Customs has the right to open packages, it's not the sellers fault.

You always take a risk when importing anything from outside of your country.
The loss is taken by you, as you had accepted, when making the purchase.

What you faced is the most unfortunate issue. As customs do have its right there,
even insurance cannot cover that kind of damage...

Customs is "king".

I once had an order stuck at custom for 2 months. After asking for multiple times,
it just said it takes time for its clearance. Worse still, in order to have the
item released, the buyer needed to pay a huge sum as VAT...I'm not saying
VAT is wrong, but the thing is the sum was unreasonable. I requested to know
how they get that value of VAT, the custom email just said "the system shows
this value, I have no idea how it was calculated."

It just gets frustrating when customs take unilateral decisions...I feel sorry
for your loss indeed

What do you mean by opened? There is a difference between them neatly cutting
a tab or breaking a seal to open a box and, for example, cutting a panel off
the side of a box or creating a big hole in it.

If they have just opened it, then there is not really any damage. Whereas if
they mutilated it, then seek damages from them.

abroad without a buyer consenting it to have the item opened.
NOT the outer package, but the item INSIDE a package.


So I would say, send in a claim at the customs department.

See, this is where I have a problem. You were buying for collect-ability and/or
price appreciation. Now your ability to do those has been compromised. It is
not the seller's fault, and it's not the custom's agency to blame,
it is the expectation that a sealed set with travel thru customs and come out
sealed. No one has taken anything from you, you can still play with the set and
build the model. But that appears to not have been your objective.

We all collect for different reasons, non is better or worse than the other.
The OP simply did not think this would happen.
I do agree it is not the sellers fault and customs certainly has the right to
open anything they wish.
But I do not agree that nothing has been taken from the OP, his MISB was taken
from him.
Again, we all collect differently, no one way is better than the other.

I ones got a small set, purely because the contents was related to my job.
I wanted to keep it sealed, to sit in my collection.

Unfortunately for me, my children thought differently, my joy was ruined.
Luckily for me I am stronger than my children

Please do not judge an honest question from another collector, thank you.
