Hi there. What UTLF said in his response was 100% correct!!!

File a Claim with Paypal and if you can't because the seller made you pay
with Friends & Family service, then report that to a Bricklink admin!
File the NSS for sure, that will give them a STRIKE against their account and
2 more and they get shut down!

The seller obviously doesn't have the head at all or he would have shipped
it. Unless it's a rare head like a Jango Fett head from original fig. Then
the seller basically ripped you off on purpose so you need to mention that in
your paypal claim and you will get fully refunded.

Also, WHO is the seller? Mention is store name and user name so we can block
him and avoid!
Thanks and sorry that happened to you. BTW, what was the fig you ordered with
the special head?

In Problem Order, Seph6 writes:
Hello, I recently purchased a minifigure from someone abroad. After some time,
and after paying almost the same amount as the purchase in taxes, it arrived.
I was so happy that I immediately gave him a nice praise. But then I realized
that the head of one of the figures was wrong. It had a similar head, but cheaper
than the one it should have come with. After that, the salesperson was very arrogant
and said that I had to comply with three solutions he presented, which I found
unacceptable. What I wanted was for him to pay for the right head of the minifigure
plus shipping to my country (as I couldn't find that head here). I have already
filled out an NSS but I am confused about what happens then. Will I ever get
compensation? Will he be punished? Is there any way I can change my praise to
a complaint?

Yes we all make mistakes. A newbie, or teenager would leave a NEG for this kind
of small mistake.

Then he leaves you a negative FB without contacting you and letting you know
so you can fix the mistake!!! Very bad and a newbie thing to do. This is unacceptable
and he will be added to my Block List so he can't buy from me! And I am
sure now he will be blocked by many other sellers here so he knows this is a
community and you don't just leave a negative to a good seller who can make
mistakes. We all make mistakes!

Yah that is unfortunate but 9/10 times after a refund and a nice message they
remove it

Wow that is nice, but I haven't seen that high of a %. But I rarely get
negatives luckily. But I make mistakes and fix them best I can.

I would have asked him to reverse the feedback and you can fix the issue for
him. Yes you are showing you have great integrity and professionalism here,
but it tarnished your perfect record which is huge! All my negative and neutral
is by rude and hurtful people who shouldn't be in this community! And I
left them negative so that others would not deal with them.

See if you can take that positive back and leave him a negative for not messaging
you first and also saw the fig and didn't say anything to you.

Good luck.

If you also leave a negative there will be almost no chance for him removing
his

But this would be after he has asked if he can fix anything, and after he's
asked for the Neg to be removed and hopefully it turns out to be a Win/Win for
both of them.

The buyer indicates that I had sent the wrong figurine.

(I always ask buyers if they would like a picture of my used fig to make sure
that they are okay with the figurine's condition.)

So I went to the pictures I had sent him and I did make a mistake and sent a
figurine that was similar to the one advertised that had a different torso.

I understand that this is 100 percent my mistake but I am wondering how should
I respond.

I sent a message to the buyer apologizing and asking if he wanted a refund.

Currently he has yet to respond.

Should I still send the refund even if he does not answer?

Would it be appropriate for me to give back a neutral feedback considering that
I had sent him a picture of the figure before him paying/me sending.

Thanks.

This was posted in the Facebook BrickLink Worldwide Buyers & Sellers group by
Bricklahoma!
This is how all buyers should be. Even in retail and grocery stores!
Here's his post:

I know it’s easy to complain here about buyers, but I wanted to share a handwritten
thank-you note from one. We refunded .25 because a torso was OOS, then she emailed
saying we shipped white instead of LBG tiles. I then refunded the whole order
and also sent a $2 coupon which she redeemed the following week.

We just got back from the new Bricks & Minifigs here in OKC, so this $$$ has
already been spent on Lego 🙂

false or misleading information in regard to paypal may simply be "this is a
friends and family payment" when they know it's for a sale.

I don't think they have any interest in policing anti-vaxxers who spread
misinformation.

Pro-Vaxers can spread misinformation too my friend. 😉 lol

recent TOS agreement, I'm wondering if alternate forms of payment are being
considered for "Onsite Payment".

I would love to switch to another platform, however, at this point Paypal is
a must, to effectively buy or sell on BL.

Stripe - and I think that's it and that's all.
No problem with Stripe for years here.
Neither PayPal.

Thank you. I'll have to look into setting up a stripe account. I didn't
even know this was an option!

We actually don't know if it's an option with BL because we haven't
heard from an admin about anything. And how does Stripe work? Are credit card
charge backs a regular thing with buyers?? Can a seller easily be scammed by
a buyer using this?

Bricklink needs to add more payment options as other platforms allow for many
other payment methods including accepting Bitcoin for payment! I accept Crypto
but I can't sell to USA buyers unless I use PayPal on Bricklink but I don't
want to use PP for many reasons and now with this new scam PP is doing, it makes
everyone want to leave PayPal!!

