Hi there. I made two purchases from a seller on April 11th (3.5 weeks ago) totaling
around $174, and I haven't received either yet. They are in Florida and I'm
in Virginia. The status on my orders page hasn't changed from "Paid",
so I contacted them yesterday asking if they'd please provide tracking info.
They haven't replied, so I just looked at their feedback, and this seller
has a concerning pattern of messing up people's orders and, when the buyers
leave neutral or negative feedback, they respond by blaming the buyer and getting
pretty nasty.
Two questions: How should I move forward, knowing that if I complain I'll
receive my first negative feedback? In hindsight, I should have looked at their
feedback first, but is there not a system in place that suspends sellers if a
certain percentage of their transactions result in complaints and/or escalations
through BL or PayPal? I've placed 89 orders, and this is the first time I've
had an issue.

payment so you have to go to Paypal (or your bank) for that.
also as a buyer, 1 negative doesn't really affect anything at all (and I
might be mistaken but if the NSS is completed it might get removed by bricklink)

Thanks for the advice! Their terms state they try to ship within 3 business days,
but may take longer for large orders or during the holidays. I purchased 6 unique
lots - 3 minifigures (11 total) and 3 small weapons (24 total), so nothing terribly
complicated or time consuming. I'm hoping they will respond and the orders
will arrive but, after seeing the retaliatory feedback they left for buyers who
left them neutral or positive feedback, I wouldn't risk leaving them negative
feedback. And that's really the larger problem. I've purchased from sellers
who have made mistakes, and it's not a big deal. I either reach out to resolve
it, or it's so small that I leave positive feedback and don't worry about
it. But when a seller is genuinely bad and it isn't reflected accurately
in their feedback because people are too scared to post it, it kind of ruins
it for all of the great sellers who work really hard for their positive feedback.

I would NSS/Negative Feedback them, I would also expect this to happen with me
as a seller if I didn't ship out for three weeks, it is over 7x the amount
of times promised in their terms, once again, I would do the NSS/Negative Feedback.
Although, when they finally contact you, don't be hostile, just use the NSS/Negative
Feedback as a way to get their attention. I do not mean to be harsh, try to be
understanding from their point of view when they make contact, you never know
what is going on in their lives, so keep a balance of being a buyer who is serious
about getting their items, and an understanding of peoples trouble in life. Just
my 2 cents.

Thanks, Noah. You’re right about giving people the benefit of the doubt; I’m
a volunteer crisis counselor, so I know that we’re each carrying pain and going
through difficult times to varying degrees. There are days when it’s hard for
me just to eat or take a shower and, as infrequently as that happens lately,
it’s what has thus far kept me from opening my store… the potential to disappoint
a buyer with a shipping delay bc of my struggle. Anyway, TMI, but I think the
world would be a better place if we all showed each other and ourselves more
compassion.
As far as an update, I heard from the seller shortly after I posted this, and
they were apologetic and said they had trouble “sourcing” this particular minifig,
but that it was on its way to them and would be packed and shipped to me asap.
I said I understood (not sure if I actually do?) and to please just let me know
when they received the items. I haven’t heard back since. Again, I want to give
the seller the benefit of the doubt, and I also want to do what I need to take
care of myself financially and otherwise. It feels like I’ve doled at an interest
free loan, and I’m the one having to pay interest on it. I know there are substantially
bigger problems in the world but, again, we’re all fighting our own battles.

Although it sucks that they can come back and leave you bad feedback when you
did nothing wrong. If you had a store and seen they had posted bad feedback for
you because they didn't follow through on their end. I wouldn't hesitate
to buy from you. I know in the long run still sucks to get a negative feedback.

to review your feedback before you buy with instant checkout. However buyers
can look at feedback scores before making our purchase. If they hit you back
with 2 negatives you'll drop to 97%, and if I were buying from your store
I'd go look at what the negatives were. You can usually tell immediately
if they're unhinged but even if, I'd go look for your feedback and see
that you filed two NSS's.

Do what's right for the community.

The status on your order is "Paid". Did you by chance use instant checkout?
Or did you get an invoice and pay with an off-site payment like Friends and Family?

As a long-time buyer on Bricklink (19+ years) this is how I would handle this
situation.
You have contacted the seller. Wait 3 days for a reply. If you don't receive
a reply in 3 days' time, file an NSS.

Open your order. On the top right side click on the report problem link. It
is easy to fill in the form.

The seller will have 5 or 7 days, I forget which it is, to respond to the NSS.

If they do not respond to the NSS in the time frame given, the NSS will be completed
against them. Then you can file a PayPal claim to get your money back.

Repeat these steps for the second order as well.

Do NOT worry about negative feedback as a buyer, it will not affect your store
feedback.

If the NSS is completed, the seller will not be able to leave feedback for you.

You do not have to wait for the NSS to be completed to start a PayPal claim.
