So getting back to the subject of the post, if you don't mind that is
What should be the guidelines or parameters for what is "official"
LEGO here on BL?

The simplest rule would be items from official sets. Then other items as custom
items on a case by case basis as BL sees fit, which is pretty much what it is
now.

Not that that would necessarily stop stolen, nightshift or similar items. If
illegitimate copies of (expensive) production parts are made, who is to know
of the origin? The only reason some parts stand out is that they are not known
in sets. Only allowing items that have appeared in sets could just shift what
is made by bootleggers. Although a lot of that bootleg jellybean type minifigure
trade still exists on ebay and facebok for the "rare", "prototype"
parts or whatever other description they want to use.

  Cutting back towards the point: These items were produced on an official LEGO
injection molding machine by a LEGO affiliated employee. Would these unique items
hypothetically then be allowed into the BL catalog? I say hypothetically, as
we no longer have the parts. Tossed them long ago, actually

Into the catalogue? Definitely not. There are many parts made by machines owned
by LEGO and sold by LEGO that should not be in the catalogue. For example, LEGO
Discovery Centres used to have engraving machines where they would engrave your
name or a word on a brick. They might still do it, it's been a long time
since I went. They own the machine, they sell the part. There would be unlimited
catalogue entries if they were allowed. Same with the new torso printing machines.

As to whether they should be allowed to be sold as customs, that is another issue.
However, if something was made on a LEGO owned machine, how can you tell? If
those are allowed as customs, they'd have to allow parts engraved or printed
on other machines, as they wouldn't be able to tell them apart. And then
they could end up allowing the sale of IPs they don't have the license for.
As for undecorated but custom parts, is there really a difference? If they are
custom ordered, made on demand, then there is little difference.

  Now to the point: What does actually qualify as "officially" LEGO
and therefore allowed to be sold here?
Maybe more definitive guidelines would
be useful to all of within the secondary marketplace?

  The part has been retired for 30 years. This is 99.9% sure just a test part that
escaped the factory.


"Escaping the factory" is not the same as legitimate routes such as from
a PAB wall.

It is old. It might have happened a long time ago. But if LEGO wants to stop
illegitimate pieces from being produced and stolen now, they have to put a stop
to all pieces like that. Otherwise, in 30 years time, those new illegitimate
Vader helmets all become fair game to list as they are old and it happened a
long time ago.

I believe a lot of Warm Yellowish Orange parts were recently released at the
Florida LEGOLAND PAB? They definitely were never released in anything else, and
they were most likely old product from the model shop that had been sitting around
for almost 20 years. There have been lots of legitimate ways over the course
of LEGO history to obtain many rare and unique items.

Yes from individual LEGOLAND centres (I also mentioned them earlier) but not

Parts like that are officially released, same with all the BAM exclusive parts.
They are not in retail sets, but they are widely available and catalogued here
as existing. Hence there is no issue with them being listed compared to the illegitimate
parts.

It looks more like a mistake when leaving feedback than a misunderstanding to
me. If they misunderstood what they were doing then why leave lots of positives

Items Pending Official Release: Items may not be listed prior to their official
LEGO release date, either as custom lots or under related catalog entries.


These items have not been officially released, so these items are listed before
the official release date. Of course there might be no release date, especially
for night-shift parts, or there might not be a known official release date but
that doesn't mean that date would never happen so they are still listed prior
to an official release.

It would be interesting to know which part it was as the OP states they were
obtainable from a PAB wall, so this suggests it was already in an official store
and so would not be a night-shift type part.

An invoice from PAB with a line 'prototype part'?

Can someone give an actual example of proof of purchase that would be accepted
by BL?

If bought from online PAB, then the paper invoice they send has all parts listed.
If instore PAB, maybe a photo of the PAB tower, although the majority of parts
I have ever seen on a PAB wall have already been common parts. Whereas online
PAB has had parts that were not (yet) released in the past.

