I'm new to collecting Star Wars minifigs, and previously I have just been
collecting CMFs.
In my three or so years of collecting CMFs and superhero minifigs, when it is
listed as 'new', it comes in the mail really new, typically unassembled
and with shiny almost polished surfaces.
I have been buying some SW minifigs in the past month or so, and after having
dealt with six or so sellers, only two sold me minifigs which are not assembled.
The assembled ones typically will have frayed kama or cape, discolored or nicked
parts.
On one occasion, minifigs had cracked torsos. (I had complained to the seller
and said he would only reimburse me the cost of the torso itself and not the
whole minifig).
Are SW minifigs so precious that obviously used ones are being listed as 'new'
even with frayed cloth parts? Is this common in the SW community?
I think people doing this sort of thing just don't care, because 99% of the
time they think they'll get away with it (ex. a buyer won't file an NSS
complaint or paypal claim to get things rectified)
I keep forgetting NSS is an option for this situation.

some shipping. If they don’t want to play nicely, then escalate to NSS and appropriate
feedback.

Assembling an item doesn't make it used, but yes there are some sellers who
pass off used as new. Personally, it doesn't bother me if the item is mint,
but anyone with experience can tell the difference between a little scuffing
in a box and playwear.
4 out of 6 orders defective is abnormally high.
I would start looking at feedback when you order, specifically the percent number
on the top right of the screen.
If it is below 99.5% and they mostly sell new items, stay away and add the seller
to your least favorites.
As for a refund, under Paypal terms the seller doesn't have to pay for return
shipping.
In your case, I would just file an NSS, let them know what kind of solution you
want and hopefully they just want to make the problem go away.
Getting a refund from Paypal is a pain. The last and only time I had to fight
a seller over a refund it took almost 30 days and I had to call and have them
appeal it because it was rejected at first.
I usually pay by credit card as well but have never had a dispute go so far as
to require a chargeback.

That's because assembled is regarded as a common and acceptable way to sell
them especially when it comes to ensuring all the parts are accounted for. It
also means there is less chance of damage/rubbing/scratches especially since
Minifig parts are generally more valuable than generic parts however the fact
that you have typically received poorer quality 'Assembled' minifigures
is down to poor seller standards rather poor selling practices. I sell all my
minifigs assembled and have never received any complaints as my feedback will
show!
That said I rarely if ever assemble capes since this can leave permanent creases
therefore I prefer to let the buyer apply this themselves.

This is only an acceptable resolution if you mutually agree to it since they
have not provided you with what was purchased which was a New complete minifigure

I don' think its a very common practice but you need to check the proportion
of negative and neutrals as this will be very telling about how the seller conducts
business. As for fraying this is extremely unusual with Lego capes and therefore
I would question their legitimacy. The only Lego capes I can think of that do
fray are those belonging to really old minifigs such as classic Cloud City Lando
but I stand to be corrected?
Either way you could always show people here what you've received as if they
are truly shocking people may even advise that you report the seller(s) to bricklink
