| It seems like there is an increase in sellers listings USED figs as being in
NEW condition, but they put some like “looks new” or “like new” in the comments.
When I’m buying figs for my own collection, I’ll take the time to read the comments
and it’s not a huge deal. As a seller, however, it drives me nuts. When someone
lists a used fig as new, they usually sell it for well under the 6 month average,
which obviously affects what buyers believe is the average cost for actual new
figures. I know what they’re doing goes against BrickLink’s policy, but they
either didn’t get the memo or they don’t care.
As sellers, does this drive you bananas or do you just shrug it off? Do you keep
your new figs listed at a price that maintains a reasonable profit margin, or
do you cut your losses to compete with current average prices?

| report the listings here
https://www.bricklink.com/problemInventory.asp
and bricklink will take them down and then the rule-breaking competition will
be gone (if they relist it just report it again and if they keep violating then
bricklink will give harsher punishments)

Oh, wow. I had no idea that was a thing! Thanks so much for the link. I don’t
want to be “that person”, but it’s good to know I can do something if someone
is really driving down the price.

no worries also I'm pretty sure only the admins can see who reported a
listing so others wont know what you reported

I wouldn't worry about appearing that way - Bricklink gets lots of listing
reports from lots of different members who feel as a strongly as you do.
So if anything you would be 'an extra person in that group of people'

I’d think unless I pulled the figure out of the sealed box, it is in no way “new”.

You can still leave negative feedback, even if the refund. If you think a seller
purposely sells used as new and only refunds if caught, then leave appropriate
feedback to warn others.

I feel the same way when I purchase “new” and receive used. I just think to myself,
“seriously?!”. I think it makes me even angrier than most bc with the figs I
sell, spend the time and money to bag and seal each part separately so everything
arrives in excellent condition and there’s no question as to its condition. I
realize that might be a bit excessive, but I know I’d appreciate it when I buy
figs. Also, I’m a bit OCD 🙃

| This is why I wish there was some way for buyers to report to Bricklink admins
instances of suspected or confirmed instances of getting used when buying new.
X% and Y total number of “strikes” would lead to a suspension followed by eventual
ban.
There are a lot of obvious stores that are doing this.

Yep, I agree with you there, too many wrong listings.
Report them, it needs to be reported via the link in OP message.

If a seller lists a minifig as "New" but then puts in the description
comments "Like new" or "looks new" then the ambiguity shows that
it is not "new", but "used". Listings like this can be reported
to admin, and they will be removed.
There is no point in being driven "nuts" or "bananas" and there
is not point in "shrugging it off." Report incorrect or fraudulent listings.

| Honestly, I think the larger issue is how BrickLink allows assembled minifigures
to be listed as New. This is absurd to me, since when you piece two Lego parts
together there is a strain on the plastic, albeit small it is still a strain,
thus the condition is no longer "New". I really wish this would be changed,
it makes zero sense to me.

Me too - assembled Minifigures are just "Played once" by the Seller (who
stole the Buyer's pleasure to do it!)
But I think the problem is the definition of New in this case, as some Minifigures
can/could have been delivered in Sets partially assembled, IIRC and in the past?
Like for antique variations; and for the majority of recent Sets/Minfigures,
New Minifigures should be reserved to NOT assembled.
Yes, BrickLink, please change this!

If these aren’t new then Lego are selling used minifigures as new.

And the old standard was that the head would come already on the torso, even
for minifigures where you would have to take the head off to complete them (e.g.
Space minifigures with tanks)

How do they dare to not follow the definition of new vs. used?
We should all file an NSS against Lego along with a paypal claim and take them
down for this scam. All that is required is 3 NSSs!

A simple rule change saying they can be sold assembled where they were sold assembled
by lego would do. But the argument against is that some sellers have new stock
dating back years where they assembled them, and they would be penalised by the
change. Over the past decade, I've least favourited stores that say the assemble
them, either here or in their terms. I think I avoid most of them now.

100% agree with you and wish this also to change.
But then it's like versions, we've got to Catalog in which set this and
that was asembled, and maybe depending the era and factory What a mess.
I think sellers could make a Note, like for versions "Assembled as they were
in the Set" or such.
But then the normal listing would be disassembled.