It is more likely that they would be from one of the German warehouse type stores
or LEGOLAND builder stock than from PAB.

The lighting is bad, but they look like they could be nougat hands and medium
nougat arms or light nougat hands and nougat or medium nougat arms. It is a good
idea to photograph and compare them to something where you know the colours are
correct.

They have removed parts that are not in official (retail set) colours, especially
minifigure parts, where they have been made by "night shift" workers
that then steal and sell them. I imagine that possibly legitimate parts have
been caught up in this.

If they buyer did not answer you, you could still reply to his feedback something
like: "reached out to resolve if there was any issue but the buyer didn't
reply"

The issue was "good prices". Anyone that cares enough to look into feedback
scores can see that the buyer that left the neutral feedback was an idiot.

Correct, and I accept returns. But as I offer an alternative solution, return
shipping costs would be on the account of the buyer. That's at least how
I see it. Would you agree in this situation?

If the item is damaged, the buyer should not pay for the return. Whereas if it
is change of mind, they should pay for it as long as you have made it clear in
your terms that the buyer pays for unwanted item returns.

I also wouldn't want to have to switch out arms in an old torso as a buyer
of it. If the buyer says the torso cracked when switching the arm, then you should
also then have to replace that. You could send them a replacement torso and ask
them to ship the one with the cracked arm back to you (at your expense) if you
wanted to switch the arm out yourself.

I know but 3 NSS and you are suspended until it is resolved. Then you submit
proof and how long do you have to wait? One guy was waiting 3 weeks to reopen.
If they all did an NSS the bad stores would be gone more often.

I don't know how long you have to wait. I know we get reports here of people
waiting multiple weeks, but I don't know how common that is. Similarly I
don't know how many buyers go on to complete a NSS after they start one,
especially when there is evidence a parcel was delivered or money has been refunded.

though. I see people with the worst feedback where they didn't send all the
parts and it only takes 3 people to make the right claim for them to be suspended.

shipped minifigs with the wrong colored parts. I've lost a total of $65
over these two orders - both of which were gifts for my son. There's no
buyer support and no protection from scammers. This last guy had 12 complaints
in the last year for the same issues and Bricklink is doing NOTHING about it.
The guy is a jerk and I'm out the money. Anyone else having this trouble?

Bricklink does support buyers in that it bans sellers if they have performance
issues reported and completed in the correct way by buyers. PayPal will refund
you if you make a complaint to them, as they are the one that deals with the
finance side (if you paid that way).

Bricklink also supports buyers through publishing feedback from previous customers.
If a seller obtains lots of negative feedback for issues before you buy, then
you are warned about it if you look at the feedback. The seller you bought from
had already received quite a bit of negative feedback before your order was placed
and would have had a low percentage rating. Did you look at it before you bought?

The old macaroni bricks could be used staggered, so that might work, but it would
be rather large, much bigger than minifigure scale.

Not really. At the very least they should be listed as incomplete sets, as they
are not complete if they are missing the original stickers. Personally, I think
the replica stickers should be removed so as not to cause confusion later on.

I think third party direct copy replacements for official LEGO parts to be problematic.
You know they are not original and you may say this when you sell them, but when
the next person comes to sell them, they might not have realised when they bought
it or they find it years later and sell it as having the original stickers, when
in reality they have replica or fake parts (as in copies of the genuine LEGO
items masquerading as the originals). In that sense, I find custom created items
that are different to genuine LEGO products less a problem, as they are not pretending
to be something that they are not and there should not be confusion as to whether
they are genuine.

You have to refund the PayPal payment and ask the buyer to pay again using the

Isn't there an option to cancel the order when the NSS is completed?

It is more abut the bank here. They cannot tell whether an order is cancelled
on BL or not. However, if they are asking if it is cancelled, the buyer giving
a seller notice that they want to cancel (and the order has not been sent) then
it should be enough for the bank.

Did you pay by bank transfer through PayPal, or direct from your bank?

