I have two orders from France (June 30), 21% Netherlands VAT is calculated instead
of France VAT 20%. It was still correct with June 28 orders.

correct at June 28

Am I the only seller having these problems, or did I miss something?
I really hope it will be set back the way it was, otherwise I have to work nights
as well.

Nothing has been changed in my settings.

I also noticed that a lot of German Sellers show 19% VAT in their store, while
I know some of them had 21% for Dutch Buyers.

If you go to my store, do you see 20% or 21% on the top of the page?

I can confirm this error too, I also received an order from a Polish customer
(23% VAT) on Jun 30 which had no VAT included.

When I click on Edit Order there is no option to turn on/off VAT like usual.

My distance selling option is also turned on, I haven't touched it since
the beginning.

I wonder if this is related to the implementation of marketplace laws for Canada
that should have started today (1. if I’m not mistaken; 2. I’m talking about
the laws: I don’t know about the implementation as I’m not in Canada and there’s
been no detailled announcement).

Vat there is 22% and displayed correctly.

In your store I don't see that you have VAT activated, I think you couldn't
use OSS if you don't put your VAT number and activate it firsty

I added my VAT (OSS) number for the distance selling option months ago, it worked
fine until yesterday.

My VAT ID is not shown since I'm VAT-exempt in Austria so I haven't activated
domestic VAT yet but that's a different story.

Problem started June 29
you can also see the problem if you have orders from the Netherlands with 21%
VAT
The order data should show Netherlands VAT (21%), but it probably shows Spain

No problems so far with orders from outside EU or domestic orders.

As far as I can see, it's only the EU distance selling VAT.

No problems so far with orders from outside EU or domestic orders.
Also received UK VAT Invoice.

Hope it wasn't caused by a treshold check, because once a seller is registered
for OSS, they're stuck for years. And you can always register, also when
you don't pass the treshold. So I hope Bricklink will never change this,
unless it's seller's choice.

today I have got an order from Italy, but BL calculates 22% VAT on goods, but
19% (German) VAT on shipping. This is wrong! Shipping must have the same VAT
rate!
In my shipping settings I have net amount EUR 7.00, BL says it is EUR 8.33 incl.
Italian VAT, but it should be EUR 8.54.

Please correct this too!

This is not new it is how BL implemented the system.

It takes your store prices that include your local VAT 19% and shows the same
for your buyers even if they are VAT 22%.

In the case of shipping it is the same, it gets your shipping price and adds
your store VAT 19% but if a buyer from another country purchases it just uses
your store price as if it was inclusive of the 22% VAT.

To prevent this you could make different shipping methods for each group of countries
with the same VAT rate and put your base shipping price making this calculation
in reverse. And additionally you can add a % fee of the total order from -2 to
+8 to adjust the final price of the order to correlate with the VAT rate difference.

  This is not new it is how BL implemented the system.

It takes your store prices that include your local VAT 19% and shows the same
for your buyers even if they are VAT 22%.

In the case of shipping it is the same, it gets your shipping price and adds
your store VAT 19% but if a buyer from another country purchases it just uses
your store price as if it was inclusive of the 22% VAT.

IIR&UC, they said they do it that way because they can’t do it the other way
now with the old site, so they may change how it works in the new version.

Taxes are patches over patches over patches… because no one ever thought BL would
have to handle complicated tax rules and certainly not that BL would have to
collect them.

I understand this but taxes are NOW and the new version is... whenever.

So in short, that means if I can't manage 600 Shipping Methods, or BrickLink
cannot manage to have a Settings page or Terms page with 600 Shipping Methods,
the prices will be kind of random, what's displayed on the Order will be
inexact (shipping price), etc?

way: same tax-included price for everyone (in EU) & different net prices.

What about B2B, he'll see an even different price? The Danish buyer above

You have an item in your inventory for 10€, as you have VAT enabled it means
for you 20% VAT in France is included (8,33 + 1,66).

A Danish buyer goes to your store and buys that item, in the order it says 10€,
but it is VAT 25% inclusive (8 + 2).

If that Danish buyer is a business and asks you to disable the VAT on their order
the amount will change to just 8€.

So you lost 4% of your revenue. (On top of other fees, Bricklink 3%, PayPal 2,9%
to 4,9% +0,35 / Stripe 1,4 to 2,9 + 0,25%, Shipping carries combustible/covid
surcharges... 12%)

And that VAT is to be paid quarterly not deductible with national purchases,
so you probably end requesting VAT returns if you sell more outside than inside
your country, and that may inquire audits... So much fun

As a Seller, I cannot set a price.
Because the price depends the VAT that'll be applied, and I cannot know.

It's like a black box, it's illegal in accounting.

So BrickLink will say "Just don't sell to Europe".

Faire enough - but this is ULTRA ENORMOUSLY deceiving from BrickLink and LEGO.

I'm 11110000% upset right now.

Hmm, I don’t see why it should be in the ToS, but let’s look at the Help pages:

Yeah, a lot of stuff in the new pages… but nothing really clear on how this is
all calculated .
On the other hand, the old VAT page (2137) is simple:
“If you turned on the VAT setting, your base prices must include VAT.”

The new pages say the VAT rate depends on the situation (locations, VAT-registration,
amount).
They indeed don’t say that it’s the net price that varies… but they also never
say the mechanism has changed and that, when needed, the seller’s VAT is now
removed so that the buyer’s VAT can be used instead.

I just mean that, technically, the pages are correct.  But it’s indeed not really
well explained.

are set up Net, without VAT.

But this it not the case for GERMAN sellers:
In GERMANY shipping costs are also including VAT by law (USTG).
I don't know, how it is in other EU countries. But if not, one may use Order
Edit (orderEdit.asp) to REMOVE VAT from shipping costs and additional charges
as well (deselect the checkbox!).

No no - I meant that when you set up the shipping prices in Shipping Method,
it's WITHOUT VAT.

Then BL adds the VAT.
It's the same for all shops/countries with VAT I guess.

An update on this issue:

- We released a backend update this Wednesday which affected the EU Distant Selling
logic.

- Before the update, if a seller registered their OSS number in their store settings,
it was applied right away. But with the new logic, it required approval from
our admin team. 

- This caused different behavior for EU distant selling for the sellers who had
previously registered their OSS number.

- We will handle the admin approval process ASAP.

- Meanwhile, we will update all orders affected by this behavior change to the
correct VAT rate (buyer rate).

- The system is currently updating to the correct VAT rate. The total order value
should not be affected by this behavior change and should remain same.

- Please let us know if you have a case where the total order value should change.

- Once updated by the system, you can see the correct VAT rate in the order detail
page.

It looks great!
Although I can't see if my own store shows buyer's VAT rate now, I see
some German stores with 21% Netherlands VAT. My previous EU orders are changed
(have buyer's VAT % now and total order value is not changed).
