I purchased several minifgs from a seller here on BL who has a bit over 100 reviews,
all positive.
When I received the items, they looked good, but they have been advertised as
new.
Some minifgs had been assembled, some not. As we all know, for some reason all
minifigs usually have that way of the legs and arms to be set when they come
of the box. Not in this case. All of them had been straight and some of them
move way to easy to be new.
Minifigs with capes had the capes creased, meaning getting them on the minifigs
was too easy as the cape was already bent that way.
I wrote the seller a message 10 days ago, asking for confirmation that hey had
been in fact new. No mean message, just voicing my concern and asking.
No response at all. The seller is still active as others left feedback for him
in the last couple of days meaning he still shipped things and should have read
my message.
I will keep the minifigs as they work for me and my collection, they look new,
except for me knowing that they "feel" not new.
Now I am asking how to proceed? I want to leave feedback, but want to be fair
to the seller, this is why I asked him about the minifigs. Now that he did not
respond I am not sure how to proceed.

some people assemble new figures which is allowed on bricklink. the arms may
be pushed down so they don't stick up and possibly get damaged in shipping
or poke the envelope. they might have originally had the capes on but then removed
them before shipping (not good since that would involve partially disassembling
the figure and it would no longer be new)
And unfortunately some people scam buyers by selling used items as if they're
new. My advice is to to go with your gut. If you really believe he sold you
used items, leave him a negative feedback (especially if he can't even bother
to respond to you). He will no doubt retaliate, but no one really cares about
1 or 2 retaliatory negatives on a buyer. It won't hurt you, but you might
save someone else from having a bad experience with this seller. Since you don't
have a lot of space for feedback, if it was me, I'd go with something like
"Bought new. Suspect he sent used. Unresponsive." if that fits.

As a buyer, if something is not quite right about my order, I ask myself "Did
I get what I wanted, was the condition good enough, and was the order packed
well and shipped fast."
Then I decide if the broken/missing/ or used/new piece(s) are enough to warrant
contacting the seller to see if they can in fact fix the things wrong.
Will I contact the seller if it was 1 or 2 pieces that were no more than a couple
cents? No, absolutely not. These are easy pieces to replace and not worth bothering
the seller about. If I buy new and the pieces/minifigs look new and I have everything
I bought than again I will not bother the seller, but I may make a notation under
the bookmark for that store that new may not be new but was in good condition.
If I am missing several parts and/or there are broken parts and/or the wrong
color or variation and those pieces are more than $1.00 worth of parts, then
I will absolutely contact the seller and continue to do so every day for 5 days
until they respond. If I get no response within 5 days, I will initiate a NRS
(non-responding seller). I have only had to do this 1 time in 19 years.
The choice is yours on what you do. You have to decide if you are okay with your
order. If you are not okay with it then contact the seller again until they respond
or 5 days have elapsed and file an NRS. That should get their attention!
