is not collected by BL / when there’s no proof it was collected,
you’ll pay it at reception.

I'm also looking into selling some LEGO parts, definitely after June 1st,
though, do I need to do anything in particular?

As an Australian yourself, before or after that date, your obligations to Australy
are the same.
Check the help page https://www.bricklink.com/help.asp?helpID=2597 , there’s
a link to an Australian page explaining when you need to do something (register
for GST or not for instance…).

You dont need to register for GST if you sell less than $ 75k AUD turn over.
GST doesnt need to be added to your sales below that value of turnover. See
here: https://www.ato.gov.au/Business/GST/Registering-for-GST/ for local businesses.

Interesting. If I am the buyer and order within the next 24 hours, do I have
to manually pay GST on a parcel from the US?

Don’t you already do that?  Pay GST to the postman / delivery man when you import?

The way I read this, there was no actual increase. There just appeared to be
an increase because the tickets were not getting lost any more.

  Hello everybody,

As many of you know, during the past couple years we have experienced problems
with lost Help Desk tickets. We did a lot of research into what may be causing
this issue, but the problem persisted. In fact, it actually got worse at the
beginning of this year.

As a result of the increased problem levels, a couple months ago we reconfigured
the connection between the Help Center and our SmarterTrack Help Desk system.
We noticed an immediate, sizeable increase in ticket volume, so much in fact,
that we were concerned about how to handle the extra tickets from a resource
management point of view.

So for 2 months we have been monitoring the levels closely, and we are confident
in saying that we have now found the problem and fixed it.

Furthermore, our great new customer service team that we hired in the fall has
stepped up to the plate and is handling the increased load of tickets beautifully.
Our overall average response time is now 27 hours, which means that for most
tickets submitted on a weekday, you will receive a personal response the same
day.

We know the running narrative in the Forum is that it takes 3 weeks to hear back
from the Help Desk. I suppose this is an improvement over what people used
to say, that one would never hear back. But we'd like to inform everyone
of a NEW reality, where our folks are getting back to you in record time, and
also with exceptional levels of service.

Because we do not anticipate needing a Missing Help Desk Ticket topic any more,
I have removed that topic from public view. It has been over two months since

No seriously, stability is ok last months (don't jinx it!!!), and I trust
these improvements are helping all!

Still curious what the cause of the increase of tickets entered was. Were that
tickets spontaneously duplicating, or a serious increase of faults/errors/problems
that were turned into tickets due to unknowing (new) users asking for help?

If the latter, some education and help might be a better way to improve the process
speed (cause instead of symptoms handling).

A section for new users, tutorial video's, a forum area for new users etc?

Keep up the good work!!!

Hopefully I'll never need to use it, but it's great to know things are

That's for sure good news!

Fresh newbies or seasoned members at one moment need some help or someone to
be with them, it's the same for all of us.

Just a few minutes or even a canned reply (read the freaking terms!) is far better
than weeks of void.

Thank you the BrickLink for your efforts in this direction!
And thanks for your information, Russell.

May I suggest 2 points?

* If possible make that someone, anywhere, is always awake anytime - so you can
watch and reply to 'emergencies'. I mean - someone who's not you
Russell

* If possible please inform people what's the actual problem (like when closing
a shop) with enough details, and what are their (if any) solutions.

Thank you again. Very very much.

It has been over two months since
anyone posted under that topic, and it just isn't a good look. I trust you
will agree.

Is it now possible to claim this as an ITC?

Yessir. If you held off submitting for Q4 2022, you can apply those in Q1 2023
for end of month (or a future remittance if you already filed).

Whenever they've updated the previous invoices, you'll be able to redownload
them to show the # on the old invoices as well for your files.

This week we’ve scheduled a deployment that includes an update to the font used
on all of the newer BrickLink pages like the Studio Gallery, My Collection, BrickLink
Designer Program pages, and many more. We’re working to gradually reduce the
number of different fonts across all of BrickLink and eventually unify down to
just one font for the whole platform.

If you notice any visual bugs with the new font (weird spacing, text extending
outside its box, etc.) please submit a screenshot to the Help Desk.

The font makes my fees bill look too big

number of different fonts across all of BrickLink and eventually unify down to

I recommend Comic Sans MS for everything )

If you notice any visual bugs with the new font (weird spacing, text extending
outside its box, etc.) please submit a screenshot to the Help Desk.

MUCH appreciated we know in advance what you're working on (on our client
side of course).
Thanks to the team!

  Dear BrickLink members,

The LEGO Group released the following statement regarding the war in Ukraine.

Our thoughts are with all the children and families suffering as a result of
the war in Ukraine.
Our priority is the safety of all our colleagues. We are in contact with our
Ukrainian team and are providing ongoing support to ensure their safety. We are
also working to support other colleagues around the world impacted by the escalating
crisis including our team in Russia.

