There's a store in the USA that is selling many uncommon/rare minifigs as
new, though advertising that they have been in a display case.

Is this now considered acceptable use for new minifigs?

I think this is risky, as it is not too far off from how I "use" Lego sets.
Most of my personal Lego is assembled once and displayed only. Even my own minifigs
are typically bagged and set aside in plastic drawers.

Was it an official/LEGO store display case? I'd understand the New condition
if it was the case, but otherwise I believe it should be Used.

The official help page about minifigure condition doesn't help much in this
particular case.

I believe that the rules on minifigures are that you can assemble them (or even
disassamble them if they come assembled) and still sell them as New. That said,
if the display case has studs then the minifigure is definitely used in my opinion.

The official BL definition seems to be that new parts have been "handled only
for sorting," but the general definition is that a part is used once it's
been connected to another part. The Help Page does make an exception for assembled
minifigs to be listed as new, but only the figs themselves, not accessories
or display stands. Therefore, if any of the display figs from this seller were
connected via their feet to another piece, like part 88646, or if any accessories
were placed into their hands, then the figures aren't new. I would also venture
that they're used if they've ever been cleaned, even with compressed
air, or collected dust at all. And finally, what about sunlight? If they've
been exposed to direct sunlight for any amount of time, they probably shouldn't
be considered new, even if they were inside a display case.

But what about when the figs are set on a flat surface inside a dust-free display
case in a basement and have never held an accessory? Seems like a gray area.
Personally, I'd vote that they're used if they've been on display
for any length of time, but then again, I think figs should be considered used
if they're connected in any way that they didn't come in the original
packaging. But sadly, I don't get to define these things.

I think it is used. "On display" is not the same as the listing definition of
handling for sorted. On display is just an adult version of "played with".