If from your bank, I'd email the seller saying you want the order cancelled.

Seems to me anyway, that simply restricting zero feedback members the use of

The spam posts tend to get removed really quite fast, at least at the times of
day when I see them (and report them). Links only work if people click on them.
If nobody clicks on them then there is no motivation to post more. Yet still
they post and post.

PaB part cost to manufacture, 5 cents, sells for 10 cents that is 5 cent profit.
Where a seller sells that part at 10 cents TLG makes 2 cents (from a major seller).

Sure you can say but TLG has overhead, where? They are already manufacturing,
storing, sorting for sets and PaB so no additional overhead.

TLG has a global foot print, way more than any seller has on here along with
better shipping rate options.

Sure they could try to capture more of the market for inividual new parts, but
at what long term cost? They cannot keep up with PAB standard as it is. PAB best
seller is OK for speed but that s relatively small inventory.

If they aim to kill small businesses selling on bricklink then there is little
point in owning bricklink. Longer term,it would be worse for sellers and buyers.

Why would LEGO care whether any third-party stores (i.e. competitors of LEGO's
PaB website) close down?

Also, third-party stores would still be indispensable, because there are so many
parts that are unavailable from the PaB website.

When taking over bricklink, LEGO claimed they wouldn't interfere with the
marketplace, implying they wouldn't compete with sellers. If they want to
compete with sellers, then many sellers will leave and move to the independent
marketplace.

They would also need to behave like other BL sellers. I'd leave them negative
feedback unless they improved their order turn around times.

One feature that might be helpful here is the ability to pre-pay fees.

It might cause issues with paying in the wrong financial year. If you pay a lot
in one year, then ask for a refund the next.

For anyone using the site frequently, maybe just a different coloured notice
on a screen if you have fees due that disappears when you pay.

Doesn't the banner go red if you are a month late? I know I missed making
a payment a few years ago when ill, and I'm sure the banner went red after
a month but before the final deadline which i noticed and paid so I didn't
get a suspension. Lesson learned, and I tend to pay on receipt.

I thought you could set up a fail safe international method with a minimum.
If it doesn't allow you to buy, then there's no shipping method, then
the buyer won't be able to buy.

I'm not sure, never tried, no minimum or such here, but it seems logical
to me?

I don't know now, maybe possible you can. I don't ship internationally
any more to try.

But whatever they do, the default shipping if everything else fails should have
the international shipping destinations turned off.

It often happens with highly specialised designs and it can be a problem if you
have to know what you have to be able to search for it. But how would you describe
these parts to make them searchable? There will be a lot of parts with a description
like "with dark bluish grey lines".

I find Google lens is now quicker and more reliable than searching by words.

It is a bit strange. They are a member for 5 months and don't buy anything
in that time. Then ask for feedback and get told they need to buy something.
I would have thought they'd pick a cheap item with domestic postage to keep
costs down and have fast feedback tyrnaround, but instead go for an international
seller. They also contact to ask about feedback rather than just buying. And
coincidentally the seller they pick is a forum user.

If you reply, make it clear what the postage costs are, in case they don't
realise this is an international site.

For some years now, whenever I add a sticker to my Inventory I set Package Type
manually to Weight, and then when someone change it to Volume Bound it changes
my initial setting.

It shouldn't, should it?


I agree. If you manually override something, someone changing it in the catalogue
should not change your manual setting.

Yes, you will naturally build up spares. It is annoying when you need just a
few cheap parts, so overbuying parts you are likely to need in future is a good
idea.

All my orders ship in a box.

I set all my stickers' package type to Weight and that works for me.

When someone changes it to Volume Band (without dimensions) it disables Instant
Checkout, which is annoying.

I'm not sure why someone would that? It should be at store's discretion,
right?

Volume bound for any parts with large dimensions makes sense to me, and it should
probably be consistent. Individual items are always at the store's discretion
as you can set them manually to weight or volume bound. Of course, if the dimensions
are entered then the IC issue goes away.