We have paused shipments of products to Russia given the extensive disruption
to the operating environment.

We care deeply about the lasting impact on children and together with the LEGO
Foundation and Ole Kirk’s Fond, we will donate DKK 110 million (approx. USD 16.5
million) to emergency relief efforts, with a focus on providing support for children
and families. The donation will be made to existing partners, including the United
Nations Children’s Fund (UNICEF), Save the Children, and the Danish Red Cross.

This is a volatile and constantly evolving situation which we are monitoring
closely.
What does this mean for BrickLink?

The global payment platforms we use on BrickLink are currently not available
in Russia and deliveries to and from the country are severely disrupted. Given
this, buying and selling activities in Russia will be temporarily deactivated.
Members impacted by this will be informed individually.

We are grateful for everyone in our community and never imagined we would face
a situation such as this or witness the heartbreak and devastation we’re seeing
in Ukraine.

Please continue to adhere to our community guidelines and show each other respect
and support.

Thank you for your understanding.
The BrickLink team

Could we please at least get an icon on each model in the list to show how we

would be useful in helping to navigate the list.

Thanks again.

Hi, dear BrickLink team! I am from Belarus. I can't make the order. Is it
because the Ukraine war? Belarus people don't support this war and we want
to buy our lovely Lego minifigures. How and when can we buy here?

  Dear BrickLink members,

Due to legal compliance with DAC-7 rules, we are required to collect additional
information from new business sellers in the European Union starting from the
middle of next week. Refer to Article 8ac of the document to find out if you
have the documentation to qualify as a business seller.

https://eur-lex.europa.eu/legal-content/EN/TXT/?uri=CELEX%3A32021L0514

Please assist with understanding your term 'business seller'.

In the linked document it uses 'individual' and 'Entity' for
the definition of 'Active Seller'. So is the 'business seller'
used here to be understood as only being 'Entity'? Or does it also include
'individual'?

And if it does include the type 'individual', and the member state does
not require a business registration, what will the be required to provide to
bricklink? Is it name, address, place of birth and date of birth?

  Dear BrickLink member,

We’ll be making some changes to the LEGO® Account system in 2023 that’ll make
things a bit easier for you and other BrickLink® members. We’re introducing a
universal LEGO nickname that will work in all online LEGO experiences, including
BrickLink. This means that your username on BrickLink will be the same as your
LEGO Account nickname. That way, you’ll only have to keep track of one nickname,
and it’ll be easier for others to follow you and enjoy your LEGO content.

Right now, we’re giving our BrickLink and LEGO Ideas members a chance to create
and reserve their preferred nickname before we open the service to other LEGO
account holders. If you already have a LEGO Account, we’ll ask you to do a quick
setup on that account by following the link below. All you must do is submit
your BrickLink username as your new LEGO Account nickname. That’s how we’ll make
sure you get the nickname you prefer, on BrickLink, LEGO Ideas and everywhere
else!

If you do not have an account already, follow the link below to create an account
and to select your own nickname.

We understand how important it is to you that other BrickLink members recognize
you on our site, so we encourage you to complete the nickname setup as soon as
you can.

There’s one more thing, though. For trademark and copyright reasons, nicknames
can’t contain words like “LEGO” or “BrickLink” We appreciate all our BrickLink
members, and we understand that changing your nickname isn’t necessarily something
you’d like to do. It’s all part of our work to provide our BrickLink members
with the best possible way to connect with the LEGO brand and each other, and
we hope you’ll feel the benefits of this going forward.

If you find your nickname is rejected for this reason, we encourage you to use
other words related to the LEGO brand like “brick” or “build.” See what fun and
personal combinations you can make!

Anyway, here’s what you need to do:

• Follow this link to log in to your LEGO Account or to create a new LEGO account

https://identity.lego.com/en-US/profile?returnUrl=https%3A%2F%2Fwww.bricklink.com%2F&clientid=0fd7ca3b-3a33-48e3-a747-8ec6f09557c1&appContext=false&adultexperience=true&hideheader=true&hideclosebutton=false&hideexternallogin=false&childsignupexperience=

• Click the Edit icon next to your avatar
• Choose your preferred nickname in the field
• Click Submit and wait a few seconds for your nickname to be approved
• That’s it! You’re all set!

Please select your preferred nickname by the 16th of January 2023. If you’re
not able to change it by this time, we’ll give you an auto-generated nickname.

PLEASE CHECK THESE GUIDELINES BEFORE SUBMITTING A NEW NICKNAME

• can’t contain a name from another intellectual property not owned by the LEGO
Group (example: Star Wars)
• can’t contain an email address or other contact info

I can not figure out how to update my seller terms and I am unable to pay my
Fee's for the month. It says they must be paid by the 15th before I am terminated
but it won't let me pay.