Yes I agree! What is misinformation to them? And where are they getting stuff
we say from? Do they stalk us on Facebook or Twitter so if we share a true fact
about a political party or leader, but paypal doesn't agree, then that's
spreading misinformation?

And what is Bricklink going to do about paypal when they force us to use PP to
sell to the USA so they can charge them taxes. I can't sell to the USA (on
BL) for this exact reason! I won't use PayPal and now after they pulled
this stunt, I probably won't use them at all. But I am losing big sales
not being able to sell to the USA on Bricklink.

  Thank you Dan

He did so much for so many and his legacy is here for all to see.
Dan did so much towards the joy of Lego.

Many might not know, but Dan was also a founder of Peeron.com. When the two
partners went their separate ways, Dan founded BrickBay. That became Bricklink
when eBay objected and threatened to take BrickBay to court over the name.

I've long held thoughts on this which I'll keep to myself, other than
to say that some pushback would've been in order. The site in question from
early on, often acts as a bully. But as with most bullies, when you respond in
kind with your own attorney and the threat of litigation, they quickly cave.

These types of entities typically use the one page letter in shotgun fashion,
either from their legal department or law firm on retainer, to handle and quash
any perceived encroachments on their business. It’s unfortunately effective on
the little guy or small business. Never did see legal redress eBay imagined they
might’ve had with the name use.

A little later all shops with Lego in their name had to change their store names.
Same happened to eBay. So, no stores names can have Lego in it.

I remember the debates on whether it should be extended to include usernames
too. Glad it wasn't further pushed, though. Wouldn't you agree, legoman77

-popsicle (not trademarked)

eBay has NO right to the words Auction Bay! That has been around for centuries!
So if you want to have a company with the word Bay in it, it's perfectly
allowed and the judge would just laugh and throw out the case. And hopefully
the judge would make ebay pay for the other's legal fees and compensation
for inconvenience! They were just jealous of losing money to another website!

I will need everyone's support to convince them to turn it back on.

You literally said in your terms that any US customers should contact you directly
so you could sell them their parts outside of BL. Not only were you transacting
using the BL system without BL getting their fees (which is against the ToS),
technically BL still facilitated in getting that order done, so states could
have an argument of tax evasion in these cases. Whether that would be a solid
argument I don't know, but I can definitely see BL not wanting to "test the
waters" there.

Either way, you will have to work this out with BL. I don't see any use in
getting "everyone's support" as nobody else but you and BL are involved here,
and to put it bluntly "everyone" only sees your side of the story.

Anyways, still good luck.

Niek.

Hi Nick. Thanks for your response.
No I didn't say or mean do a deal outside of BL!
I said contact me but then I'd go through BL for the sale. I'd get a
few emails saying that they can't order in my store because I didn't
have the auto paypal on.
But nothing went through.
But they have said they give 2nd chances but not to me?
And support would mean emailing admins and asking for me to be reimbursed stated.
And admin canceled a NPB report I have against a, None Paying Buyer! Lol.
So they are trying to hurt me and let a buyer who's under age keep his account
and a negative on my profile. This happened with the Asian owners when I reported
a seller who circumvents fees. They didn't care and left my Neg feedback
there but told me they would remove it. Admin have different standards for who
they like and don't!

For that matter it's legal for me to sell to buyers in other states and not
collect sales tax (it's on the buyer to pay it), as long as I don't have
a physical presence in those states - the law is that online marketplaces (BrickLink,
eBay, etc., etc.) have to collect and remit sales tax. So if I want to sell on
BrickLink I have to allow a payment method (PayPal or Stripe) that enables them
to collect that tax.

But actually, I don't have to charge tax to USA buyers and that's legal
cause I'm in Canada. I work for a 50 year old company of sporting goods.
We only sell to Canada and USA. When a USA buyer buys from the website, they
are NEVER charged taxes and can check out with the purchase price and shipping
is the only thing added. We don't charge taxes and leave it to the boarder
and the buyer to pay the taxes if it's needed.

Seems that some admin has decided my store needs to be suspended as many other
sellers here on the platform.

Without any notice, I got suspended due to a very angry buyer that didn't
read the store terms and the shipping costs from the Denmark to USA.

I've being in touch with the support only one response given without any
chance to move on or to understand why I shall be kicked out Bricklink after
almost 10 years on the platform and about 210 very positive transactions with
always payment of my seller fees in time!!!
Seems a new buyer with only 2 transaction can kick you out quite easly.

Got kicked out like that is quite annoying and doesn't motivate me buying
more designs, sets or other stuff from this website.

Seems I have to sell my inventory on other platforms as Brickowl, DBA, facebook,
but honestly those platforms are far from the excellent Community within Bricklink.

Bricklinks lack of action speaks volumes about their opinion of their CUSTOMERS.If
someone ignores post after post their actions, not words, are clearly representative
of their caring or their ability to listen to those they are here to serve.
It is evident they just do not care.
John P

Agreed. Even if BrickLink has justifiable reasons for suspending all these shops,
their lack of customer support, follow-up, and transparency tends to make one
feel that the entire system is unfair. We can't be secure with our business
here knowing that others were dismissed without discussion or appeal.

