Be aware that not all sellers here will charge VAT, or be able supply a VAT invoice.

It only shows if the list is not empty.
So if you filed your latest orders (and ‘filed’ are filtered out by default)
or haven’t ordered for 6 months, it’s not there 🤦

| Hello,
I’ve purchased an order from overseas and had it shipped to Australia. My total
order value including shipping fees was below $1000AUD. Therefore I have paid
10% GST to Bricklink as per Bricklink’s terms.
My package was held in customs after they inform me the order had a declared
value of over $1100AUD (more than $200AUD over the actual value I paid). Customs
has sent me a bill of over $200AUD for GST and duties fees as a result. I have
sent customs my invoice and proof of purchase to verify my order was under $1000AUD
and they have verified that there was an error and have refunded the GST fees.
However they are saying that a $115AUD duties fee is non-refundable as that was
charged for the inspection process. This fee would not be attracted if the order
was correctly valued at the amount I paid for it.
The seller is claiming they’ve followed all processes correctly and attached
the necessary forms. They have said that Bricklink has automatically generated
the invoice on their end that shows the order value of over $1100AUD. So it appears
there is an error with Bricklink’s generated invoice system, as the invoice I
have as the buyer was completely different in value to the seller’s invoice.
Bricklink have not responded to any of my requests for assistance.
What is the best course of action for me? Has anyone else in Australia had a
similar experience and how was it resolved?

| so bricklink calculates everything including added fees (postage, paypal, etc..)
is that right? (I didn't read anywhere in the help that it would only be
the price for the goods) So I will also count everything the same as last year,

The €10k threshold replaces the previous by-country thresholds for non-domestic
sales, so it works the same way, and that’s the same way as domestic sales: it’s
your total sales.
BrickLink and PayPal fees are parts of your costs, exactly like buying the LEGO
you sell. You don’t remove your costs from your sales when you consider your
total sales.
Postage is a cost too. There’s rare cases where it can be excluded but they
don’t apply on BL.

That threshold is for intra-EU sales excluding domestic. So all of EU but Spain.
Otherwise, each EU country has its own thresholds and procedures and statuses.
The domestic VAT threshold can go from €0 to €90,800. AFAICT, Spain’s threshold
is €0. So every professional should get a VAT number in Spain.

life. My advise is to learn Spanish (Castilian) well, make the effort. Having
command of the native language is fundamental in opening prospects in your new

was in France and in University as well. So I'm still pretty good at reading
it. But I lost the "talk" so I'll definitely get some classes for
that.

Good idea.
First place I landed abroad, I was required to take a submersive language/culture
course, 5 days a week/8 hours a day. Felt like brainwashing, in that I literally
could not stop processing (turn off) the language or absorption of my surroundings
vis-à-vis advertising, etc. that I was surrounded by on the subway home or elsewhere
on the town. Crazy stuff... But it did definitely paid off for me, being immersed
so completely into the culture so quickly.

When moving to a different country be aware that you'll need to keep everything
you bring into the new country for at least a year otherwise you'll have
to pay a bunch of extra taxes & fees.

Yeah I moved from Ireland to Canada last year
|
How has the first year been?
|
Its been great so far, met a bunch of new people, saw a bunch of animals that
I only saw in a zoo before (and some that I've never seen in real life before)
and its so easy to go to a national park and leave the city behind for a few
hours.

I take it you like nature
I think where I live we have to much of it!
E.g. Bears breaking into peoples houses. A few years ago one ripped the door
off our shed!

When moving to a different country be aware that you'll need to keep everything
you bring into the new country for at least a year otherwise you'll have
to pay a bunch of extra taxes & fees.
Other than that you will have to register for VAT if you think you will earn
more than 10.000 Euro (not 100% sure on the number) in 12 consecutive months.

How has the first year been?

Its been great so far, met a bunch of new people, saw a bunch of animals that
I only saw in a zoo before (and some that I've never seen in real life before)
and its so easy to go to a national park and leave the city behind for a few
hours.

Oh yeah we love it here . Its so easy to see wildlife everywhere, lots of national
parks that are easy accessible. Also I'm earning more than I did in Belgium
and have to pay less taxes here
There are some downsides though, you need a car to do basically anything, almost
all stores/ restaurants are chains and groceries are pretty expensive.
There are a few things we didn't expect:
- The amount of wildfires that happen
- the size of the country (My home country Belgium literally fits between Edmonton
& Calgary)
- Seeing a Tornado in Alberta

to pay a bunch of extra taxes & fees.
Other than that you will have to register for VAT if you think you will earn
more than 10.000 Euro (not 100% sure on the number) in 12 consecutive months.

Yeah I moved from Ireland to Canada last year and I still haven't reopened
my store either.
I highly recommend to get a moving company that does international moves, they'll
handle everything, there is a lot of paperwork involved. I think the container
took about six weeks to arrive if I remember correctly (Moved from Ireland to
Canada Last year)
When you have settled and ready to reopen your store I would suggest to find
an accountant that can help you set everything up tax wise.

