Under the current definition of NEW, taken from
https://www.bricklink.com/help.asp?helpID=102

Parts that are scratched during storage, are factory seconds, brittle, yellowed
etc can be listed as NEW with no qualifications, as long as they came out of
a sealed set.

In an extreme example, I could run over a set with my car and list the parts
as NEW, even though a significant portion of the pieces would be damaged.

My suggestion is simple.

Add the same requirement for disclosure to NEW parts as applies to USED parts
if there is damage.

You can actually just copy and paste the exact text from USED Parts, "If
the parts show excessive wear, discoloration, excessive scratches, other marks,
etc, this should be noted in the item description. "

There are already people listing used items as new. I imagine doing this would
just lead to even more of that behaviour. If a part has excessive wear, it has
been used. New parts may get scratched in factory or storage but they should
not get signs of wear unless they are used.
