Following up on the just just send out newsletter;
It stated clearly that sets have to be marked as a custom set , instead as "incomplete"
when minifigures are missing.
As of now the rules on this are somewhat subject to point of view.
Also it states on the page before the definitions that incomplete sets status
does count when minififures are missing.
"Item For Sale Condition (New/Used) and Sub-Condition (Complete/Incomplete/Sealed)
must adhere to their respective Definitions. For example, sets which have been
previously built must be listed as Used. Sets without Minifigures must be listed
as Incomplete."
"Incomplete - Contents are brand new, but may have been removed from plastic
bags for inventory purposes or to remove other contents from the set. The set
is missing some of the contents, instructions or original box/packaging. The
description should clearly state what exactly is missing."
And can only be New when kept and stored in its package?
That would be fun for the sets with two capes in one box. I forget if it was
a Star Wars or Avengers set last month where I was about to flip my lid when
I didn't see a second box.
