Hello,

I am writing because I have just been the subject of a purchase/sale that could
be identified as fraud. To sum it up:

- I buy two sets from a seller (he has only 2 reviews)
- The two sets were listed as New and Sealed.
- Specifically they are :
76240 Batman Batmobile Tumbler - 140€.
10264 Corner Garage - 170€.
( as you can see the price is good/low)

- I made the purchase
- They were sent without a protective box, the two sets were packed in two black
plastic bags.
- They arrived with the packaging intact, the black plastic was correct, without
any cuts.
- I open the bags and the two sets were with the boxes broken, wrinkled, worn,
with the tips in very bad condition. Typical of a very badly preserved second
hand set.

- I contact the seller and the answer is:
"The sets were new, sealed and in perfect condition when we sent them. End
of story."

- I complain to Bricklink but Bricklink only responds if it hasn't been paid
for, or if it hasn't arrived, nothing else.
- The seller notifies that he has sent everything well. (End of Story.)
- I have photographs of the sets and all of us, who know about Lego, will clearly
identify the defects as a Used Set.

The result is that I have paid for two new sets, that turned out to be old, and
have no option to return them. Is an absolute lack of protection.
I am complaining to Paypal, it is the only option for now.

We as a buyers are completely unprotected in Bricklink.

I should have noticed that this seller only has 2 reviews...

I will continue to take whatever action is necessary to prevent Bricklink from
losing credibility because it is clear that without protection I will not buy
again in Bricklink.
And to prevent this situation from happening to another buyer.

As a measure especially for Bricklink's credibility, I believe that a mechanism
to withhold payment until the transaction is secured should be implemented.

If anyone has been in a similar situation I encourage you to report it and let's
lobby for the good of Bricklink and honest buyers and sellers.

Not true. You mentioned you paid with PayPal. Whenever you make a purchase make
sure you pay with PayPal (or for extra security pay thru a credit card on your
PayPal account) and if any issue ever arrives you can simply tell PayPal and
they will side with you pretty much every time to the point where sellers have
very little protection so you should be all good. You mentioned it was a low
feedback user so they probably just shipped it out as cheap as they could without
any care for the packages which is sad so you can leave negative feedback if
the seller doesn’t make it right to help other potential buyers know about him

Ask for a picture before you make a purchase. Especially one that high price
from a low feedback seller. Even ask them to ship in a suitable shipping box.

How do you think they should protect you? You already have paypal protection.
Relying on buyers to say they are happy would put power into the hands of scammer
buyers. As buyers choose sellers, this would lead to sellers being scammed.

They have clearly not packaged the sets at all well. Are they actually sealed?
If they are then they are new and you can leave negative feedback for the seller
saying what the problem is. Ask the seller for a return and refund and if the
seller refuses a refund, then contact PayPal.

  As a measure especially for Bricklink's credibility, I believe that a mechanism
to withhold payment until the transaction is secured should be implemented.

This is a real problem since bricklink are then involved directly in the transaction.
If a buyer is a scammer, then they will claim fraud. It is then word against
word and bricklink staff would need to decide who is right.

If a buyer doesn't mark as complete, then the seller won't get paid for
six months.

Complicated case...

1) Even with a damaged box, they may have been New and Sealed.
New doesn't mean Mint - just unopened from shop or factory.
However a good shop would've carefully described its condition.

2) You simply shouldn't buy 200+€ Sets from a 2 FB shop without at least
asking for pictures and MANY details. Your decision is, sorry to say, part of
the problem here.

3) It's not a new fraud. Protection already exists. It's called BrickLink
NSS and PayPal.

And...do not discount a fraudulant sale is infact illegal in every country on
our conjoined planets. There is zero exception to that rule

A "New" set is one whose parts haven't been used - the box being
in worn condition does not make the set "Used". Now I think you do have
a valid complaint about the state of the boxes but your description above isn't
necessarily correct.

Sorry you had a bad experience with the seller. I have found that its not a good
idea to buy large $$ items from new seller anywhere (here, ebay, etc) as the
liklihood of a bad experience is all t hat much higher. I would also ask about
box condition if it is important to me. To that point, the seller DID ship the
items, and they appear to be correct if if they are beat up. Shame on the seller
for not using a box...

I would also say I get sets direct from LEGO that look similar... 2 weeks ago
I got the new modular (pizza shop) set delivered with a hole in the outer shipping
box and pieces on my porch. Turns out the free gift VIP bag exploded in the box
and lost over half of the parts in transit.

Perhaps consider neutral feedback that purchase was delivered but packaged poorly
and the sets are damaged etc.

BrickLink is a market place just as for example E-Bay. The market place can’t
take responsibility in the transactions as they aren’t involved. All marketplaces
has a feedback system to provide essential information for seller and buyer to
make vise decision about a transaction. This is vital for the most things we
all do online.

Guess you failed right there.

Also - I suspect that you paid with f and f. Because if you didn’t - then you
wouldn’t need to cry out over BrickLink in the forum just use your buyer protection
that you have with PayPal.

Second fail there.

But we all have done mistakes online. And we learn. So do you.

After a while you will come over this and there are many great deals waiting
for you in the future, I’ll bet!
