Got this pen in the mail last week. Apparently someone is chasing businesses
down, putting their logo on the pen as a free sample. But they don't seem
to know what they are doing and put the Bricklink logo on it!

I have several of those pen’s.
They use information from the chamber of commerce.
The pen’s I have only have the company name and adres on them.
It seems they now track the header of the website, which in your case links to
bricklink.

That's cool. I wonder what the legality is of them producing items with a
company logo on without permission, even if it is as a sample for that company.

That's exactly what I figured when it arrived.

Yeah, that must be it, but it's a high risk like yorbrick mentioned. I guess
it pays off though

Check the pen carefully, there should be a mistake done on purpose in spelling
to avoid problems with trademark. I know this company, used to do some work for
them in their irish branch.

1. Nope, there isn’t any mistake.  It’s even written “bricklink” on the pen in
the same typeface it’s written on the header here.  And the logo is correct too
(I think, because it’s more difficult to see: it’s October so the logo changed
on Bricklink and any perceived error could just be due to the photo or the stamping
process).
IOW, they just copied and stamped the image of the logo.

2. Even if there were an “on purpose mistake,” try selling a soda drink called
Coco-Colo and come back to tell us how it went… if you have Internet in your
cell
Such small differences do not protect against trademark infringement.

They are in the “it’s just a commercial sample” zone.  They are not selling the
product.

The moment they’ll start to be in trouble is when Alico64 signs the order… but
then Alico64 will be in trouble too

Of all the knickknacks I've seen used as promotional items over the years,
pens are at least useful and tend to be at-hand to be passed around for use by
others - further promoting

Well, it at least is a positive indicator that individual consumer data being
sold across the internet isn't wholly accurate. My personal favorite is phishing
e-mail claiming to be from PayPal or other site that I do business with/through.
I don't have to check the (il)legitimacy of these emails because the English
grammar and spelling are so bad as to make an American third grader feel better
about their own self-image.

I deliver a lot of these sample pens from National every week. They're kind
of like Spectrum communications; no matter how many people keep throwing away
the Spectrum ads they receive in the mail, Spectrum keeps right on trying. I
daresay that if every living being (and a few deceased ones) on Earth was a Spectrum
subscriber, they would still mail out standard mail adverts every few days.

Actually it's because the OP is a registered business, which (awkwardly)
means that the address is public. So no need to buy any data, they can just go
over the chamber of commerce register. Many small businesses are not happy about
it, but it seems that for now it's not going to change...
