Kind of a long story, buyer contacts me last month asking if I'll please
open my store so they could purchase a couple of figures. Wasn't really
interested, but gave them the password anyway (my first mistake), and they made
a purchase. Pulled the order and sent invoice, instead of paying they waited
awhile and used the password to add another figure. Pulled it and sent another
invoice, same thing, they waited awhile and added another figure, pulled it and
sent an invoice, you guessed it, they waited, used the password and added another
figure. Each time resetting the time.

Anyway, once I was wise to this scenario I changed the password and waited.
Finally messaged asking if they were going to submit payment or if there was
a problem I should be aware of. Response was, I'll be submitting payment
today. Waited several more days and finally opened a NPB. Buyer paid that evening
and I shipped the order the next day. Mostly brand new never assembled CMF's
with leaflets and packages.

Tracking shows the order was delivered a few days, so today I get this message:
"Hi! I have received the package. But all of the figures are so permiated with
cat urine, As I was walking out to the mailbox I could even smell it. Maybe
by a compensating half refund That would be fair. Let me know what you can do!
Thank you Kindly!"

I did respond in anger (my second mistake), "Seriously? Guessing this is a pathetic
attempt at retaliation, since you couldn't
be bothered to pay for your order until I filed a NPB. Especially since I don't
even have a cat."

So this is where we are now, see pic. Between 1000's of transactions between
here and Ebay I've never had a claim made against me, but hear all the time
that Paypal always sides with the buyer, does anyone have any suggestions on
how to proceed. In a normal situation I'd simply tell the buyer to return
the order for a full refund including shipping, in this case I seriously doubt
mu merchandise would come back the same way it was sent.

Just give paypal the facts and hope for the best. We had a paypal claim put against
us last year because we took one day longer than our stated 5 business days to
ship the order out (we had told the customer about the extra delay before shipping
the order out, but they waited until after receiving the items to complain about
delay and demanded a full refund). We gave paypal the facts and they closed it
in our favor.

Thanks, I did respond in Paypal, offering a full refund plus shipping upon return,
based on the response I'm pretty no matter what happens I'll be screwed.
Either she'll get a refund or return something unpleasant. fingers crossed.

Does PayPal know that the buyer wanted to make a deal for a half refund? I feel
like that's important if she is now claiming that the items are counterfeit.

They do now, I sent them a copy after your post. Thanks!

It is allowed to name and shame on the forum. Many sellers had done so.

Do not pay a prepaid label. The buyer has to pay for return shipping, specially
in this case.

Few weeks ago, a customer opened a case on PayPal. (but did not make it into
a claim)
I called PayPal's customer service. They said my record with them was perfect
and I am a good seller. I discussed about few things with them.
Even if they return you some broken minifigs and get a refund, you can still
appeal PayPal's decision. They will check who said what and make a decision.

The point that they say AT THE SAME TIME "counterfeit" item AND "Smells" urine
would make their case look like a scam.

Good luck!

You should post it. Sounds like a good thing to alert sellers to.
You should also have a cat. So many need homes.

I did at one time, sadly they don't live as long as us or I still would.
BTW, he was gone long before the "counterfeit and covered in urine" figures
ever came into play.

I'll be leaving appropriate FB for this scammer shortly.

It is possible an animal entered the delivery truck and did it's business
on your package. I have left my car door open for minutes and my neighbors cats
entered my car. I think the cats thought my car was either a fun house or had
something good to eat (or both) as the cats entered my car a few times.

I would offer return shipping with a prepaid label and provide a refund upon
receipt of the items. I would also video opening the package that was returned.

Anything is possible, my concern is this all started AFTER I opened a NPB, then
they tried to get a 50% discount for "urine" that miraculously became a full
refund for "counterfeit" items. It's pretty clear this buyer is nothing
but a scammer and thief.

I really hope admin. sees this and gets rid of them before they steal from someone
else. This isn't the kind of behavior I've come to expect from people
on this site and the main reason I stopped selling on Ebay. It's people
like this that ruin things for everyone else.

