  The only things I can think of is:

1) sending someone replacement parts due to missing parts that fell out of a
broken envelope
2) Someone inquired if I take any payments that isnt paypal, but I didnt engage
or sell this person anything
3) A buyer failed to pay and I forgot to cancel the order.

Not sure what else is there.

Those three reasons don't sound problematic.

You have a very low lot limit of 7 lots. Was there anything in your terms suggesting
that buyers could buy more by contacting you, or something similar that could
be perceived as advertising here but arranging orders away from bricklink?

To be fair, it was a way to artificially make your store appear cheaper than
it actually is on the price guide. This in itself is not entirely 'honest'.
If you want 1.10 for a part, list it at 1.10, not 1.00 with a surprise 10% fee.

I can't tell if you're serious. You can have low prices.

You can't have PRETEND low prices. Low prices that you raise back (after
they order and after BL gets their fees) by adding fees.

That is obvious not why you are suspended.

If you are making out that you are suspended for some bogus reason, it may well
be that the admins reading it won't remove the suspension.

A common fee avoidance tactic is to charge a 10% handling fee, essentially meaning
you are selling for 10% more, but only paying your fees on the list price. Did
you do that?

Yes I did have the additional handling fee, but I guess I did not know that would
be considered fee avoidance. It was just handling fee that I charged in the
option 1 category.

Is it possible to restore my account? Was not my intention to avoid any fees
and I can remove the handling fee.

A handling fee is okay as long as it isn't a percentage or really big.
A suspension like this probably happens when someone sees it and reports it.

Don't know if this is for the OP or Bricklink. Bricklink does let big sellers
get away with stuff, in my opinion, like havinh lots of negatives or neutrals.
An argument about large numbers of feedbacks that are poor, is a those small
percentage of sales. But there is a limit of 3 NSS no matter if the seller has
one feedback or thousands.
As for the seller not knowing that adding a percentage fee is not a way to increase
buyers prices and is unfair is a stretch. If the OP does not know this, he/she
should not be selling.

during checkout so basicly he can charge whatever he wants.

I'm sorry, maybe I don't understand VAT, but why is this being charged
to the buyer? When I ordered from this seller, I was charged tax at the full
Colorado, USA rate. Why should I have to pay VAT in addition to tax? And not
only that, but pay VAT on the tax I already paid? I made a $105 order that turned
into $178 after shipping, tax, 10% handling, and the 25% charge. That's absolutely
ridiculous. And to rankster's point, I believe that the seller is overcharging
shipping too, since the same weight, same postal service, same package size is
significantly cheaper from other Danish sellers.

Double-taxing: Denmark’s VAT is due to Denmark.  Colorado’s sales tax is due
to Colorado.  Two different, independant entities that each charge the taxes
they want.


I think we see here the effect of the difference between sales tax and VAT:
— Sales tax is levied on the final buyer only.
— VAT is levied every steps of the way to the final buyer.  One could say it’s
due by the seller and only transfered to the buyer.

Anything you sell, you owe VAT on it.  (And if you’re registered, anything you
buy, you can get its VAT refunded.)

Under certain conditions (exportation or selling to a VAT-registered buyer),
the seller can reduce the rate to 0%.

But even in the “normal” VAT scheme (that is, not margin scheme), if the seller
can’t prove they exported the product, they need to remitt the VAT.  So they
need to collect it first.

In the margin scheme, the conditions seem to be harsher, so this store can’t
reduce the rate to 0%.  So they need to remitt 20% of their total (1 - 1/1.25
= 0.2 = 20%) as VAT, so they need to collect it.


   And not only that, but pay VAT on the tax I already paid?

Yeah, that’s not right: it should be the other way around.  You should pay Sales
tax on the VAT.
What is exported from Denmark is ($105 + shipping & handling) + 25% VAT.  And
that total should be taxed by Colorado as being sold to you, in Colorado.

But the way the fees work on BL make it work the wrong way.
(Doesn’t change anything to you at it’s all commutative multiplications.  But
I’m not sure Colorado likes it.)

It's far too complicated. BrickLink is NOT designed for margin scheme, seller
may not understand all the laws and what he's to invoice, and his accounting
people will probably have another opinion

Too much work and uncertainity for probably nothing significant.

No and yes.

The store does not use margin scheme it’s VAT registered. But the problem is
margin scheme related anyway.

When you sell NEW items and are VAT registered there’s no problem as you are
able to deduct VAT on all stock you puts in to the store.

If you sell USED items in a VAT registered store you pay full VAT without having
any VAT from your purchases to deduct. Effectively you pay double VAT compared
to the store selling NEW items.

To be fair and equal the tax between selling NEW and USED in EU we have the margin
scheme. Selling used then gives you exactly the same VAT taxes as the store selling
new.

But.

BrickLink does not support Margin scheme, instead the non VAT registered store
are seen as “private seller” that are not allowed to sell for more than 10 000
euro/year (EU-sales). Once the store reaches that threshold BrickLink shuts down
it’s selling abilities to EU countries for the rest of that year.

What this Danish seller are doing is to sell USED, registered to VAT so that
the store won’t be shut down at the threshold, and also adding 25 % on price
to level out the tax situation with stores selling NEW.

Not the best solution maybe, but we are many USED sellers in the EU that are
struggle with the fact that there are rules in EU to equal competition between
selling NEW versus USED - but BrickLink don’t letting us use them.