In Administrative, Admin_Russell writes:
  Hello everybody,

Yesterday we updated the Seller Terms of Service. Here is a summary of the changes
that were made.

• Opening section - Removed one restrictive phrase

If you do not agree to the revised Seller Terms, then BrickLink is entitled
to terminate these Seller Terms as they apply to you, and disable your
Seller account.

• 1.2.8 - Replaced the term “on hand” with more explicit language

Exact quantity: The quantity of the item that you are listing for sale must
not be greater than the quantity you have physical possession of in the country
in which your BrickLink store is registered. Drop shipping is not permitted.

• 1.2.11 and 1.2.12 - Removed these sections regarding the MOC Shop

MOC Packages. If you offer for sale in your store bricks and build instructions
for a design made available by a Designer (a “MOC Package”), then you must (i)
offer to sell all the bricks that are necessary to build the model represented
by the MOC Package and (ii) deliver or otherwise make available to the Buyers
of the MOC Package the build instructions for the MOC Package.

Designers’ MOCs and Designs. Without written consent of a Designer, or except
as otherwise permitted herein, you may not sell, reproduce or create derivative
works of any Designer's models, images or designs published on the Site,
including at moc.BrickLink.com or within the Studio Gallery portion of the Site.
]

• 1.3 - Removed various other mentions of the MOC Shop

• 1.3.11 - New language was added regarding complimentary use of the site

Complimentary use in Select Countries: LEGO BrickLink, Inc. is required to
register with the tax authorities in the countries from which BrickLink collects
Store Fees. For certain countries with few BrickLink sellers, or where the overall
BrickLink sales volume is low, the cost to LEGO BrickLink, Inc. of registering
for tax purposes can exceed the anticipated revenue from Store Fees. In such
cases, BrickLink may not charge Store Fees for sellers in countries where the
cost of registration with local tax authorities would make it economically advantageous
for BrickLink to not charge Store Fees. The list of countries for which BrickLink
will not charge Store Fees is subject to change from time to time as economic
conditions change, at BrickLink's sole discretion. The current list of exempted
countries may be found here.

**************************************

You can easily see the exact differences by opening two tabs for this page:

https://www.bricklink.com/v3/terms_of_service_seller.page

On the dropdown menu in the upper right corner, select July 1, 2021 and for the
other keep it at the default Feb 2, 2023.

None of the changes to the TOS were considered critical enough to require consent
from our sellers. However, communication was sent to various groups of sellers
who may be affected by these changes.

Thank you,

The BrickLink Team

Why exactly did we get rid of the Moc shop? The concept seemed cool…

I don't remember exactly when MOC Shop was retired, but it was sometime around
1-2 years ago.

I was fairly active on MOC Shop, both as a designer and as a seller for other
people's MOCs. However, I found the amount of effort required to produce
kits to be too much for the amount of money involved, and not many buyers were
willing to pay the full price. I ended up selling many kits at a loss.

In retrospect, it was not very well thought out. Why pay someone else to do something
you enjoy?

That being said, some MOCs did sell well, such as the Nintendo Entertainment
System. Funny enough, the LEGO Group released their own version just a few years
later!

Set No: 71374 Name: Nintendo Entertainment System
*
71374-1 (Inv) Nintendo Entertainment System
2645 Parts, 1 Minifigure, 2020
Sets: Super Mario

Not sure if it can fit a Raspberry Pi, though.

My personal favorite was the pegasus, I even kept a copy just for myself. It
was also my best selling MOC. The instructions are for sale on Rebrickable:
https://rebrickable.com/mocs/MOC-74921/Amida_Na/pegasus/#details

Now, I just sell instructions for my own MOCs, since buyers can easily upload
the parts list to BrickLink and order the parts on their own. Buyer does all
the hard work, much easier for me…

It didn’t work out.  Nobody used it.  No demand, no offer; no offer, no demand.

Much work, zero profit.

PayPal works in Belarus even with local credit cards from banks that are not
under sanctions, so no problem with payment. I think the real reason is that
Lego left our market, so Bricklink left it as a part of Lego group.

I thought paypal had stopped operating in Belarus as Western governments have
applied the same financial sanctions on Belarus as Russia. And yes, LEGO pulled
out of both countries, as have many other Western based international companies.

]

The Belarusian foreign minister confirmed last week that Belarus is doing joint
exercises with Russian troops building up in Belarus. Russia is freely using
Belarusian air space for missile and drone attacks on Ukraine. I don't think
YOU or any of your friends are to blame, but your government is entirely allied
with Russia in this.

Because the many western countries have imposed financial and trade sanctions
against Belarus because of your government's support for Russia and their
invasion of Ukraine. Importantly, PayPal have stopped operating in Russia and
Belarus because of the financial sanctions, so there are no payment options to
pay fees.