Buyer also claimed the items were counterfeit. These scams often have 2 embedded
claims so that if one fails (the urine bs) there is still the other one to deal
with. Also, if the odor was a pungent as the buyer claims the post office would
not have delivered it. Urine is considered a toxic substance and must be properly
packaged.

Why do this? Even if PayPal decides against her, buyer still has to return the
items at their own expense. I have never heard of a successful PayPal appeal
using video, would love to hear about anyone being successful with video of opening
the package.

Why, because that is how I would choose to handle this situation.

Yes, I wanted to know your reasoning.

Even if PayPal decides against her, buyer still has to return the

Incorrect
https://www.paypal.com/us/webapps/mpp/returns/terms

Buyer has to return the items at their expense. If the buyer activated the Return
Shipping on Us PayPal service and PayPal pays for it instead that's good
for them:

*Exclusions apply. This is an exclusive offer offered to eligible holders of
U.S. accounts with PayPal. Activate Return Shipping on Us. Once the service is
activated, participants may receive a refund or create a free return shipping
label, for up to $30 on 12 eligible purchases of tangible items per calendar
year (January 1st - December 31st) on qualifying returns in accordance with seller’s
return policy. PayPal reserves the right to cancel or modify part of or this
entire Offer at any time without notice, for any reason in their sole discretion.
Other limitations apply.

I have never heard of a successful PayPal appeal
using video, would love to hear about anyone being successful with video of opening
the package.

I haven't heard of video evidence failing.

Video evidence *alone* has never worked for me or anyone else I know. It would
be great if PayPal's policy is different now, but I have been told by them
over the years that video evidence is not acceptable because it is too easily
manipulated.

the order for a full refund including shipping, in this case I seriously doubt
mu merchandise would come back the same way it was sent.

Sorry to hear about your troubles, Darcy.

You got some good advise regarding PayPal, let's hope it's handled justly.

I've provided everything I have, and had already offered a full refund, including
shipping, plus provided a return label, so we'll see.

As for the furbabies, sadly the rottie and tri-color mix both passed away the
beginning of this year, 1 in Jan. and 1 in April. Both were seniors and went
peacefully at home with me by their side.

Always seemed a cruel irony that man’s best friend and companion has a lifespan
so much shorter than ours. They are wonderful, our dogs.

Just a bit of advise. If the buyer wins their case. Launch a seller protection
case. Base it on fraud. And you should win that one.. You may lose the buyer
case against you but remember you are covered by seller protection and have to
lodge a case but can not do that until the buyer one is settled. A lot of sellers
are not aware of the seller protection or do not lodge a case as they wrongly
think the buyer case stops them from doing so.

just a footnote get in the habit of taking photos of the good before packing.
Packed in box/packing before sealing. The box/package sealed and address and
tracking on it. These photos come in very handy with seller protection cases
with paypal...

Taking pictures and video will do no good. Once it is pictured you could open
the box put what ever you want in it and reseal it. Just be glad it’s not Amazon
you never win a case.

I had an issue in the past where the buyer wanted to return the items, for legit
reasons (box got damaged in the mail).
The seller started a PayPal claim, which I responded to I would agree to a full
refund when the items arrived at my address. A few days later, the packaged was
delivered. Not unimportant: the package was complete. PayPal received proof of
shipment (tracking) from the vendor.
A full refund was done, without the cost for return shipment (I guess this was
covered by some PayPal insurance?). I certainly didn't buy a return label
up front.

Given this experience, I would not do a refund (or buy a return label) before
the items are in my possession again. I would inform PayPal a full refund is
not an issue, but only after I validate the goods are received back in my possession.

Should the returned items not be complete or be replaced by counterfeits, I would
inform PayPal at that moment of such case. I know PayPal favors the buyer most
of the times, but not always. Just stay calm, act rationally and communicate
through the PayPal ways of communicating (and no longer directly with the buyer).
I think that's your best chance.

Follow up: I followed all of the advice given here and finally won the fraudulent
Paypal claim opened by this buyer. I'm stuck with a negative FB but at least
they weren't successful in ripping me off.

Thanks so much for all the good info.
