On Tuesday, a 23-year-old from Klagenfurt was sentenced to three years imprisonment,
one of which is unconditional, for serious commercial fraud at the Klagenfurt
Regional Court. The defendant was accused of having deceived customers who had
ordered Lego parts from his company. In the process there was talk of 250 victims
and 500,000 euros in damage. The judgment is not final.
In addition to serious commercial fraud, the Graz public prosecutor also accused
the man of falsifying documents and favoring creditors. As of 2019, the 23-year-old
is said to have deceived more than 250 customers from home and abroad with his
Lego shop. Orders entered should have been sent incorrectly or not at all. In
several cases, sand was sent instead of Lego. Some of the goods were not in stock
or ready for dispatch as promised. According to the public prosecutor, not only
the customers, but also two payment providers were harmed by the remittances
carried out.
Amount of damage
Despite a prevailing financial distress of the company in 2019, the defendant
is said to have continued to invest the down payments from customers. Money is
said to have flowed into furnishings and private objects, among other things.
Transfers from company accounts to the defendant's private account have also
been proven. There is still no trace of 100,000 of the over 520,000 euros in
damages. During the ongoing investigation, the defendant founded another company
under a false name. "My reputation was already damaged at this point," said the
Klagenfurt resident.
The defendant confessed to the allegations, but denied intent and asserted that
he had also bought goods for customers with the down payments and loans. With
most of the money he wanted to save his company. Only a year later, after he
was already aware of the poor financial situation, did he file for bankruptcy.
"I was dogged. I wanted to get it done," said the defendant. "He failed to pull
the emergency brake," argued the defense attorney. A lack of commercial training
was another reason for the defense attorney's actions by his client .
The lay judge, chaired by Judge Ute Lambauer, finally sentenced the defendant
to partial imprisonment. Because the defendant had been in pre-trial detention
for eight months, the remaining four months were considered conditional detention.
In addition to the sum of money and the number of victims, the Lego sale was
an aggravating factor during the ongoing investigation. "That doesn't show
any remorse and doesn't make a good picture," said Judge Lambauer. The public
prosecutor's office made no statement, so the verdict was not final. The
request for immediate release from custody was granted.

I was one of the buyers harmed by him, but I only lost around 20 EUR on a very
large selection of parts of a 80 EUR order, many people lost much, much more
and that's a shame.
