| Apparently it's becoming mandatory to register with the German LUCID register
by 1 July 2022 under a threat of big fines.
Looks like it's a serious thing as eBay just had an update saying that all
sellers selling to Germany regardless of their location need to follow the rules
of the act or their listings won't be shown to German buyers.
Do bricklink sellers need to register?
Will bricklink enforce the registration?
I didn't see it discussed in much detail in the forum and it's probably
time to know more as the deadline isn't far away.

I think it applies to all businesses sending items into Germany, whether they
are in UK, EU or elsewhere. Turn off Germany in the shipping options and the
issue goes away. If the cost of the licence (isn't it something like 40 euro
minimum through eBay suggested partner) is more than the extra you make selling
to customers in Germany it is not a big deal. Just like some EU sellers stopped
shipping to the UK for Brexit paperwork reasons, no doubt some will stop sending
to Germany too when the packaging licences come in.

| Turns out there is a comparison website (verpackungslizenz24) for the "licensed
recyclers". The one recommended by eBay is the most expensive. I bet eBay is
taking a cut. There's one that seems to offer the needed level of service
for about £10 per year and a few for around £25

I'm going to go out on a limb and say that a law requiring any kind of thing
from hobby sellers, gift givers, or small businesses halfway around the world
is unreasonable.

This is Germany. Remember all the issues over the years German sellers have had
to comply with local legislation compared to other international and even EU
sellers. German legislation often goes further than other EU states. For some
it is too much microscale management but to others it is innovative thinking
charging at the source of the packaging waste.
No doubt costs will get passed onto the consumer although here that means setting
up separate shipping methods just for Germany, unless they are charged across
all EU customers, for example, if that is a seller's shipping zone.

How does the German government plan to enforce this new law? I know that foreign
companies that fail to comply with the GDPR can be banned from doing business
in the EU, but the German government does not have the power to fine U.S. citizens.

Presumably they can destroy parcels that don't comply with their laws.

You'll have to remove Germany from every shipping option you have - including
manual invoice.

| Since we are a bigger firm where the BrickLink shop is a tiny part of we're
already registered.
It's sad to see buying opportunities vanish because of inconvenient rules.
But that also means more business in Germany for us. Though we mostly deal in
used parts and I think there is a bigger market for new parts/sets.

I'm following up with this to see if anyone had issues since inception? We
have a non-LEGO business on Etsy and have seen many small business people say
they can't sell now as Germany is fining them.
I'm curious if this is actually covered by TLG for the U.S., and anywhere
they collect VAT from the customer - as the VAT invoice shows LEGO as the collector
of said VAT - if thats the case, wondering if packages will go through under
their name?
Hoping someone has some idea? I'd hate to stop shipping to our German customers,
but we will if this is attached to the individual shipper and not to whom is
handling the tax collection, etc.

It's not related to VAT.
Packaging Act is to pay for recycling things you send in Germany.
Dot.
VAT is, doh! VAT.

Ok, so what I'm hearing is that it's assumed all sellers on here need
to register for this, as most likely the packages won't go through?

Donno if it's active as of right now, if parcel go through or not - I mean,
from here it seems to be OK.
But yes, it seems (didn't have much time to read about this), you've
to pay an annual tax for the cr^p, erm the packaging, you ship to Germany, so
they can recycle it using your money.
It's not very expensive, but if you ship say a couple of parcels per year
it's probably not worth it.
As if their government couldn't pay for this But it's another story.

I know it's obvious but really it was more of a comment about how many small
businesses are dealing with the issue. I know of quite a few ebay sellers that
would normally send ~20-50 parcels a year each that have taken that action. For
consumer type goods, it is probably not an issue for buyers as there will be
plenty of channels to get the same items. But for collectables and similar, it
might make a more noticeable difference.
