if tax had to be collected then payment must be made onsite otherwise its a big
problem. Bricklink must collect tax. try refunding the buyer (complicated if
paid in cash possibly) and ask them to pay onsite

Yeah, that would be seen as tax evasion.

Note that the buyer should have read the (scary) “pay onsite, don’t listen to
what the seller says” banner added to onsite invoices.  So they should have at
least talked to you about it….

I meant legal workaround

  Note that the buyer should have read the (scary) “pay onsite, don’t listen to

Okay, then the tax problem remains if it’s not cancelled (and refunded) (or refunded
and re-paid).

The site is now required to collect and remit all requisite taxes: sales, use,
VAT, etc. Btw "etc" is coming

For cash, Lisa, I suggest keeping such transactions offline:

Thank you, thank you everyone.

Rest assured, I was NOT trying to avoid BrickLink fees, or to avoid state sales
tax. And I said as much to the buyer. I was only trying to avoid the Paypal fees
of 53 cents to accept one dollar! (although with our tax, it would have been
a whole $1.09)

It would be nice if BrickLink was able to let us do that (take cash or other
payments), and to charge the seller the tax due, just as they now remove tax
from the payment when it is online.

That way, I could have taken the $1.09 from my buyer, and since BrickLink knows
how much tax is due, if they can't get it from the buyer, then they get it
from the seller, and they are not in violation of anything.

It could be set up as a fee a seller pays, just like the BrickLink fees.

That’s why it’s the marketplace that has to do it.

I think the reason why marketplace taxes came to be wasn't because stores
couldn't register or be authorized to collect taxes - it's because they
simply weren't so the various countries were missing out on a lot of sales
tax that was slipping through at the borders. Many countries have regulations
that dictate if you sold $X of sales to people within their country, you're
to register for tax collection and remittance, but that's basically impossible
to enforce unless it was a very large store that was abusing it and they could
trace it from import data. Not to mention that global e-commerce puts a much
larger strain on customs for processing not only the content for safety/regulations,
but the total tax due upon import as more and more order from around the world.

I know in Canada, one of the big ones they targeted first was digital sales.
The "Netflix tax" as some call it. US company selling digital services
across the border making millions of sales, but the Canadian government not seeing
a dime of sales tax as there was nothing tangible to stop it at the border. Paying
BL for our fees is another example.

For most global stores, they may only have a small footprint in each particular
country not hitting the threshold required to register. And it also goes down
to the province/state level usually as well so small stores like many that run
on a platform like BL could never manage this alone. Just look at how BrickLink
is struggling and they have access to a tax team/company to assist (not to mention,
the backing of LEGO Group). So instead they target the aggregate, being the marketplace
platform as a whole and hope that the marketplace can handle the intricacies
of tax collection and remittance.

Of course.
I just said “sellers aren’t registered,” I didn’t say why they aren’t
I then said “that’s why the marketplace has to do it” because I meant: the sellers
aren’t registered but the marketplace is (has to be), so, legally, it’s the only
one who can.
Why the sellers aren’t registered and why the marketplace has to be and why governments
made marketplace laws are different matters.

As you say, why sellers aren’t registered is because they don’t register and
are not obligated to: some really sell not enough to bother, some just stop below
the $X threshold you mention or pretend not to (fake sibling companies).
But even if you remove the threshold (lower it to $0) it’s unenforceable: too
many people to check, most of which are out of jurisdiction, for very little
to gain.
But all those small amounts add up to a hefty total and most go through a few
online marketplaces.
That’s why they made marketplace laws: the marketplaces are big enough and can
control their sellers.  Win-win for governments: money in without having to manage
all the small sellers, only the big marketplaces.

The “Netflix tax” is related but a different matter: it’s one big company and
it’s a service.  Marketplaces sell (mostly) goods.
It helped governments wake up to “online” but, really, it’s South Dakota vs.
Wayfair that started the marketplace (facilitators) laws in the US, and the shenanigans
of some companies in the EU.
Shenanigans in EU:
1. Move wares from abroad to your own warehouse inside EU: you don’t pay import
VAT because it’s not been sold yet; then sell from your out-of-EU website but
distribute from inside EU and no VAT (it’s already in EU, no added-value in EU,
no VAT).
2. Giant marketplaces, like Amazon & AliExpress, with lots of very small sellers,
billions of very small untaxed sales (below the €20 threshold, or sent as ‘gift’
or without proper papers).

But then again, I was just commenting on those facts: sellers are not allowed
to collect, BrickLink is.  And the laws have made it this way: even if you’ve
your own website and are registered to collect in other countries, you can’t
collect for the sales you make through the marketplace.

I still can't figure out why buyers in my store see a banner that says "Seller
does not support orders shipping to California"... It clearly says in my
store terms that I ship to all countries worldwide!
