I would attempt to reach out to the seller and if they do not get back to you
in a reasonable amount of time then I recommend that you file a NSS against them.

Give the seller one week to respond.
After that, file an NSS on Bricklink and a PayPal claim via PayPal.
Sometimes, a package gets delayed for some time. Your was sent about 25 days
ago. It may still reappear on the surface!

NSS (Non-Shipping Seller)
If this doesn't get the seller to respond, file a PayPal claim (if you paid
via PayPal) or a chargeback with your credit card (if you paid via Stripe).

The hive mind is going to (correctly) tell you that the seller is wrong and that
the seller needs to make sure you get your product regardless of what they might
say in their terms.
Order lost. Seller refunds you 100%. Seller takes up the insurance claim with
courier. End of story.

I wouldn't bother communicating with the seller again. Just contact PayPal
and let them deal with it. You've given the seller the opportunity to put
it right and they have refused. I doubt it is worth filing a NSS here either.
It will be removed once the seller shows that they refunded you, even if they
needed to be forced to refund you.

There's always the off chance the seller doesn't respond to the NSS and
just lets it complete.

Never understood why BL allows filing an NSS when the payment is through PayPal.
Once the buyer contacts the seller and they don't respond or respond inadequately,
buyer has to file a claim with PayPal anyway to be refunded. Seller then files
proof of the refund and the NSS is removed. Seems like alot of unnecessary work
for the BL staff.
I've asked this numerous times on the forum, still don't know the answer.
I do understand the need for an NSS if the buyer did not pay with PayPal and
has no other recourse.

The seller is incorrect, they paid for the package and they would be the one
that had to file the claim.

When I see these types of terms in a store's policies (not responsible once
shipped, 5% paypal fee, etc.) I just dislike the store and shop elsewhere.
