Can I sell a copy of the minecraft mountain cave (21137) that is non lego? I
can make it very clear in description of listing and chop the price if that is
needed. Currently incomplete, but I will complete before selling. It is a naccurate
version, but there are small differences.

Hi, good that you took time to ask.

You are not allowed to sell non Lego brand pieces or sets here on this site,
you would also need to open a store to sell Lego.

However, best of luck selling this elsewhere.

Do not sell on eBay, it's not like its an off brand of building blocks it
is counterfeit of copywrited branding of LEGO & Minecraft. Counterfeits are not
allow on eBay.

You forgot they’d also have to remove all parts that are under copyright, trademarks,
patents and design patents.

If, according to your first message, the set is a copy of a LEGO set and is definitely
recognizable as copying Minecraft’s look, it’s infringing on LEGO’s and Minecraft’s
IPs.

Let’s take a maybe more easy to explain example: If you have a Superman figure
but it has a N instead of of S on its torso, it’s still infringing on DC Comics’
IP for the Superman resemblance, and on LEGO’s IP if it’s a minifigure.
So it’s a counterfeit and it’s illegal to sell, even as second-hand seller, as
it’s also illegal to buy.

The idea of it being a scam is that your are taking someone's money for an
product or service illegally. While the description of the product is techincally
correct, since this is a counterfeit product, in my mind it is a scam.

scam: a dishonest scheme; a fraud.

Now the company that made the set committed fraud, but if the redfoxbuilder is
upfront about it not being lego, it's not dishonest, a scheme, or fraud.
So redfoxbuilder would not be scamming anyone.

But of course there are other illegal aspects as others have pointed out.

You could sell it, just not here and you would need to disclose that it is not
Lego brand. Ebay or local marketplace (craigslist, facebook marketplace) are
your best bet, but still need to disclose. Maybe call it Brick building set.
Some say "Lego compatible" but I think that's still questionable.
