Absolutely not.
“New” / “Used” isn’t about how the parts looks, it’s about their history.

| Taking a quick look at your store, you probably need to change all of these to
used. You also are not allowed to say "like new" or "new condition"
for used parts. The listings will get removed if reported.

Please don’t list anything as NEW if it is not new, even if only one part is
used or damaged. That is one of the most frustrating things from a buyer’s perspective.
It’s also incredibly obnoxious to other sellers because if you list a used item
as new, you’re probably listing it at a lower price which brings down the average
cost and forces other sellers to lose money by lowering their prices in order
to compete. If you have ever displayed a minifig (any part of it) or done anything
other than remove it from the set and immediately store it, it’s not new.
Imagine buying a new pair of shoes online from Nike and receiving them with used
laces? And then calling them about it and they tell you that you should have
read the fine print?
Yes, this is clearly a sore subject for me
