If you break them, then it is your responsibility. If you want to avoid it happening,
don't buy the affected colours from the bad period.
Agreed. And I’d put fault on LEGO for making brittle colors like dark red, dark
brown, etc. as it should never happen to begin with.

comments to the seller as he/she is selling brittle item? Or how to protect
the seller on this topic?
When I put myself as a buyer, I would challenge / wonder why the seller still
going to sell, if they know they are brittle. Or putting a disclaimer to state
about the brittle items are for display purpose only would be better? I totally
under it's LEGO's fault. But how LEGO will compensate the lost of the
brittle item owner? (as most of the brittle minifig are already retired, and
cannot be replaced)

unfortunately you cant always tell if a part is brittle or not. sometimes the
seller may simply not know of brittle brown and other times they could miss it
as it didn't affect every set during the affected
