So, I accidentally shipped a $60 order to the wrong person and they are now ignoring
all my emails. I sent them a pre-paid shipping label and asked them to use it
to ship the package to the right person and they are clearly not going to. They
opened the package and built the set inside well knowing it was not theirs.

I have refunded the buyer for this order, but now I am looking for some way for
myself to get a refund. Does anyone know if PayPal has any seller protection
for this type of situation?

Very disappointing that some folks are like that.

As far as I know, the seller has no such protection; Paypal would have no one
to charge back. I am afraid this is one of life's hard lessons.

sadly if you sent it to them, there is nothing you can do, US laws support this
stance even. and no, paypal will not refund you if you sent it to the wrong person.

We have something similar in the UK, if the company has purposely sent unsolicited
goods. However, we also have law that if it is sent by mistake then the receiver
cannot keep the goods and should return them (at the seller's expense). So,
for example, if they send the wrong item, then they can request that you return
it at their expense, although if postage is more than the item value they may
say to keep it. By default, the buyer doesn't get to keep the wrong one and
also get the correct one or a refund.

Our law is exactly that no receiver may keep goods sent by mistake. Senders pay
the return postage or courier costs. The recipient can choose to keep the goods,
but then must pay for it. It is actually a consumer law offence to do otherwise.

I m still a bit a confused about PayPal's new rules from September 2020:
Receiving Payments – Impact of PayPal Buyer Protection on Sellers

We have amended the wording in the "Impact of PayPal Buyer Protection on
Sellers" sub-section: If you are a seller and lose a claim under PayPal Buyer
Protection and the buyer’s claim was that the item received was Significantly
Not as Described, you may not receive the item back, or you may be required to
accept the item back and pay for the return shipping costs.


For us certainly, there is not even a question - no recipient is allowed to keep
the goods, even if it is a SNAD claim, incorrect shipment (which is technically
also not as described) or used as new. The only time a recipient is required
to pay for the return shipping here is when they cool off or they have damaged
the goods themselves.

Why not? Joy.Brix has probably swapped the labels. Each of the two received the
other's set.

I read it as the buyer of the set received nothing but a refund.