That threshold is for intra-EU sales excluding domestic. So all of EU but Spain.
Otherwise, each EU country has its own thresholds and procedures and statuses.
The domestic VAT threshold can go from €0 to €90,800. AFAICT, Spain’s threshold
is €0. So every professional should get a VAT number in Spain.

Unless you’ve a batmobile, a helicopter should be more than twice as fast as
a car, so I get you mean it’s 40min for the helicopter to reach you and 40min
more to get you to the hospital?

That's about it.
The drive is over 250km.

robbed of their phones when walking in an underpass at like 2 in the morning

Unless you’ve a batmobile, a helicopter should be more than twice as fast as
a car, so I get you mean it’s 40min for the helicopter to reach you and 40min
more to get you to the hospital?
Isn’t there a doctor in the helo?
Or is it the “find a wounded, transport a severe case, register a death at the
hospital” method?

BL doesn't collect GST/HST/etc. for Canada. The buyer would have paid when
he or she received it, there's nothing at all you need to do about it.

Thanks for the info! I guess this whole thing about possibly exceeding tax thresholds
and having to register for tax collection in multiple countries had me scared
a bit when I first saw it written in red letter on my Stripe tax page a couple
months ago, but false alarm all along lol.

BrickLink automatically collects VAT on Import (ex: USA) to EU for orders of
less than 150€ - with some exceptions, like pros.
In all cases, if BrickLink doesn't collect it, you simply declare the value
(CN 23) and the buyer will have to pay locally for taxes.
In short, nothing which matters the USA (for ex) seller. You don't have to
register or do anything on your side.

1001bricks, thanks for the confirmation on that! I think I'll open my store
back up to international + EU customers again pretty soon. I've never had
any issues with shipping overseas but just wanted to make sure I wasn't missing
anything from a tax collection standpoint. It's kind of fun shipping LEGO
around the world instead of just within the US.
I wonder if anyone has any insight/confirmation on if my order to Manitoba also
had all the appropriate taxes sufficiently collected (leaving nothing for me
to have do on my end from a tax collection + registration standpoint). I'd
assume so...

| Sorry for the lengthy post here, but I didn’t want to leave much out.
I'm based in the US, but I previously had my store set to sell to 21 countries.
I recently ran across something on Stripe relating to registering for tax collection
on some of my foreign orders that exceeded tax thresholds in 6 different EU countries
as well as Manitoba in Canada. I’m just curious if any of you Stripe sellers
have run across a similar thing.
On the BrickLink page about VAT instructions, it says "If your business on
BrickLink sells goods in any European Union country or Northern Ireland (“EU”),
you may be required to register for and collect Value Added Tax (VAT). Most EU
countries allow you to register for VAT online, through the local tax authority’s
website."
However, I am also aware of the following info from BrickLink:
For orders where the item total value is less than or equal to €150, BrickLink
will collect VAT from buyers on orders shipping into the EU that are dispatched
from outside the EU.
For orders over €150 imported to their EU Member State, the buyer will pay VAT
at delivery to customs/carrier.
I don’t think I need to set up tax registrations in the EU countries that I sell
to but not really sure about Manitoba since I don’t see what taxes were collected
on that order. I wasn’t sure if taxes were already sufficiently collected on
it. Do any other US or Stripe sellers have experience or insight in this matter
regarding the EU or Manitoba?
I contacted Stripe customer service and was told "After carefully checking
the information you provided me, I was able to see that your customers are already
paying VAT taxes. In this case, if you add a tax registration on your account,
it will charge taxes since it's from Stripe."
and
"If you are already managing taxes with another platform or with a third
party, it is recommended that you continue with them and do not activate Stripe's
taxes. It would charge double tax since they are separate entities."
and
"Since the VAT that your customers paid is being collected by BrickLink,
I recommend you to contact with them directly and share your query with them".
-- I actually did reach out to BrickLink 2 months ago for confirmation on
this matter but never heard back. That’s why I’m asking here in the forum 😊
Anyway, since BrickLink is collecting the VAT from buyers on orders where the
item total value is less than or equal to €150, and for orders over €150 imported
to their EU Member State, the buyer pays VAT at delivery to customs/carrier,
I just want to see if I actually need to do any registrations in those countries.
I’m pretty sure the answer is no based on the info I’ve collected, but it’s always
nice to check with others who have already managed a similar situation. As for
Manitoba, I’m unsure about if taxes were sufficiently collected on that order
and if I need to register for tax collection on the Stripe site.
I temporarily disabled int'l shipping just to be safe while I get this figured
out.

I know this varies by state, but in Florida, retail stores do not have to accept
a Resale Certificate - therefore they charge sales tax.
|
Additionally there are steps you can take (at least in my State) to try and get
a refund for sales tax on items bought for resale. I've not actually tried
it so I'm not certain if it actually works, but the option is there.

Marketplaces (Ebay, BrickLink, etc) are required to collect STATE sales tax based
on the destination. In your case you are paying Minnesota Sales Tax.

So point is those with a sales tax number should not have to pay taxes anywhere.
As stated before Bricklink is suppose to fix this. They have not. So my question
was why do some international people have the option to give their VAT number
and not pay taxes and the rest of us can't.
