Dear all,

I have a problem with a seller and I'm not sure what I can do.
I placed an order at a store, without instant checkout. Therefore the final s&h
fees as wells as additional fees were not clear to me when ordering besides what
he stated in his terms and conditions.

The invoice I got was with way higher handlings fees as stated in his terms and
therfore I asked the seller to cancle the order, since it was simply a joke and
not according to his terms and conditions (he wanted to charge me the whole order
twice by adding nearly 100 additional costs).

The seller did not responde and after some days just opend a NBP case against
me. I contaced him again and made clear, that I want to cancle the order, what
btw is completly according to his own terms and condition (14 Widerrufsrecht
in Germany) as wells as Bricklinks terms and conditions.

After two weeks now, the order has the status "cancelled", which I thought
was the end of the story now, but it also still says: "Cancelled (NBP completed)".
Also he gave me a negative feedback, while I cannot give any feedback to the
order due to "Feedback Removed by Administrator".

1. Is now a NBP strike on my account?
2. How can I go against all this? My actions are perfectly aligned to the Bricklink
Terms and conditions to cancle an order due to not noted fees as well as the
sellers terms and condition. I want to make sure I have no strike due to not
doing anything wrong as well as removing this negative feedback from my account.

I feel pretty abused by such a behaviour. Does anybody have a similar expirience
and knows how I can contact Bricklink about this?

Did you respond when he started the NPB to say that the shipping and handling
costs that you were invoiced were way higher than in the terms?

It is little wonder that people tend to prefer to shop in stores with instant
checkout when costs are known.

I did explain the situation in this NBP thread with my reasons. There was no
response from Bricklink at least and it just stayed open for two week until the
order got cancelled (I don' know by whom).

Yes the rating of the store is horrible and a lessons learned for me. I did not
check the feedback in the store before ordering, which was a mistake on my side
for sure!

Warum hast du keinen OCR gestellt? Überhöhte Versandkosten hätten dich dazu berechtigt.
Das Widerrufsrecht schützt dich weder vor einer negativen Bewertung, noch vor
den Folgen eines NPB innerhalb Bricklink.

Das hatte ich nicht auf dem Schirm, dass ich das machen müssten und sollte. So
schnell konnte ich aber garnicht schauen, da hat der Verkäufer schon auf NBP
gestellt und dann konnte ich daran nichts mehr ändern :/. Fürs nächste mal werde
ich mir das merken, danke!

For your seller:

Order Stats: 558 placed / 104 cancelled

Cancellation rate of 18% in the last 6 months.

Do you think after all this time, the lack of response from Bricklink while the
case was going on, he would have any chance now? I doubt

Proactive means wasted time and nerves which I would save myself in this situation.
I'm not saying it's an easy or right decision, especially when you have
strong arguments.

Regarding the right of the 3 NPBs cases, when looking at the seller's feedback,
the errors are minimized. I wouldn't worry about it

strike or not. It shows nothing to me anywhere and the order status just shows

If you can't leave feedback then it's a completed NBP - you can normally
leave feedback on Cancelled orders. However, replying to feedback is something
different. You can generally reply to Neutral and Negative feedback and this
appears under that feedback as a reply.

That big red cross indicates that you cannot leave feedback, so the NPB is completed
against you. You can try contacting the help desk (there is an email address
posted by one of the admins on the forum recently) explaining that you disagree
and that you did respond to the NPB, and then wait and see if they remove if.

That big red cross indicates that you cannot leave feedback, so the NPB is completed

sellers terms and condition. I want to make sure I have no strike due to not
doing anything wrong as well as removing this negative feedback from my account.

I feel pretty abused by such a behaviour. Does anybody have a similar expirience
and knows how I can contact Bricklink about this?

I'm not expert on EU/German law, but I'm pretty sure it is illegal for
a registered business to do this.

I am disappointed that BL is not more proactive is dealing with bad sellers who
have been on the platform for years with 1000s of feedback.

