And if the sub-set isn't a minifigure at all, then it can't be sold as
New while having been assembled, is that the general consensus?

Built minifigs can be sold as New historically because sometimes they come built.
Also, what happens to existing store listings when BL finally turns off this
rule. Nightmare.
There's never been any thing about selling built sets as New whether they
are advent or not, I don't see the difference.

I brought up these sub-sets specifically since (a) I saw some listings like this
and (b) they're small, packaged in clear polybags, and (c) I guess one could
argue that they're special assemblies. Just wanted confirmation before I
start reporting the listings.

But I have heard at least 2 contra arguments from dealers thar have at least
some merit.
1) less potential to scratch in shipping when assembled.
2) If displayed in a brick-and-mortar store, along with a bricklink listing,
clients at the brick-and-mortar browse the assembled figures.
A few other notes:
1) Some new figures come assembled (DK books, Minifigure promo sets)
2) Some dealers are unfortunately sketch - and list used figures as new, considering
new as a commentary on condition - totally against the rules, but it does happen.

on the flip side, it also starts to stress the parts. Most heads form a stress
line these days as soon as they are added to a torso, and the torso will have
pressure from the legs casuing possible cracks

Yes, I agree with this, assuming it's packed separately. Still - if I'm
ordering a minifigure because I want to part it out, I'd much rather it not
be assembled!

Sure. In fact in the old days minifigures typically came with the head already
on the torso, even in cases where you had to take the head off to assemble it
fully (like with an airtank).

You put the minifig parts in a small baggie and nothing moves or gets scratched.

I have struggled with this a couple of times myself. 95% of the time I part sets
myself and place "New never assembled" in my New listing. The have been
a minor of figs assembled by others during a parting out which I have listed
as "new assembled'.
