1. I discovered that this store has been adding fraudulent fees of 20% to their
orders.
2. According to their terms, they only charge a 5% PayPal fee.
3. They refused to cancel the order despite our request.
4. They won't abide by EU's right to cancel law
5. Bricklink initially suspended their store for a few days.
6. Although Bricklink canceled our order and later reinstated their selling account,
we have not received a refund.
7. Several Bricklink members have messaged me that this seller is notorious for
causing issues.

just read through his terms and this is a big red flag for me and against bricklink
TOS

"In any option you do not want a certificate, you must pay by bank transfer
or Paypal friend. (The rates are cheaper)"

he even listed the percentages for each EU country. Did it include countries

yes the sellers terms state that he must charge 21% for any order outside the
EU.

"Customers living outside of the European Union: These sales of consumer

they process the payment."

in the sales invoices.

Consequently, those exporting services and goods are exempt from VAT. This exemption
applies to sales to other companies as well as to individuals.

However, professionals and businessmen must inform the tax authorities of these
extra-Community transactions by means of form 303.

This is the EU directive. I personally don't know how Spain transposed this
directive. At any rate it is the Spanish law that counts and not the EU directive.

In Portugal, the copy of the invoice is not enough. We need the Transportation
Document (DAE) which only private carriers provide.

If Spain transposed the law the same way Portugal did, and the seller doesn't
want to use a private carrier (expensive) then he has to pay the 21% Spanish
VAT to his government on top of each order outside of EU.




  You will need to provide this proof to be able to fully deduct any receivable

it does not matter where the buyer is, the seller must adhere to the laws of
each country he is selling to.

besides bricklink TOS state that a buyer can cancel an order if the seller charges
outrages fees (Like charging 20% VAT for a buyer outside the EU) and Bricklink
TOS is above any store terms

According to his emails, he’s claiming that the 20% VAT charge is to cover the
20% VAT he incurs when purchasing the bricks. However, a fairer approach would
be to include the cost of goods in the price like everyone else on the platform.

in places like Canada and also Europe (i think at least) they get that money
back from the government if it was purchased for the business so there shouldn't
be a need to charge it onto the buyer if they are doing things properly