Jen

There are things that we will not disclose in public about why stores were closed.
One example of that is fraud. If we tell a seller how we determined they committed
fraud, they will know the next time how to circumvent our system or hide what
they are doing.

We hold our sellers in very high regard and it is not in our best interest to
shut down people for no reason. We are generally very open to appeal and give
many, many second chances - probably more than we should.

Still waiting for my 2nd chance since I never broke any rules literally!
Waiting on admin to reply after sending proof of my situation and the correcting
my mistake that I didn't understand.
Thanks, James.

a better template for communication with sellers in this situation. It appears
that many of them don't have a clear understanding of what went wrong. Also,
being told no repeatedly is better than radio silence when one is searching for

Why has our community engagement person disappeared?

Is CE_Tanja okay? Was she kidnapped by the dark side? Are her hands tied by corporate?

Maybe someone on the Marketplace Panel (or Seller Panel, whatever it’s called…)
could broach this subject with her?

Maybe we can all get TLC to hire more admins and pay them to take care of stuff
better? I'll apply! I still haven't heard from anyone yet!!
I haven't tried Brick Owl yet, but it was created by a pissed off guy from
here. I can't remember his name but I remember the heated debates in the
forum years ago!! 😉

I'd guess you're just "one in a batch" of removals?
I'm very sorry.

In general I think that BrickLink should start to contact sellers before they
hand out punishment.

This one case is no big deal: it is the way BrickLink has started to do things
that worry me.

I 100% agree with you on this.

Many here live for and from this business.
While BL have probably no obligation to, a simple word explaining what happens
would be a nice gesture - especially when families can be endangered IRL by even
a relatively short shop closure

For the record: I did actually get an apology from BrickLink now, stating that
many such removals are being done and that mistakes happens.

But I still think that their method for handling removals and shop closures are
too fast and summarily.

Helge

Why would BL not see all these posts and fix the issue; notification? Are they
just turning a deaf ear to all the cries for common decency explaining their
actions. Are they really that arrogant that they feel no need to answer? Are
they even part of this community or in some little office in the third basement
of some building in a low rent district? Everyone here, for the most part, are
nice and thoughtful. Why not the guy with the bottom that closes stores. There
seems to be absolutely compassion or even a minute given to write a short note.
Jeez, it baffles my sense of fairness. Everyone is relative attentive to the
community but the button guy. WHY, BUTTON GUY, DO YOU NOT EVER RESPOND?

John P

Standing Ovation 🧍‍♂️ 🧍‍♂️ 🧍‍♂️ for you sir!!!

I posted this same help post in the BrickLink Facebook group and some trolls
think they cause me for tax evasion 🤣. I'm in Canada so how would I know
your government wants you guys to pay taxes on every yard sale item you pick
up?? Lol
And how many years has everyone used BrickLink and even eBay where we never charged
taxes for anything we bought off grandma selling stuff through sites??
But they feel so proud like they caught me. Lmao. One idiot took screen shots
and will send to the irs Lol. Real helpful to me getting admin to open my store
so I can fix these issues.

Can everyone email admin and ask for answers for me and ask them to reopen my
store please? It would mean a lot. And 100 emails might get noticed.

Peace, James

  Good afternoon everyone,

I'm a few orders in as a new seller in this great and resourceful LEGO community
and last night I received an order that raised a red flag for me, so I wanted
to reach out to ask for some guidance and advice on the best procedure to follow
on this.

I did peruse through a few topics in the forums first before posting, but did
not find anything useful. So here is the situation...

The order has an unusual username (ex. one captial letter, followed by three
underscores, and another capital letter)(M___C). They also have zero feedback.
The first and last name on the order reflects the first and last letter of the
username, but when comparing the physical and email addresses between Bricklink
and PayPal, the email address isn't the same. In fact, gmail address is wildly
different.

The Gmail address on PayPal is the buyer's firstname.lastname@gmail.com.
The buyer's Gmail address on Bricklink is... not the first name(dot)some
initial(dot)some initial(dot)not the last name@gmail.com.

How should I proceed from here? Should I email the buyer at both email addresses
to verify? Or contact Bricklink Support / PayPal Support to look into it? I would
be grateful for any thoughts or guidance on the topic.

Sincerely,
Julian Evenfeather

Happy building!

It's not too concerning if the emails don't match. What is important
is that you ONLY ship the order to the address in the PAYPAL account!!! NOT
the Bricklink account if it's different!!

You should also send the buyer an email saying you will be shipping the package
to the buyers PayPal account as per the PP user agreement policy, WITH tracking
number.

Good luck.
James

Thanks everyone for your input... still no word from Admin... but I think I'll
change my terms page.
But do I allow PayPal and USA sales with taxes charged??? Or just stick with
Canada?

This is where your comfort level comes in. You could always try Paypal again
and if you start running into many issue with buyers, you can always turn it
back off again. Either way, hopefully you get your store back and continue your
selling journey.

Thanks. You Americans would love to have my Lego. Lol
