Order shipped to the Netherlands.
Total value= $59.17 USD = about 52 Euro
Shipping = $17.50 USD
VAT charge by Bricklink = $16.10

I passed ELECTRONICALLY the VAT and attached the invoice on the mailer. The buyer
received the package few weeks ago but after about 2 weeks, he has received an
invoice by Dutch customs to pay VAT: 33,24 Euro

This is why I put minimum 150 Euro for orders from Europe.

So VAT in the Netherlands is about 50%?!

$59.17 + $17.50 + $16.10 = $92.77
€33.24 ~= $38, hence 40% but that’s without counting with the handling fee.

VAT = 21% (like Bricklink calculated correctly)
Import Tax = 11 %

What do you mean by “import tax”?
There’s no duty below €150 in EU (hence the limit for VAT collection).

Customs Clearance fee: depending on courier. Minimum is €4 (PostNL, low value
parcel, online payment), but I have seen fees up to €20 for handling the customs
proces.

21% VAT on $92.77, that would be $19,48, so about €17 (with the rate given by
OP).  That makes about €16 not accounted for.
Could be fee and could be punishment/late fee too (as, apparently, the package
was delivered but the IOSS/VAT was verified later and found lacking, need to
get back the price of the stamp for sending the invoice).

You are right, my example contained some errors (the 11% import duty, which for
Lego over €150 is 4.7%).

Don't all countries have a VAT rate PLUS a fee for assessing and collecting
the VAT. Those fees are typically in the region of 10 Euro or so minimum, depending
on who is doing the calculation.

No, it changed: under the 150 threshold there is no Duty fees anymore.

https://www.laposte.fr/produits/article/tarifs-consulter-le-catalogue-integral

Package from out-of-EU, distributed in metropolitan France:
https://www.laposte.fr/medias/sys_master/apache_synchronised/h52/h93/17490078662686/Tarif-frais-de-gestion-France-Metropolitaine-12-10-2021.pdf

€2 or €5 (online payment), €8 (payment to the postperson).

No mentions of any value below which there would be no fee.

(Good news is I remembered it was higher (about double).
Bad news is I don’t know how you can pay online when the first you hear about
it is when the postperson rings at your door….)

Oh? But La Poste isn't a reference

I thought there was no duty fee with the IOSS, now I'm puzzled... !?

Anyway...

I mean customs brokerage fee, whatever.

I'm still surprised you've to pay upfront the VAT, and then you've
to pay separately the brokerage fees...

I can see less and less import/export

You’re both right and wrong:

Right: When the IOSS is correctly passed and received and used, La Poste doesn’t
assess VAT and doesn’t collect and therefore there’s no brokerage fee.

Wrong: When there’s a problem and VAT is due again (double-VATed, like OP), then
it’s like the IOSS was not used (like above €150) and there’s an assessment /
brokerage, and therefore there’s a fee.

This thread is about a buyer who got double-VATed… so IOSS didn’t work and there’s
a fee.

In Germany you have to 6 Euro to Deutsche Post for processing this VAT collection.

Ah OK... Then that's what I thought, alright.

Yes I was talking about in case there's IOSS applied.

In short, I'm 100% right , buyer hasn't to pay VAT twice, and hasn't
to pay for brokerage.

OK, thanks other-Sylvain for your always detailed info!

Thanks, but I think you’re confused about the meaning of “other”: _you_ are the
other-Sylvain.
But no problems, it’s a common mistake:  The other day I crossed the street to
the other side and people there told me the side I came from was the other side.

The buyer has to submit an objection at the Dutch tax agency. They have to proof
they payed tax twice. With bricklinks IOSS number and the (assuming) PostNL invoice
they can proof this. There are more (small) requirements, but it is the main.

This is a link to the Dutch tax agency explaining how to deal with this. It is
in Dutch, I could not find an English page for it.

https://www.belastingdienst.nl/wps/wcm/connect/nl/internetaankopen/content/ik-moet-te-veel-invoerrechten-betalen-voor-mijn-pakket-uit-het-buitenland-wat-kan-ik-doen

I also can imagine every European country should have such a objection methode,
maybe we can collect them for every country and make a Bricklink help page for
it. If done very well, we can also include an example letter.

In Denmark it is not possible to object. They suggest not paying and have shipment
returned or pay and handle it with seller afterwards.

I have a shipment from the UK which they claimed did not have ioss electronically.
The system is broken and Bricklink needs to take action.

The most frustrating element of this is, that the other way round (Canadian buyer
buys from Dutch seller) there is no problem at all.....
That's good news for Canadian buyers, but ihard to swallow for Dutch buyers.

IF and WHEN Dutch buyers object/claim at the Dutch tax office and get there double
paid taxes refunded, PLEASE post this in the forum to HELP other buyers and sellers.

This is a good point. Also, there may be other places/resources out there on
the web as this must be happening to many Dutch/European consumers in general
right now. I can imagine that if many consumers have to deal with this problem
when buying online, it could at least reach the media.

  Order shipped to the Netherlands.
Total value= $59.17 USD = about 52 Euro
Shipping = $17.50 USD

As I found 33,24 Euro too much for this order, I contacted the buyer and asked
him if he has another order. He responded:
The answer is yes but almost everything remains the same, except that I do not
know if the other seller electronically submitted IOSS number.

Funny thing is that PostNL delivered the package but now asking him to pay otherwise
they will return the package to seller or get disposed of it!
