One can disassemble parts that came assembled from LEGO and sell them New.
One can assemble minifigures (only once, and only minifigures) if they came unassembled
from LEGO¹ and sell them New.
Everything else is Used.

If you've removed the arms the parts are definitely no longer new. It hardly
fits into

Disassembly of legs is particularly bad as it can break the little nubs that
hold the legs on. Which Figure is it that needs hips switched out to make it
more valuable?

he is the only one doing it as this only came in a $240 set and there are several
sellers with multiples for sale as new.

same as the regular figure so it’s a bit funny so many do it (within $5))
