Hello,

I made an order #24772841 in March in the French store called 'La brique
dorée'. The package was sent by Colissimo International and then handed over
to DPD, however it never reached the destination (though on their website it
states the recipient wasn't at home, which is not true, but that doesn't
matter right now). According to their tracking system it was sent back to seller,
but probably got lost somewhere.

I contacted the seller, he made a complaint a month ago but that was the last
time he responded to my emails. I am not able to check the status of the package
and of the complaint. I don't know if he got any compensation from the company.
He ignores my completely.

I lost almost 400 Euros which is a lot to me, and I don't know how can I
get it back. I tried to contact bricklink admins, but no response here as well.
Is there any way I can get my money back? This is absolutely crazy..

Open a Paypaldispute on the Paypal website.
On Bricklink start a NSS complaint. https://www.bricklink.com/v3/user/confirmation_code_required.page?returnTo=/retractOrder.asp

I paid with a bank transfer, not paypal. I've started that NSS complaint,
according to the info I can cancel the order now, but will it help me get my
money back? I'm attaching a screenshot of it.

You can try contacting your bank and telling them what happened. Bricklink won't
be able to intervene for you.

Paypal exists for a reason, in situations like this, buyers have almost no recourses
to have their money back.

hi

some help, see here and also in your language

If you shop online, e.g. B. in an online shop based in another EU country, the
retailer is responsible for ensuring that the ordered goods actually reach you.
If the ordered goods are damaged or lost during shipping, you can request your
money back. The retailer is also liable for the loss of returns – throughout
Europe

Then it's ok! As a buyer on Bricklink, it's not clear to me. Then he
should/must also adjust his terms of sale accordingly.

Yes, and this is also required by French laws.

Like other things he has to change

Colissimo is a serious shipping method; if the parcel has been insured he's
been refunded if lots (in fact 70% of the price, but it's another story).

You could try to post on his Facebook page - see its link on his Terms page.

Otherwise he should be closed temporarily for those Terms, at least:

This is forbidden in France:

"Every order will have to pe paid via a bank transfer (without any additional
costs), via Stripe (0€25 and 2% additional costs), or via Paypal (0€25 and 4%
additional costs)."

This also:

In case of loss or deterioration during transportation for non-insured parcels,
La Brique Dorée can't be held responsible.

This is forbidden on BrickLink and PayPal:

Please note that a Paypal payment "between friends" is possible. However,
we kindly ask you to make the request at the moment when you order, otherwise
Paypal traditional fees will be applied.

And so on...

Please NSS, report the Shop, post on Facebook, contact your bank.
Maybe you have it, or it's probably easy to find it, place him a phone call?

Presumably to avoid paying the 16 Euro PayPal fee that the seller was passing
on to the buyer.

Saving 16€ while risking to lose 400€, I wouldn't.
I'm not sure the reasons behind this?

Some Countries (like NL apparently) don't use much Credit/Debit cards, it
may then be more difficult to pay with PayPal.

Maybe it's cultural, like an habit - in DE they use SEPA a lot AFAIK.

Maybe people don't know that PayPal is FAR safer, especially cross-borders?

I'm still puzzled about this.

I assume it is that the seller has decent feedback so is not likely to be a scammer
so it is unlikely that they won't send it, and things rarely go missing in
the post especially if tracked so it is unlikely to get lost. So why pay the
seller's extra PayPal fees when the chance of it going wrong are so small.

Then it goes wrong.

Thank you for your reply. I used IBAN because first - it was free of extra charges
and second - I have a really bad experience with Paypal, as ~15 years ago they
charged me over 500 dollars for the order I haven't made and it was extremely
difficult to get that money back.

Colissimo on the other hand turned out to be completely unprofessional, they
weren't even able to communicate in English.

I couldn't find his number HOWEVER today, after cancelling the order he finally
responded. I was advised by a European Customer Center consultant to give him
an ultimate date when he should transfer my money back - if he won't, then
they are going to take necessary steps.

Sincerely it's changed since 2000 or such.
Now PayPal is officially a Bank, their Buyer protection works in the vast majority
of the cases (99.99% of cases?)
Never had have any problem with us, pro or private.

Colissimo on the other hand turned out to be completely unprofessional, they
weren't even able to communicate in English.

Colissimo International is our French most expensive shipping method (apart courriers
like DHL, UPS, Fedex...) and they're reliable.

I'm not sure what you mean about communication, but they provide a tracking
in English.

If any problem, it's to the seller to communicate, not the one who receives
the parcel (and probably for all postal systems).

I couldn't find his number HOWEVER today, after cancelling the order he finally
responded.

He did? I hope it's a positive reply for you!

I called French Post first and they gave me a direct number to the Colissimo
Information Center, I called them 3 or 4 times but each time I was asked to speak
French - when I said I cannot, they... hung up. The tracking is indeed in English
though, you're right about that.

It is also true it is no my responsibility to contact the shipping company. That's
exactly what I've been told by the lawyer and ECC consultant, so now I am
just waiting for his move.

Thank you for your time and help

They are French, therefore they don’t speak English.
La Poste’s site isn’t available in English, other national postal services’ sites
are.

Indeed… and therefore, if a recipient contacts them, they don’t understand why
and brush them off.

Could be

And “someone else is (not) doing it!” isn’t a valid excuse.

Is English just badly pronounced French?

Quand la langue française envahissait l'anglais

Bernard Cerquiglini - La langue anglaise n'existe pas : c'est du français
mal prononcé

Well, when Académie Française realizes that it's actually the 21st century
and not the 16th, maybe more people will be willing to learn the language.

Sounds like someone got a completed NSS and now wants to do something about it.