How this seller doesn't have 3 completed NSS with the amount of negative
and neutral feedback is a mystery to me.

Someone with 9,000 feedback and a 95% feedback rating should receive a suspension
until they can provide BL with an action plan to improve their service.

They have roughly a 20% cancellation rate, which means their terms don't
match what buyers expect.

I’m sorry to say that everything that has occurred here is Wrong!, Wrong!, Wrong!

Some sellers get suspended for receiving 3 NSS (even if there is no proof the
seller did’nt ship and it was simply lost) but other sellers can rack up multitudes
of negatives and be allowed to continue without even attempting to improve their
service. The sellers feedback shows that many buyers are largely dissatisfied
with that service hence what steps are Bricklink doing to improve overall selling
standards on this site?

With regards to penalising buyers with NPB’s and strikes I find this totality
unnecessary and I go back to the point of allowing buyers to cancel where no
Instant checkout is in place and essentially treat orders like this, like quotes
that can be cancelled at any time if buyer does not agree to the final fees/charges:-

When is Bricklink going to catch up with other platforms where feedback can only
be used for buyers to rate sellers not for sellers to have a hold over customers
and use for retaliation purposes!?
Either way there should be no need to leave negatives for their customers. Bad
buyers only need be blocked and reported to Bricklink in extreme cases whereupon
Bricklink can eventually remove from site when they receive a continued pattern
of bad behaviour!

Here is an update for everybody:

I don't know how it happend, but Bricklink now got involved in the end:
The status of the order was changed by a Bricklink Admin from "completed
(NBP)" to "pending". There was no reason given though. I took your
advice and immediately changed the order status to an official cancel request
"OCR", which now is completed one day later.

-- No NBP any more in my record, which is the most important thing for me
right now!

I still got the negative feedback from the seller and also the red cross for
not beeing able to leave feedback myself, which I hope will be removed also.
A request was made by me.

I also received a mail from Bricklink, that some help desk tickets went missing
over the last months due to technical issues. Maybe this was one of it and the
Admins never had the chance to have a look on the case. Why they found it in
the end ist unclear to me. What I can imagine is, that multiple cases like mine
where open in parallel for this specific seller and they had a look in all of
them. I saw him receiving a negativ feedback about it yesterday, which somehow
is today already removed... smh

Thanks for everybody giving here their opinion and advice on this case!

mutually agreed to remove it after issue was resolved

Unfortunately in your scenario the seller understands the loop holes in the systems
whereby upon opening an NPB against you they then hold all the cards whereby
you lose all rights to leave feedback.
It seems to be okay for them to have the right to tell everyone that you are
a bad buyer simply for overlooking their terms and not wanting to agree to their
hidden fees/charges but its not okay as a customer for you to leave your own
opinion about their unhelpful conduct and unwillingness to cancel. The seller
seemingly expects you to read through all their endless list of terms like you
have nothing better to do with your time besides which adding hidden fees should
not be encouraged here anyway.

The fact that this seller has received 1 negative and 1 neutral in every 30 transactions
this year is far too high and should be addressed if Bricklink is to be taken
seriously as a safe and inviting place for people to shop

Actually I did read his endless stupidity of text and the seller does note some
fees in them. The fees I received were actually way higher though and not even

That's even worse then!

On a side note... they ship to UK and yet a UK buyer would be expected to adhere
to all their terms which are only written in German. Yes a UK buyer could spend
more time using a translator but given they are not very accommodating it doesn't
bode very well for those that are not so proficient in using such third party
tools and yet still expected to understand their terms. The way they operate
their store is underhand and almost set up to trap people in using zero tolerance
approach to cancellations.
I don't understand why a seller would would want to force someone to buy
something they don't want since it doesn't bode well for their customer
feedback or any future custom either yet they don't even appear to care about
that either since they treat all customers with contempt!
