I have found a seller who is selling minifigs as New but then proceeds to label
them as "assembled" (when those figures are not shipped assembled by TLG).
That seems to me to be a violation of policy since an assembled minifigure isn't
New anymore (AFAIK). Where I can report this misleading seller?

That all depends on the person's perspective. What do you consider new compared
to used? Some of our new pieces are sorted into categories and subcategories
up to three times before listed. Are those pieces now used because of the amount
of times they've been handled? A new piece drops on the floor as the bag
is opened, is it now used? Does a piece become used the second it touches human
hands? If I pull the top part of a new lever off from the bottom, are those used
since lego doesn't shipped them like that?

There isn't a fine line between new and used.

I have a few new minifigures labeled like that. I didn't have a good storage
for them a while back, so I'd put them together once to make them easier
to identify and reduce the chance of lost pieces, but I made sure to let people
know in the description. I also had to take a couple pictures of a couple new
minifigures for another site, and as such had to assemble them once. I still
consider the minifigure new, but for pickier customers, I put in the description
that it was assembled to let them know.

As long as the seller is honest in letting people know that it is a brand new
minifigure pulled directly from the bag, was assembled for one reason or another,
but not played with, handled excessively, etc. I don't consider that used.

I wish they were required to say they were assembled, but the rules do allow
it to be assembled once and left assembled and still be new. When I assemble
one just for a catalog pic, I sell it as new and say so in the comments.

The rule does not say this. It is:

New Minifigs - Minifigs are brand new, taken directly from new sets or were purchased
"as new" in another form such as accessory packs or Pick A Brick and have been
handled only for sorting. Minifigs may be listed as new either assembled or
unassembled.


There is no clarification in the rule as to whether the minifigure can be assembled
only by LEGO or also by the seller. Some people even go as far as saying a minifigure
that is not assembled is not a minifigure, it is a collection of parts.

Personally, I'd prefer new to mean unassembled, or if assembled that a seller
should state this, but there is nothing in the rules that stops them listing
an assembled minifigure as new. In most cases when buying for personal use it
doesn't really matter, but where capes are concerned it does. Of course,
if buying to sell the parts, it does matter.

As in the definition of parts condition:
New Parts - Parts are brand new, taken directly from new sets or were purchased
"as new" in another form such as accessory packs or Pick A Brick and have been
handled only for sorting. These parts have never been used in any manner. If
a minifig is originally sold assembled by LEGO, its component parts after disassembly
can also be listed as new.


it is clear that an assembled minifigure can only be disassembled and the parts
called new if it was originally assembled by LEGO.

So if you want new parts and buy a new minifigure to get them, it is best to
make sure that the seller does not assemble them first.

The seller appears to be acting in a way permitted by the listing policy for
minifigs.

There is only one definition for "new" in Bricklink, and that is as defined by
the listing policy. Everything else is someone's opinion or preference.

I can understand that some prefer to assemble the minifig themselves. In that
case they should check with the seller to ensure that they are not disappointed.
