| Hi, I am a seller and a recent international order was damaged. The buyer sent
me the pics and it looks like the package was run over. The package and label
are clearly damaged. I will gladly insure packages if requested and paid for
but this package did not have insurance. The buyer wants a refund and it's
like $40. Do I have to refund the shipment? I feel for the buyer for sure but
not sure I have to take the hit here. I do have in my shipping terms that if
you don't buy insurance then I am not responsible but maybe that is not true.
Any help would be appreciated.

| Refund, learn, and move on. You are responsible despite terms. Also, packages
that have "tire" treads that look like they were run over may have been
inserted into a USPS sorting machine that isn't designed for rigid items
and only for flats/envelopes.

More like if you can’t afford to risk it then require insurance. In general you’ll
make more money in the long run if you don’t buy insurance for every order but
say you get a $100 order adding insurance for peace of mind can be helpful but
if you get a $10 order it’s not worth it. And also that the seller is fully responsible
for the delivery of the package and any damage it gets during shipping and that
insurance is for the seller not the buyer

I once heard someone say something to the effect of "Insurance is for the
seller, not the buyer." You can either raise your shipping prices and buy
insurance automatically for all of your orders, or you can self-insure and
put a little money aside from each order, to cover situations like this yourself.

No, that is not true. Generally speaking, the seller is responsible for ensuring
that the package is delivered to the buyer.

On the rare occasion I send a package internationally I put it in a box, since
it's usually not a matter of ounces like it might be domestically.

| Hello,
I ship a lot overseas and use a lot of bubble mailers. Tip is to put some packing
chips in that will protect the lego pieces great. For example a fig in a bubble
mailer that gets stuck in the sorting machine does not have a chance, but with
packing chips they will probably take the hit before the fig. Extra plus is that
chips doesn’t add weight like a cardboard box would have done.

I wrap every bag of parts in a piece of bubble wrap (e.g. from Amazon bubble
mailers) and then put that into a larger bubble wrap envelope. It’s a little
extra insurance that if the packaged is banged up it still gets there ok.
For the OP here… what else besides the DBG legs were damaged to impact $40? Can
you replace any of the parts for them?

Just a thought...Is only the legs damaged? Maybe it would be cheaper to offer
to send another pair of legs? Or to refund only for the legs? Maybe the buyer
would work with you on it. If you offer different solutions and apologize for
the problem most buyers can understand what happened and work to get it fixed.

interesting as (if counting the USA) I've shipped countless hundreds of orders
in bubble mailers without issue. (outside of Canada/the USA its getting close
to 100 orders most of which are bubble envelopes without issue)

| Interesting to read... did you also start shipping in bubble enveloppes? I had
initially as shipping policy that I can ship up to 500g in bubble enveloppe,
but in the three orders I received there were minifigures, so I did not dare
to send the enveloppe, but ended up sending a box (which was most expensive than
the invoiced price... :S).
How do people normally start? Is it worthy taking the risk of sending a minifigure
in a bubble enveloppe? Specially at the beginning of a shop?

| I started and continued with bubble envelopes. if its a fragile item I ship it
in a box but pretty much everything else (if it can fit) goes in an bubble envelope

| I'll second that. When shipping from the US, once you get past 8 ounces int'l
postage is calculated by the pound.

It may also be that the package was caught in a mail sorting machine, and the
marks/damage were caused by the belts.

Refund and move on.
My first question would be why did you ship the order in a bubble mailer instead
of a box?
It looks like the order was just for a single minifigure, so placing the item
in a box wouldn't have cost additional postage.
Second, I would consider whether it is worthwhile to conduct business internationally,
when US by far has the largest market of buyers. Europe and China net export
LEGO, rest of the world imports.
Third, you can't legally claim in your terms, you don't accept responsibility
for lost or damaged packages (and least between a buyer and seller in the
US).
You as the seller have a legal responsibility to provide the buyer with the goods
promised in the time frame promised. Anything less is fraud.
If this is a problem for you, then require insurance on every order.
