with the gst/hst tax holiday in a few weeks do any other Canadian sellers know
if this would apply to bricklink stores? for example, I see this

https://torontosun.com/news/national/which-items-will-be-tax-free-under-gst-hst-break#:~:text=dolls%2C%20card%20games%2C-,Lego,-%2C%20Plasticine%20and%20teddy

news article which mentioned Lego by name but would that apply to individual
bricks? Just curious what any other Canadian Sellers think.

and a link to the official Canada Website

https://www.canada.ca/en/department-finance/news/2024/11/more-money-in-your-pocket-a-tax-break-for-all-canadians.html#:~:text=building%20blocks%2C%20such%20as%20Lego

but its still unclear as it says things like

"Select children’s toys: a product that is designed for use by children under
14 years of age in learning or play and that is:"

however with a basic reading that sounds like more so for sets and not individual
bricks. also it says "under 14" so it wouldn't apply to say the Bricklink
Designer program sets as they are all printed on the box as 18+ sets

It just hit me earlier that LEGO Canada will already be needing to get this guidance
themselves in regards to the 14+ statement with sets, and for the sale of individual
bricks. I reached out to BL help desk (case #08307998) asking if they may contact
someone from LEGO Canada to get their guidance before Dec 14th as it impacts
both sellers and buyers.

Good idea for reaching out! If your willing, would you perhaps be able to share
the results you receive via the forum?

I believe it will still apply but plan to contact CRA prior to Dec 14th to confirm.

Bribes for you know what next year

Nice idea, but I don't charge the tax already, I just pay out of pocket as
my sales are mostly low cost items.

What do you mean by that? You shouldn’t be collecting or remitting sales tax
at all (unless you registered for a gst/hst account?)

Thankfully they shouldn’t (until you meet the requirements at least)

I just checked the Lego site. On sets for younger children there is no GST. On
individual parts, Lego continues to charge GST. I am going to take my cue from
that, and continue charging GST.

I heard the fine print on the GST tax break says that stores don't have to
comply.

But the ones who comply are less expensive and more attractive than the ones

The CRA website on the tax break/holiday says the opposite:

"As a shopper, you should automatically receive this tax break on the qualifying
items you buy. There should be no GST/HST charged on the item when you make your
purchase."

"What to do as a business that charges the GST/HST
From December 14, 2024, to February 15, 2025, do not charge the GST/HST on the
qualifying goods and services listed above."

https://www.canada.ca/en/services/taxes/child-and-family-benefits/gst-hst-holiday-tax-break.html

Note which words are in bold text on the CRA website.

Have other sellers contacted the CRA and been directed to any resource other
than the above link or bill C-78?

i just paid for an ebay bulk lego lot where ebay is responsible for collecting
GST, they did not collect GST on the purchase.

My reading of the new temporary GST rules is that it does not include collectible
toys or sales of toys targeted at adults.
