How does megablocks even get away with it?! I can’t figure out how they haven’t
been sued.

AFAIK, as long as they don't put LEGO on it, and TLC doesn't have a Patent
on this specific item, or there's no Copyright issue (for ex. a Star Wars
item) - anyone is authorized to mold and sell this item.
If you prefer, see it like a (common) bolt or nail. Anyone can make them without
being ha ha screwed

| It also has the circular marks in the corners that read mega bloks. 
We all miss things from time to time.
