Hello everybody!

I stumbled upon a seller who definitely is breaking Seller Terms of Service,
point 1.2.8.
(does not have exact quantity for sale).

https://www.bricklink.com/v3/terms_of_service_seller.page

This seller has EVERY part that PAB offers, for a very small price, in huge quantities.
He sells nothing else, no sets, no minifigs, only parts available right now on
Pick A Brick section.

He has in his terms that orders will take 10 days to process, 2 days to invoice
and so on.
It is obvious orders for parts that he gets, he will turn around and buy on lego.com,
wait for it to get to him and THEN he will ship it to the buyer. He does not
have these parts on hand.

Is this something BrickLink and its community should allow?

What do you think?

Lots of assumptions in there, you can't accuse people without being 100%
sure

Hence why I didn't name the store.

Its inventory just jumped from 5M parts to 8M. I'm not sure what else to
call it than sketchy.
I think it deserves at least a looking into by BrickLink.

You can report the seller using the problem center at the bottom of the page,
then let them decide.

If the seller can deliver the sold quantity at the agreed price, no matter when
or where the seller stocks up, I can't really see any problem.

Given the large quantities involved, I think it's worth BL looking into.
If the seller can prove out their inventory, more power to them.

That's nice, but the terms for selling on BrickLink require you to have any
listed stock on hand.

If he is relying on online PAB on lego.com then it will take longer than a few
days to get to him, let alone his customer.

It's hard to say for sure without knowing who the seller is, but it's
entirely possible that they do have the parts in stock, and have simply sourced
them from Pick-A-Brick.

Hello again,

It seems like BrickLink closed down his shop when I posted on this forum, only
for him to reopen yesterday.

Again, the store follows the same modus operandi - items listed are ONLY items
that are available right now on Lego's website, in exorbitant volumes, sharply
undercutting everyone else.

All sellers should be nervous about this, as it's unfair competition - it
is against Seller Terms to list things you do not have on hand. It's another
matter to be short by 1 or 2 pieces, but not having the stock and relying on
customer orders to purchase the parts? This person lists in their store terms,
that their processing time is really long (2 days for invoicing, 10 for processing
+ other days to ship).
That time is used to order the parts from Lego's website, receive the parts
and send them to the customer. It is within the time-frame of Lego's delivery
here in Poland.

If this goes on, what will stop others from listing items that they do not have,
with an undercutting, minimal profit margin, in quantities beyond other sellers,
only placing an order online AFTER a customer buys it in their store first?

I don't have proof for all this, but this is really sketchy and I think BrickLink
admins should really look into this seller's inventory.
As of now, this store is the biggest one in Poland, being 1.5 times larger than
the next store, and quite frankly, I feel like it's not being truthful and
fair.

What will stop them is bad feedback for late delivery if customers complain and
later read feedback before purchasing.

It may be that they do have the inventory. If already BL shut down their store
but allowed it to be reopened then presumably they would have asked for evidence
of the existence of the stock. I think all you can do here is report them again.
If BL have already investigated it, they will ignore the reports.

Their inventory jumped from 2M parts, to 8,2M, then when closed went back to
0, and is now at 3,5M. All parts reuploaded yesterday, all available at Lego
PAB section. Minus the DUPLO available there.

The largest store in Poland has almost 2M parts and has been operating, adding
parts for few years. This is not fair to any seller who had to first invest into
purchasing their inventory, and then have it listed, essentially freezing their
money until someone purchases.

He has, for example, a staircase in Reddish Brown, 1700 of it, which is about
10,000PLN - you can purchase a car for that. Multiply that by 3,000+ lots he
has, and you can see why I'm skeptical about all that inventory quantity.
All his prices are Lego.com PAB prices + little extra.

It is clear, at least to me, that something is not right here. It isn't difficult
to have low prices if the inventory is 'in the cloud', and the financial
input to purchase these items isn't yours, but your customers, with a small
margin slapped on top of that. It doesn't seem like healthy market competition.

So report it, with whatever evidence you have.

BL can look into it, and they would probably ask the seller for photos of proof
of stock. If they investigate and the seller is allowed to continue, you have
to accept BL have made the decision.

Thank you Brickwilbo, I appreciate your concern!

I am just asking if such store policy is permissible on BrickLink and should
it be tolerated. Pieces of this puzzle paint a certain picture and I am just
wondering if this seller is acting fairly.

Their orders placed are nearly double their current feedback.

I think that, at least partially, helps explain the processing delay.

Compared to other large stores in Poland, it looks like they just sell New Parts
in bulk.