Instead of parting out 4 copies of set 10291-1, are you changing the numbers

It shouldn't happen but it does.

Something else you can do, especially if the parts are cheap, is double up by
ordering the same parts from other sellers if you are already buying parts from
them. It helps avoid missing lot problems and gives you spares if some (used)
parts are not up to quality or if you drop any.

And if you are not in a hurry, space the orders a day or two apart. If one seller
has an issue, there are still others on your list that could provide parts to
make up for other sellers errors.

How did you pay through stripe, as bank transfer refunds can be a few days, back

I don't think I had one. My childhood LEGO was second hand, we had a bucket
full of it. But no sets, instructions, or boxes. Maybe that is why I have always
enjoyed building MOCs.

There is a reason sellers might want to set an order to complete.

If you want to delete an old shipping method, you cannot if there is an open
order using that method

There's also NO reason to immediately delete a shipping method.

Simply disable it and forget it, delete it later on - it won't be shown in
your shop while disabled.

In short, there is still no reason a seller would set Completed an order

Sure there are work arounds to solve a problem. But if a seller wants to remove
a method, they cannot and are warned it is because there are open orders (even
if they are filed). Hence they can be tempted to complete ones that are already
months old.

There is also the issue that store wide minimum orders take into account any
disabled methods. So if you have multiple redundant methods that are disabled
you still have to edit every one of them if you want to raise the store minimum,
even though they cannot be used by a buyer. Of course, this is not the buyer's
fault (or care), just dodgy programming blocking changes.

It also seems strange that you cannot delete a shipping method while an order
is open, but you can change all the variable parameters in that method.

Personally, I think it is better to use the existing tools, such as using a minimum
lot value or maximum number of lots as these are displayed in the store. Using
more hidden fees that are only seen when viewing the final cart cost or after
placing an order are likely to make a buyer leave the store or cancel the order.

There is no way a seller can block zero feedback buyers, so some sellers just
cancel orders. You can leave feedback if you like, but you will get a negative
back. For you, that could be serious, as it is possible to block buyers with
negative feedback and that will mean you cannot buy form significantly more sellers
that have this option turned on.

So long as you got a refund, I'd leave it. Least favourite the store though,
and don't return to it in future. Or alternatively, place an order with someone
else and get feedback, then return to the first seller asking if you are worthy
enough now.

There is no chance for licensed themes to be done without the IP holder's
agreement.

I cannot see LEGO banning someone selling on bricklink for using a small number
of bags with 100 parts in each, when this is how LEGO sells its products. Especially
now they are trying to cut down on plastic waste, banning someone that is trying
to be more environmentally conscious is very unlikely.

There are no limits. It is up to potential buyers to look at feedback and decide
for themselves.

could support their favorite content creators and not have acess to their adress,
friends that are not on the adress sharing level can also do that, members of
family can have a way easier time finding something you actually want without
the hassle of looking for it and packing and sending it. It would be a really
fun idea all around imo with a lot of ways to surprise someone.

Voted no, because of the idea of supporting content creators. This would be abused
from both sides. The buyer has no idea if the seller sends the item. Similarly,
there is no eller protection as the buyer asks for it to be sent to a different
address to their payment address.

LEGO cannot be seen to be making money from intellectual property that they have
no agreement to use. If they allow instructions to be available for designs based

But not all sellers do. So if some parts are especially important to the buyer
then indicating this makes sure the seller is aware of it.

It is not always as simple as they need / want all the parts in the order. I
just placed an order with a store, I only need about half the items I ordered.
The other parts are cheap enough, so I'll buy them even though I don't
need them right now. But I wouldn't place the order just for those extra
parts.

Frankly, as a LEGO New parts seller I'm very concerned, that'll make
things sooo complicated, to say the least

  refuses to accept PayPal because "the British" always complain about
his orders.

If every British person that buys from him complains, then chances are he sends
poor quality parts.

Can't you just file a cancellation request, if he refuses then report for
not allowing paypal even though it is offered. Asking for IBAN when offering
paypal is no different to offering PayPal then demanding friends and family.

Yes, I was serious. If the buyer is having the same issue with multiple orders,
it makes sense to ask sellers not to ship if they cannot fulfill the whole order
or the important parts.

  EU consumer law as with any laws around the world, is the province of the people
and their respective nations. EU law is not binding elsewhere if not otherwise
accepted elsewhere. Iow, we here live by the laws created by the representatives
we elect to do just that, and not by the laws other people of the world create
for themselves. Put another way, it's not binding nor enforceable elsewhere.

But now back down to Earth for me There is compliance with law (money returned
as the seller did) and then there are the TOS for the adherence of the entire
membership. Othewise, it just doesn't work. Strikes for behavior on a membership
site, have little to do with the satisfying of any law, as I see it.

Happy to be proven wrong and learn. Sure this is eye-opening for others too

I think the direction of travel is actually the opposite. We have seen it with
GDPR laws, tax laws, the German packaging law. That is, if an American seller
wants to sell in the EU (and by advertising to the EU, that is what they are
doing), then they should abide by EU consumer laws. If they don't want the
transaction to be covered by EU consumer laws, then don't sell to te EU.
This is pretty much what happened in the early days of GDPR, even relatively
minor things like cookie tracking for advertising. Many US (and elsewhere) based
sites blocked access to EU viewers as they were not GDPR compliant at the time
and it was easier to block users than resolve the issue quickly. It wouldn't
surprise me if the same happens with consumer laws, that if a US company wants
to access customers in the EU then they have to comply with EU consumer law.
They have the option to not advertise to EU customers. This doesn't always
help the buyer, of course. Quite a few ebay sellers stopped shipping to Germany
due to the packaging law registration costs. Of course, if the German consumer
chooses instead to pretend to not be in the EU, using a VPN forwebsite access
or a US reshipper for their delivery address, then that is (presumably) different.

There are of course other barriers to returns. I buy a fair bit of hobby electronics
from China. If I decided to return a cheap product, the cost for me to return
it is likely to be more than the cost of the product. So the business can easily
comply by saying the consumer can return at their expense but are unlikely to
have to deal with returns.

Seller misused the NPB here as payment was made.
So BL did the only right thing here: remove the NPB as it was incorrectly used
by the seller.

Yes, and if a seller says they will NPB a buyer for not paying, the buyer just
needs to pay then cancel to avoid the NPB.

  What could be argued is that BL parts orders are “goods made to order or clearly
personalised.”  Those are exempt from the “cooling-off” period.

It used to be that lego.com PAB orders were not returnable. They have changed
their rules so that they are now returnable so long as the whole PAB order is
returned. So if LEGO have relented on their 'no PAB returns' line, presumably
there is some legal reason behind it.

It can happen when a once relatively hard to find part suddenly becomes more
common as it is in a new set. There is often a lag for prices to stabilise especially
if people using wants lists don't care if they overpay a little to get it
all in one order.

There is a downside to this though. If an EU (or UK) buyer wants to cancel an
order and not receive an NPB, then it is better to pay, then invoke their right
of return once it is sent (or just once paid) and then post about it in the forum.
It is especially hard on the the seller if they don’t indicate who pays for return
costs.

please understand that as a consumer you have extensive rights in europe.

if you do not like the quality of the goods, you can return them to the retailer
for any reason. this is normal day-to-day business in europe.

but sometimes there are dealers who do not like this. the only thing i want to
discuss here is the "Non-Paying Buyer Alert system" has been abused by
the dealer and what i can do about it and this is a problem for all buyers from
Europe if they buy from European dealers.

It has not been abused. Tge seller refunded you according to the law. However
your right to cancel is totally different to the right for a seller or marketplace
to refuse service and stop you buying if you place many orders and keep returning
them, even though you are entitled to return them.
